Harassment of my son in the Navy
My son has been receiving harassing phone calls from these inept collectors and it is causing him to stress out. He was incorrectly charged while he was in boot camp ( he's in the Navy) and his account went into further debt through no fault of his own. He had called and made arrangements with them before he left for boot camp!
Now FIA card services has sent his account to a collection agency which is threatening him and calling him continuously. I resent the fact that he is being hounded by this agency while he is trying to do his job in the Navy. He was once again incorrectly charged and is now further in debt because they deducted funds on the wrong date. They are threatening to sue him. I say screw them, let them sue. He's already in collections because of their idiocy.

fraud and scam
I have a Bank of America account. I deal with the bank nearly always by the Internet or telephone as I travel often. Awhile back I ordered a CD that paid 5% interest. I knew roughly the date when the CD would mature, but not exactly when, as the bank didn't include details of it in my bank statements. I received a letter from the bank that my Cd had matured and the bank had rolled it over to another CD paying only 1.59%. I hadn't asked the bank to roll the CD over, they do it without asking.
I could see on the Internet that the Bank of America was at this time offering interest rates of 2.5% on CD's. I applied online for another CD with the higher interest rate. Knowing that if I changed the CD that the bank had given me within 10 days there wouldn't be a penalty.
After a wait of several days the bank emailed me that I couldn't apply for a new CD online, but had to contact my personal bank for one. Seems the online offers are for attracting new customers. I contacted my representative by email asking for the CD to be changed for one with the going interest rate. There wasn't a response from her, I inquired again a few days later and was told that I had exceeded the time limit and would be penalized three months interest if I changed CD's.
My sister, who also has a Bank of America account, had the same experience. The bank must save a lot of money by paying less than the current interest rate. Another thing about the Bank of America is their horrible computerized telephone system. It's very difficult to get to speak to a human, and when you do they never know anything and can't help. They say they need to transfer me to another person to help. I plead with them not to put me back on the telephone computer system, but they mostly do.
I really dislike this bank and am searching for a better one.
For nearly 30 years, I maintained what financial institutions call 'excellent credit'. I've borrowed and satisfied close to a half-million dollars in various loans. Never defaulted on a single one. Always made payments on time. In 2003, I started a small business and then the following year, purchased a house. The credit was good enough to take out a 90K (unsecured!) mortgage loan in my name alone. As a result, Bank of America, suddenly and without explanation or prior notice, raised my 9% APR to 26% on two credit cards having a combined balance of cloe to 30K outstanding. I had always paid more than the minimum monthly payment until the minimum went from averaging around $350/mo to a combined whopping $800/mo. and RISING!
For the record, I am a long-term customer of Bank of America. Carrying everything from savings and checking (business and personal) accounts to investments, Certificates and major credit cards.
Last year, I applied for and was turned down by Bank of America for four different home-equity-type loans, even though I have sufficient equity in my home, to consolidate bills and lower my monthly payments after expenses relating to the illness and subsequent death of my mother, followed by a rash of necessary home repairs necessitated using up the last of my savings (cash-flow insulation.) and I am now faced with the following options: bankruptcy, giving up my business, yanking my daughter out of college and/or possibly losing or being forced to sell my home.
Is this fair or even legal business?
In January 2008 my mortgage increased $347 due to a shortfall in escrow. With the slow down in the economy it became difficult to cover this increase and I fell behind. Bank of America will not accept partial payments which I sent and thought showed good intent to pay on the account. The balance was paid at a local branch of Bank of America and I did not receive credit for that amount for two months.
Then in May 2008 I arrived at an agreement with a representative in the customer service department to spread the increase over two years instead of one year. This gentleman, Bill, indicated the new rate would roll back to January 2008. I received a new payment book for the agreed amount and made my next two payments using the payment coupons. At the time this agreement was made I requested a letter of confirmation but all I received was the new payment booklet that indicated the change of the monthly amount.
Then I received a letter they wanted more money over and above the amount on the payment coupon. I wrote them twice detailing what I have paid and what was due based on the agreement made in May. (I request such a break down from them but never received it.) After reading another posting on this site it appears that one person does not know what another person has done at Bank of America. My figures show I owe $60.62 plus the current month at the new rate.
I cannot understand why it is so difficult to deal with this bank. Do they really want to put homes in foreclosure when peoples with loans with them are making an effort to pay a reasonable monthly rate? One never speaks to the same person twice so this leads to further confusion.
My original mortgage was through a different bank and the loan was taken over by Bank of America. Bank of America was not my choice as a mortgage company and I would not recommend them to anyone for any kind of transactions after seeing how customers are treated.

Bank of america's service of our loan, originally through Greenpoint, then through countrywide, and now with BOA is of the poorest quality of customer care whatsoever. They are too big to even get their files and facts straight. There are so many people working there that no one takes responsibility for anything whatsoever, and they don't even meet internal checklists or promises they make during the recorded sessions we spend time in trying to resolve financial issues. They mis apply funds, then promise to fix the problems and don't. We applied for modification and they lost the paperwork, and as a result have mis applied funds and reported us late for months on end, charging us for additional fees. In the last 4 attempts at resolution, Bank of America has been unable to follow through, after we are re-assured over the phone that the repairs will be made. We again requested to apply for a modification program, and were finally told that the reason they just dropped the last process was due to the "investor" changing their mind on participating in the program on our loan. What an insane amount of wasted time and inefficiency. I am planning on moving my loan elsewhere and boycotting all business transactions with Bank of America. They are too big to care. They route you to umpteen different departments who have differing and in-correct records. They tell you whatever they think you want to hear to get you off the phone, then do whatever they please. Poor form Bank of America. Shame on you. After loaning out monies which didn't exist at all anyway, you scam poor Americans out of the money they Earned through real action and hard work. Bank of selfishness, bank of profit, Bank against Americans. Boooooooooooo..boooooooooo..

BofA used to be the best bank, In the last 3 years they have stolen money from us also. my husband and I are both on Social Security, our money was direct deposited into the accounts and we made large deposits when we took out loans on our home. I have been with bank of America since I was 2 years old. My mother worked there for several years. When I called to have several charges investigated, they told me that they would do so, and I used to be able to rely on that. They returned the money to my account and then took it back out with no warning, then they charged me more nsf charges, besides the ones that were in question, they sent me paperwork to fill out and we did so and sent it in. We received a letter stating that it would take 90 days to complete the investigation, then a few days ( not weeks or months) later is when they reversed everything again. They keep letting fraudulent companies try to run our card numbers and keep tacking on nsf fees and then they tell me they can't reverse them unless money is actually taken from the account, because they don't keep a record of whose trying to get money from our account unless the money was actually taken. Aside from the fact that we are paid by the Federal Government, this has to be illegal to even charge a fee for something that no one got. I would understand it if it were bad checks, but they don't even try to find out who is fraudulently attacking our accounts, how are we supposed to stop these companies if we don't even know who they are? For all I know, bank of america is doing this to us themselves. I am writing this in response and sympathy to all the complaints I have read tonight. I am going to see if there is a class action law suit against bank of America and if I find one, I will post the information. The person who posted the complaint I am responding to, they did the same thing to one of their own bank managers, right before they started shuffling all the employees around. She had to get a loan somewhere else to pay off her bofa cards and then she cancelled the accounts and shredded the cards. This is so sad that they are hurting so many people financially in our worst hours.
I agree with everything you have said I, a business owner have had many problems with Bank of America from deposits not beening posted to charge fees to my accounts, transactions posted then returning to a pending status, how can that happen the bank reps. (customer service) dont even know. I, have files a complaint with the FTC, but there has to be more than just one to get the ball rolling, so you need to file a complaint asap the phone # is [protected] the only problem is they don't regulate the banking institutions. So anyone that has had problems with Bank of America call the FTC...

bait and switch on home loan
I too am a victim of the bait and switch tactic that Countrywide Home Loans used. I had very good credit when I decided to buy my dream home and two weeks before signing the seller wanted more down payment which I did. Then one week before the signing my realtor told me that all they can get is a subprime loan, I was promised a prime loan and that was one of the point I insisted on, along with $25000 deposit, I had to come up with an $51000 and was sucked into a sub-prime loan due to the fact I already had a large amount of money down. I have been selling my personal items to pay for my two mortgages, which my realtor said they weren't have any problem selling the house we were moving out of. I'm renting it now which is not covering the total cost of the house. The dream house has turn into a night-mare. I hope not one else is going through this.
Signed loan with countrywide on 12/8/2006, first payment with them was due on 2/1/2007, asc charged me for payment dated 1/1/07 and late fees. I did not have them as a loan provider at that time! I want that removed from my credit report.

I agree with everyone on this comment board and I am so sorry to hear about all the trouble that you are all having. This is the reason I started my company. I have helped several people that have mortgages with ASC, Countrywide, and other mortgage companies that don't seem to care if they harass people or suck them dry. The comments I have heard are along the lines of trying to get blood from a stone or turnip, or something like that.
Contrary to what some people have said on here, I am not trying to be one of those people I mentioned above. My company is a nationwide company that provides services for people that are at the end of their rope. One of the helpful things that we provide is letting you know, before payment for service, if we can assist you and if we can not. If we can not, we tell you why not and what can be done to allow our company to assist you. Most companies won't do that, but we will also give you the reasons why exactly so that, if you should choose a different service, they will not be able to scam you. Now that's a way of saving money too.
I have a service that actually will take you out of the loop of contact with ASC, or Countrywide or whomever you have servicing your loan. All you have to do is tell me how we can help you. By that I mean, tell us what you are looking for us to do for you and we will pursue the help that you want, no matter what. We have all aspects of the mortgage business covered from being a mortgage mediation company, a title company, a real estate company, all the way to having access to attorneys for litigation or help to avoid foreclosure. No aspect of help is turned away.
Let me tell you, most of the customers that I deal with have told me about the fear and the frustration of working with mortgage companies that don't seem to care or give them the runaround. To be totally fair, mortgage companies have their ways of dealing with people. Some are good, some are horrible. But one thing all mortgage companies love is being vague. When they are vague, they don't have to give you information until you ASK for it. How does that help you? How can you try to save your home if you don't know how to ask the right questions?
That’s another reason why I created this company. I take your number out of their "system". When they mail you something, it goes to me. I take the burden away from you so you can live your life without the phone calls and the letters. And the rudeness! Oh, man, if I told you some of the stories I have heard...let's just say, it’s not pretty.
I know that some people are going to look at this comment and go, this guy is trying to drum up business. Well, you're right. But here's the kicker. I used to work in mortgage collections. I used to make the phone calls and send the letters. I used to work around the people that make your lives hell. And I kept asking myself, why? Why are these people not being told about the help that’s readily available? Why are these people not being helped to make payment arrangements that are realistic? Why does this company care more about the money than about customer service when that is supposed to be their primary objective?
That's why I got out. I can not stand collections. Just because they are hiding behind a company name they think that they can say anything or act anyway they like with the customers, being friendly with one and the next 40-50 they can treat like crap. Where is the customer service?
I take all that frustration away from you and create solutions that work. I know that it may be hard to swallow, but I do. I have done it for several people. And I can do it for you too. If you go to the website for the Attny General for the state of California you will see the full attachment of the legal papers filed in court against countrywide. Apparently two other states are suing Countrywide also, Washington and? If you go to the NPR website there is a new release on it. Also if you go to the website for Mortgage New Daily there is a rather large news article about this suit.
I think anyone living in California should file a complaint against this terrible company!

I have been with Countrywide for sixteen months and the only problem I have had is they did not pay my insurance premium they collect each month to the insurance company for a few months. I have a letter sent to me by the insurance company that there was no coverage in effect for two and a half months. They competed against a few other large mortgage companies and brokerages to get my business and kept all promises made . I downloaded my payment history made to Countrywide and found its accurate and complete with no mistakes. When I did have some problems at the beginning I was annoyed that I was speaking with someone in a foreign country that I barely understood.They immediately started asking me questions I feel to take control of the call, but it didnt work and I got what I was looking for. They keep sending last chance offers and emails all the time offering me mortgage consultations and that gets annoying. I hope with the take over from Bank Of America that things get even better as I would be willing apply for a mortgage with them. May I suggest no matter who you are keep at least two if not more people competing for your mortgage up until the time where appraisal are ordered after you have a written confirmation and approval letter . Also use the closing agency and better yet attorney of your choice. I have always employed an attorney for "all' real estate trans actions. No I am not an attorney just an upholsterer for all my life

Becareful everyone. I haven't gotten 8 calls since the new year started and COUNTRYWIDE TIMESHARES SCAM COMPANY is still up to their old tricks. 5 calling me asking how I got my money back and 3 thanking me for speaking out against this company. I havent written in months but the company is still ripping of many people so WATCH OUT! I wish everyone would read this and take this warning seriously. I now hear that the fee is up to $1850.00, $500.00 more than than they fooled me for. Never EVER send this company a dime and anyone that comes across this warning you are a lucky one. I have received at least 5 calls today advising that they have an offer for my property because the one like mine fell through so they contacted me to see if I was willing to sell. I agreed to sell; however was not willing to pay any upfront fees without having a valid contract with a buyer - since they said they had one. They were asking for $2497 upfront telling me that was a $1000 discount from their normal price. I gave them my fax number to fax a contract - thinking it would be between me & the identified buyer but it turned out to be a contract to advertise. I told them I had to run to a meeting, review the contract & finish reviewing the complaints for their company. They said they would call me back but probably won't since I hinted that I was on to them...so thanks to everyone for the heads up !
Please becareful all they are still scamming people I am up to 30 people that have contacted me with the same lies I was told so be careful everyone they are still scamming. If you are told your timeshare is sold and send them the upfront fee they are lying. Keep reading here and be smart keep your hard earned money or it will disappear just like the people that have contacted you telling you your property is sold after they get their commissions. I am happy you sold your timeshare. I was mislead and told it was sold before I used this company. I did get a refund after fighting for 3 months to get it back after no one every contacted me after I paid the money. Jeniffer came through and is the only honest person that I spoke to in all those months. I never wanted to speak bad of anyone but after being mislead and taken I was PISSED. Misleading payment due dates on credit cards
Bank of America credit cards have their system set so that sometimes due dates fall on non-business days, for example Saturdays and Sundays. However, they will not accept payments on non-business days, which means they will not accept payments on the due date, and your payment is therefore due earlier than the statement due date.
Specifically, a payment must be made by 3:30 p.m. EST or it will be credited to the next business day. Let's take a fictional example. Your statement says "Due June 13". Let's say June 13 is a Friday. You go online June 13 at 8:30 p.m. to make your payment. Too bad, it's already late, it won't be made until Monday, June 16th.
Or, let's say you go to your local BoA and make your payment at 3:40 p.m. on the 13th. Again, you are too late. Even though you are IN their bank ON the due date, it is considered to be made on Monday the 16th.
Now, obviously, you COULD have payed them on time on a Friday. Let's take another example. Let's say your statement says "Due June 15" and June 15 was a Sunday. You CAN NOT pay them on a Sunday. You can't pay them online, or on the phone, or in person, or by mail. There is no way. You can't pay them on Saturday, June 14th, either. So your payment is ACTUALLY due on Friday June 13th. But there is NO indication of this written anywhere on your statement.
So, again, if the payment is due June 15th, Sunday, and you walk INSIDE the Bank of America on Saturday morning the 14th and make your payment the day BEFORE it is due, it is STILL considered late, even though the employee is looking right at you and can look at the calendar and KNOWS you aren't making a late payment.
Then they will charge you a $39 late charge, and possibly raise your interest rate. This has happened to me! I've tried to discuss this and get the late fee removed, etc. and it's like talking to a brick wall. It's their "policy". I find this to be fraudulent. After all, in this age of computers, they can certainly accept payments on the weekend. The computer knows what day the payment was made, and the time down to the millisecond! They could certainly accept my payment made in person inside their bank on a Saturday, and they could also accept online payments on weekends dates if they so chose. I know that I can pay American Express online anytime, 24/7. I could log on Sunday at 11:50 p.m. and make that payment and they would consider it paid on time.
At the very least, they could change their due date system to not issue any payment Due Dates for non-business days. So if, due to rotation, it would be due on a Saturday or Sunday, it would either bump it forward to Friday's date as the stated due date (which is really true anyway) OR they could be courteous and bump it back to Monday. I could accept this, but not this sneaky cheating method of payments being "due" on days when they will not accept my payments.
I do not recommend Bank of America to anyone, for ANY of their services. I've had bad experiences with their savings, checking/debit AND online banking as well as credit cards. The only advice I have is to stay far, far away!
US Bank uses the same system since many years ago. Other banks do to. And to make matters worse, many other businesses are beginning to adopt this trick as well. It must be a lucrative scheme, so the band-wagon is filling up.
This is really something that should be made illegal. The Banking and Commerce Commitee should act to stop this unethical practice and make it illegal.
I have the very same complaint. It is ridiculous, they are the only credit card I have that I've had this problem with. I even did an analysis for one year and found that almost half of the due dates fell on a Sat or Sun, or holiday, AND that the number of days in the billing cycle were DIFFERENT from one cycle to the next, almost as if they were intentionally and STRATEGICALLY changing the number of billing days in the cycle so that the due date would fall on a weekend with hopes that you would not pay it on time, just so they could charge you a late fee and raise your interest rate. They should be ashamed of themselves.

SCAM, LIES, MEET NEW PEOPLE. Once you give them your money you never can contact anyone you trusted. Keep getting the new person to tell you more lies. If you enjoy losing $1350 of your hard earned money use them! I am actually starting to think I am getting my moneys worth. They are bringing out my heart to get the truth out. I am actually enjoying getting pissed of at this company and letting the public to BEWARE of this SCAM COMPANY! NEVER NEVER NEVER NEVER trust anyone at this company. If you do get a call make your you tell them yes and string them along thinking they have another sucker and when it is time to pay them just laugh at them and say SUCKER! Hello everyone following my journey. It is Tuesday 6/24/08. I just got home from work and called my credit card company and my refund hit! I was returned all $1350. It was quite the road to recovery and I am happy it is over. Thank you Jennifer for being the first honest person I met in your company and I will vote for you to be president of the company. I hope they keep you because you followed through with your word and thank you for your efforts. I am sorry about your lose as well.
I see someone called me out saying how good the company is and congrats to you for selling your timeshare. The thing was I wasn't even interested in selling my timeshare and I was told they had a buyer and that is what was wrong with the way I was treated.
If anyone is told that their timeshare is sold becareful that is all. Tell them you will double their fee if they sell it first and you pay them after it is sold. Take their cut before then send you your final check if they will not go for that you are buying an advertising fee and nothing more. You are buying an advertising fee and it was dishonest in telling me it was sold and all the people that were in on it is the scary thing. Just do your research before you do anything.

I was told they had 3 offers on our property. We haven't heard anything from them told me they were doing a title search and would be getting a check in about a month. Had someone else get on line to confirm everything. I also put right on the document that we signed not to be OK if it isn't sold before I signed it.
They need to be looked into because they have done this alot and need to pay back for lying!

Vacation Property Services -- the entire company -- is a den of thieves. Gedeon Tirado left numerous urgent-sounding messages on my voice mail. When I finally called him, he announced that he had buyers for my timeshare (a weekly at a lake in Iowa). He claimed that Vacation Property Services had sent them on a week's vacation to my property, and they wanted to buy. The "buyers, " he said, had offered $15, 000. "You could counter-offer, but I wouldn't. That might scare them off." He told me I'd incur no costs except for deed and title, for $702.
He transferred me to the Verification Department for that damning taped recording, during which the woman never once mentioned advertising. A week later, I received an "Advertisement Confirmation" letter, not the "Welcome Packet" the woman had mentioned. At the bottom, I saw my $702 had gone for "advertising." And my time to respond and cancel? The day before I received the letter.
I immediately took the matter up with Discover, who gave me a temporary credit but then reversed it when VPS provided "documentation, " including the script the phony Verification Department employee never followed. I sent them the notes of my conversations with Gedeon, along with a copy of a five-page letter I wrote to the Economic Crimes Division of the Florida Attorney General's office, which had been investigating VPS for these deceptive practices.
James Caudill of VPS called a few days later, saying that the Attorney General's office had contacted Frank Perry, the president of VPS. Mr. Caudill said he "had" me on tape, offered me a $100 credit and additional advertising, and said he could put me in touch with buyers. I asked him if he was insane. "Why would I need advertising when Gedeon told me he'd sold the property? And he never mentioned advertising. I work for an ad agency. Don't you think I would have noticed if someone had mentioned advertising?" He couldn't have cared less.
In a recent letter, the Attorney General's office told me they'd closed their investigation but forwarded my letter to VPS, who "may or may not" take action. So, the crooks are the ones who get to decide whether they'll keep my money? Again, insane.
This has gone far beyond the measly $700. These people have no principles, morals or consciences. They don't deserve to do business anywhere! And if I can stop them, I will. If that means hiring an attorney to pursue a class-action suit, I will.

I too was suckered into this scam by them telling me they had my timshare sold for almost double what I paid for it and of course they won't return mu phone calls, so suggest we get a Class Action Suit going against the ###s. Another one to beware of is Vacation Property Services a guy named Jonathan Terrelli sold me the same line of BS, so have advertised my timeshare twice and only given them money and not received a dime. I have been suckered into this scam and I have tried to contact them for weeks and I have gotten the run around, and screening of my name . I was told they had a buyer for my timeshare for 38, 000 and that I needed to sign on so that they could get this buyer for me, I was naturally excited because I have wanted to sell these timeshares ever since becoming a widow 2 years ago. They rushed me to fax them info, and promised me that the credit card amount would go directly to escrow and not be charged to my credit card, and I felt safe, until a few days later it appeared on my statement as being charged. I have not been able to talk to anyone about this, They refuse to call me back and everyone seems to be out of the office when I call, the receptionist has even hung up on Me. I of course called her back & told her never to do that to me again, I am a paying customer. You said Jennifer helped you, I have tried to talk to her, but they screen my calls and always say she is not in or shes on the phone or in the bathroom, whatever, I have begged them to return my calls, I want to cancel this contract because they have lied and misreprested me in the deal, I believe there is no buyer for my timeshares. What recourse do I have if I can't talk to anyone? I threatened the receptionist with saying I was going to call the attorney General of Pa. to get some results. they have stolen my money
I opened a checking & savings account 2 weeks ago. Deposited over $5, 000 to open the account of my money. I received 2 transfers of funds from a company I do work for that also happens to have BofA. Those went through just fine. On the 3rd transfer, they suspected it was fraudulent and put a -$888, 888.88 negative balance on my account and all my checks started bouncing like a blonde’s boobs on Baywatch. (lol).
So I call them and they tell me they suspected a fraudulent transfer?!? From a guy who logged into his account and entered specific pass phrases to get into his account and transferred the money. Meanwhile, he's done this 2 times before with HIGHER amounts with no problem.
So now, Bank of unAmerica has stolen all my money and held it hostage until this other guy calls them and clears this up.
I thought we have rights in the country. The right to bend over.

I will NEVER bank with bank of AA CRIME (A meric a scrabbled) again. I discourage anyone to bank with them. Years ago the bank accepted an out of state, stolen check in anothers' name, deposited with my stolen ATM card, at a banks location I never used. I had no knowledge of the check, as my signature was not on it, and most banks' 'policy' is to place a ten day hold on any out of state check. My disability income was immediately used when it was automatically deposited to offset the daily increasing negative balance of nearly $3, 000.00 in overdraft, ISF fees and late fees. I had to borrow money from my father to pay the monthly rental, & utilities, etc. My account was closed by the bank, and nearly $2, 000.00 I had in a savings for longer than three years, was not returned to me. I wrote the Vice President District Manager & the states' Comptroller of Currency. I contacted the FDIC and the results are nothing done. I filed a claim against the bank in small claims court, appeared with the out of state, unsigned check that I still do have, show papers of my non-returned savings account monies, and the judgment is in the banks favor. The justice this country favor ONLY criminal actions.

This company is a joke! They contacted us regarding selling our timeshare in Florida (Mystic Dunes) in Feb '08. The person we spoke to was Kate at ext. 3003. She had said they had a buyer for our property that was offering $23, 500. This sounded too good to be true but my wife insisted we hear what they say. I told them I needed a couple of days to think about it. She called several times after and left messages on our answering machine that they had an immediate and confirmed buyer and all we needed to do was pay the fee and our deal would be started. I called her back and after negotiating with her and her "supervisor" we agreed on $500 for them to start the process with the understanding that if the deal fell through we would receive a full refund. Well after several weeks and not hearing or seeing anything I called again and again and was never able to get a hold of "Kate". I did manage to speak to her once but she was so frazzled that she pushed me off on some other guy. His name was "Sean Thomas" and his extension was 3012. Sean was supposedly handling the escrow portion of our transaction. He said that everything should have been back and gave some big apology and said he would "look into it". After another week he called after I threatened to take them to court saying that there was a mistake on the title report and they needed to submit it again. So another week goes by and he called to say that the closing documents went out and I should receive them in 2 days. 2 days and nothing so I called. He said he would send them again, nothing still. So I called again and all of the sudden he's gone. No longer works for the company. The receptionist said he got called back to the National Guard. So I asked for a supervisor and got a "Frank Johnson" this time. He was very apologetic and explained no one knew "Sean" was being recalled. He tried to say that "Sean" left a lot of open files that didn't move off his desk. Now is when it gets good! He said "Sean" never did anything with our file and that the "buyer" cancelled the deal a month ago! A month ago? He again apologized and said that he was working with the "President/Owner" of the company and was authorized to make things right. He said we could either receive a full refund or he would relist our property with their "platinum service" which puts us on some stock exchange type ticker and gives us the highest level of exposure. I told him I wasn't interested and I wanted the refund. He agreed to my request and said he would need the final sign off my the owner which would take about 2 days and then the refund would be processed. That was over a month ago. I have since tried calling the company and "Kate", "Sean" and "Frank" no longer work for the company. I was told I need to speak to "Jessica" who is a supervisor but have never been able to speak to her. I was then give "Jennifer" at extension 237 who supposedly handles refunds. I tried calling her and left messages for a week until I finally sat on hold and waited for her for an hour! After I spoke to her she said the best she could do is give me $200 back. I told her that was not what I was told and would not accept it. She tried pulling the usual "you signed a contract" and I told her to go back and look at what I signed and faxed.
I covered my tail with these guys knowing they might pull something fishy. The contact they sent had "N/A" through just about everything except for the sales price, resort name and my name. I amended the contract on their paper and also outlined the terms of our deal on the cover page of the fax. I also made sure to choose my words wisely when they do their normal "recorded for verification" process that says they didn't give you "the name" of a buy and so they don't get caught for bait and switch. I also made sure to save any phone conversations they left on my machine and also records of all phone calls/faxes.
So after I told her I had all this she got quiet. She said she would need to speak to their "legal team" to see if they can authorize it. She said to give her 24 hours and she would have an answer for me. 24 hours and still nothing. So I called, and called, and called. 7 days calling and not once a return call. I have left message after message for them and I only get the receptionist. The thing I find funny is they have changed their phone greeting and the people who answer. When I first started calling there was 2 grumpy women who always answered. Now it sounds like some teen who needed a job.
Needles to say I am now contacting the State Attorney General for CA, FL and PA (where they are located). I am also contacting the Better Business, Department of Real Estate and my lawyer.

Well it is Tuesday now. My fax never got here and the person that was going to get back to me never did again. I really thought I finally found the first honest person in this company, but stupid me for believing. This is the most dishonest company around people. It is a scam or lie from day 1 DO NOT get fooled like me. Keep your credit cards in your wallet and believe nothing you are told. NEVER NEVER NEVER believe this ### or you will be out $1350 like me. I will continue to call this company until I am refunded. They all know my name there and the more new people that come will know me as well. Today I talked to a new receptionist poor girl and told her she should look for a job because her company is a rip off and I will not stop until they go out of business. She sort of laughed a bit but I told her she better get used to hearing every client because everyone is pissed.

Chris I am in the same boat as you. I am giving this one last person a chance to get things straightened out and the I am going to everyone I can to let everyone know of this company. I to have recorded conversations and messages left by Jason and Morris. The best one I have is of Morris crying telling me he will get fired if I do not send in the fee because he listed my property as availible and the seller is irate if he can not get my property today for his grandson.

Terrible service
I went to use my b of a debit card and it said that the bank would not process it. I tried getting gas and it wouldn't let me. I also tried the atm and it still wouldn't let me. I am 5 mo pregnant and have an almost two year old son who needs diapers which i was also going to buy today and that didn't happen. This is very frustrating. I don't know what else...

On June 11, 2008 I was charged for four overdraft fees. My checkbook register and the on-line statement provided by B of A agreed. However; the on-line statement the bank actually uses disagreed by $44.33 I contacted BofA and asked for an explanation of the disagreement. The rep and eventually the supervisor I spoke with could not provide an explanation. All they could keep saying is that I made a mistake in my register. Ok, but how did I make a mistake with their on-line statement? They/she refused to refund the fees. As a result I am unable to get medicine for my diabetes or the appropriate groceries for my condition. Instead the money I have coming in goes to their fees. It is their mistake. In my opinion I believe they (BofA) manipulate the accounts that are getting low to accomplish the gaining of fees.

Not only do I agree, I have proof. I will be filing the appropriate complaints against B of A, but do not expect any action.
2 months ago they charged me $105.00 overdraft fees for a .70 cent error, which by the way was for them posting a $2.98 charge for accidental death insurance. When I called to cancel the ADD, I was told I did not have ADD. Not only did they fraud me on this, I was, told they would not refund the 8 months of $2.98 ADD debits because they were "over 60 days old". They did refund 2 months. WOW, Thanks!. Now, this past week, they have again charged me $105.00 in overdraft fees when, according to their own web site, I was NEVER overdrawn, even after their theft on $105.00. I am on disability and have already stopped taking several medications due to expense. This certainly doesn't help! They could care less! I will GLADY due leg work for any attorney that has the guts to file a class action suite.
I feel your pain.In June I was charged 2 overdraft fees For no apparent reason was not refunded my money.In August they have charged me 290.00 in overdraft they did however credit 245.00 back to me just to turn around and take out 35.00 more the following day.I had money in my account until the overdraft fees. Be careful all. I was scammed by this company. I was told my property was sold. I was in disbelief and said no thanks. A week later I was told the offer went up to $36, 915 and the buyer wanted it for a gift for his grandson. I still told them I had to think about it. Then the so called magager called me and faxed me an offer or bid for my unit. The just needed to search the title to make sure it was paid for. I said no thanks. Then the next higher up contacted me, the region supervisor and said ever thing is a go I just have to fax them my permission and credit card number. I fell for it $1350...a day or 2 later I got another fax from them for an agreement that i was selling this and it was ok to bill my card, I did it. The next week I call to talk to the manager, he is out of the office. The next day I talk to his secretary he will get back to me in 15 minutes. No call. Noone has ever spoken to me and now it is 2 weeks later. I talk to the sales supervisor. He is going to get me a partial refund of $350 it will be here in 10 days. He told me there was dishonest practises as the reason for my refund. My propery was priorty and it will be sold fast. 2 weeks later I call he no longer works there either does anyone elseI spoke to in the past. Now tomorrow 6/12/08 the new supervisor will call me. I will keep you posted as to what happens. DO NOT TRUST ANYONE AT THIS COMPANY UNTIL YOU HEAR FROM ME. This is for your own good believe me! Scam all the way. Susan sorry you got ripped. They gave me the same story as you heard. Just different people did the scamming to me. Bryan Cole was the ### that got me. I was told he no longer worker there but I found out he still does because someone e mailed me that he was trying to get someone else.
Keep fighting and writing here. I did receive my refund of my $1350 but it took alot of calling and writing. I keep my name listed here and I have had 25 people write me and thank me for me writing here and getting the word out on this company. I feel I owe it to everyone to make them beware of countrywides dishonest practice and scamming tactics. 5 others have contacted me by telephone as well and I feel so good everytime I talk sense to people.
Just keep fighting these rip off people and I don't know how they can keep getting away with this. They must all make alot of money and all get together and laugh at all us stupid people for believing their lies. So keep calling and make sure they never forget your name. Well, the latest is, I filed a complaint with BBB. I received a copy of Countrywide's response which was:
"Attach you will fine sign agreement for advertising until it was sold. We also have a verification recording agreeing to the terms. We so specifiy on the tape that it is a one time NON RefunDALE FEE which she agreed to."
This was written by Stephanie Robello, with the title of 'Office Manager'. In case you are wondering, the spelling, grammar, and text is copied verbatim from the letter. So professional!
I have also called Whitehall Township to see if they have a business license; will let you know what I find out when I hear back.

She said she had buyers from Europe and Asia that wanted our timeshare for 22, 500.00.I asked if there was a fee and she said i would have to pay 1297.00.So I asked for her number to call back after I checked them out on the internet and she wasnt ripping me off.

I was just contacted by Rich Burton of Countrywide to tell us they have a buyer for $21, 500. It seemed a little fishy to me since I had never contacted him nor Countrywide and I already tried 3 different companies which turn out that they are all liars!
After hanging up the phone with him, I went on the internet under Countrywide and found all of your postings.

COUNTRYWIDE TIMESHARE SCAMS!
We have been duped by a timeshare scam, and after doing some research, I find that we are not alone. On June 29, 2008, we were contacted by Countrywide Timeshare Sales in Whitehall, PA with the 'news' that we had a "buyer ready to go" for our timeshare in the amount of $22, 500. This seemed like the answer to our prayers, as we have hit some pretty bad financial times right now, and this would ensure us being able to keep our (residence) home out of foreclosure.
Of course, we could only 'sell' this if we paid up front, the $875.00 advertising fee, so we scraped together the money with what we had been saving for our son's upcoming dental work, because we were assured that this was a done deal by Countrywide.
Well, here we are 4 weeks later, supposedly through the Title Search, and into the next phase, however, I've been trying for days to get a hold of the Countrywide folks to see where things stand, and they will not return my calls! (Richard Burton, and Dave). It's always "he's out of the office, but I'll take a message", or "he's in a meeting, but I'll give him a message", blah, blah, blah. I have asked to speak to a Supervisor, and same story. On top of that, the listing on the website, as well as some paperwork shows the price to be $2, 225, not the $22, 500 we were told was offered. When I saw that, I figured it must be a typo, but I questioned too, why it's even listed for sale online when it was supposed to be sold?
Countrywide has ripped us off! We were fools not to check this out ahead of time, but all I can say is that they caught us just as we were leaving town to attend our niece's wedding, and we didn't have time. Now, I have done the checking and found that they are not members of the BBB, and have had numerous complaints filed. A search on the web under 'Countrywide timeshare scams' brought me you folks, and shows there are plenty of other victims out there!
I am so disgusted with myself for being taken in like this, but what breaks my heart is that my 4-yr-old son will suffer, as I don't think we can scrape together the money needed for him to have his cavities filled, and they are causing him tremendous pain! I'd love to hire an Attorney, but it would cost more than $875.00 that they duped us for.
These people are horrible, and should be criminally charged. At the very least, I'd love to see news story on them to so that other people would be warned. At least then, something positive would come out of my stupidity.

Poor customer service
I financed my home with an ARM with the promise Countrywide would give me a better percentage rate when my 3-year period was up. When the time came, by interest rate went up to more than 9%, resulting in a more than $500 a month increase in my mortgage payment effective Feb 2008. In January of 2008, when I realized I could not handle the payment, I filed paperwork with Countrywide's Home Retention team for a home loan modification. After finally being contacted by my counselor and filling out the loan information, I again called several weeks later to find out the loan had been approved. However, she did not know this, and it became immediately apparent Countrywide's internal communication methods were and are very poor. She had told me when my application was pending not to make any payments until my loan modification papers were received and, at that time, I should make my new payment. I finally received the papers, signed, and returned them with a check covering late escrow fees and some processing fees to the tune of over $1400. I was also assured my account would be returned to current standing when the loan modification was finalized. However, I continued to receive phone calls and letters telling me I was delinquent, and even though I have made my first new payment under the loan modification terms, I am still receiving threatening and harassing calls and certified letters. When I call to complain to customer service and explain the process I started many months ago to avoid just this situation, I am told just to tell the callers, for the umpteenth time, what is going on and explain to them my situation. I am told the letters and calls I have been receiving are automated and cannot be stopped. This is baloney! Countrywide's internal communication methods are extremely poor. Also, since receiving my modification package, I have tried many times to speak with my counselor who is always unavailable. She does not return messages left, and her supervisor has also been left messages in this regard. The customer service representatives also have left messages asking the Home Retention Office to update my account, and this still has not been done. I just received another call from a debt collector asking what I intended to do about my overdue account, and I "lost it" for the first time. I am in a customer service field for the US Government, and this is no way to treat your customers, especially those who anticipate they will have a problem, contact the company, do all they are asked to do, and then are still harassed with calls and threatening letters. I never had a late payment on either my first or second mortgage prior to this time, and I will never again work with Countrywide. I will also make sure none of my friends or family do either. This is very sad.
I have emailed Countrywide three times on this issue and the only after I heard that they were an issue in the news for their poor business practice. I refinanced my house with them based on a mail_in that stated that I would be able to qualify for a $250K with a payment in the $700 range. I applied and they gave me an interest rate and payment that was not what I was expecting. I brought the subject of the mailed offer and they told me that that was old and didn't apply anymore.
What could I do... I needed to refi for a cash out for a business investment.
While we were waiting for the paperwork to be processed, I got the same mailed offer as earlier. I told them about it and they said, "sorry."
Now that I have heard about their over aggressive practices with getting people to into their grasp, I complained and I'm complaining now, to you, to see if there is anything I can do about this. I only refi'd for $145K with a payment that is around $970. Over a thousand with other fees. Can you help me with this or direct me to a consumer advocate to address this with Countrywide. I am sincere and I did email them three times with no answer. I even filled out their survey with negative responses without a reply.

For years we have fought to keep our Home 22 in fact... Not just Countrywide but 2 other companies have tried and tried to take our home... from sending back our payments saying they were never recieved... then tryed to forclose! Now they sold our so called 2nd mortgage and now say we are current on first and forclosure is pending on the second! WHAT? Our home is valued at 77, 000 and the amount claimed is 16, 000! wow what a winfall for them I hate this company and any of them that could care less if you live in a box... just wheather they have that big bonus for a new toy!

Countrywide's TV commercials all say "Nobody can do what Countrywide can. Nobody!" Well it turns out that for once they are telling the truth, because from everything I've heard and seen, even Countrywide itself cannot deliver a fair and honest mortgage package that won't cost unsuspecting consumers more once their intro period is up.
As much as I hate Countrywide, I just can't seem to get away from them either. Even if I try to go through another lender, Countrywide end up buying them out and I am stuck no matter what.
I also experienced the poor level of customer service in the loan workout department. I am in the military and under Serviceman Civil Relief Act my mortgage interest rate can be reduced to 6%. Took Countrywide forever to respond to me when I first send the request in. After that, all of a sudden I have to deal with the loan workout department whenever I have an issue. My rep never calls me back if I leave a message. When I do get to speak to someone, I am treated like second class citizen. One rep basically told my wife when she called that it's our own fault that we are in the loan work out situation and if we want better service we should request to be taken out of the SCRA program and pay the higher interest rate. (We have never been late on payment, but I guess countrywide groups all special loans under one department) So it's my fault that I am serving the country during the time of war and have been offer a benefit that I have earned through my active duty service according to Countrywide...go figure!
Anyways, we now have a second loan that countrywide services *not by choice* and we are going through a loan modification. We are working with an attorney backed firm this time though and I think that's important to take note. A lot of companies out there claiming they can modify loans but if they are not lawyers they pretty much can't do much. (They can collect your money and disappear that's what they can do)
If you are being contacted by debt collectors that's even more important because according to the Fair Debt Collection Practices Act, ONLY attorneys can stop collection calls. My agent at www.fixanydebt.com also had her loan through Countrywide so she knew exactly what I was going through. I wish I can say this is the last time I'll deal with countrywide, but I know unless I pay for my next house with cash, that's going to be very unlikely.
I have never seen the breadth of incompetence in a mortgage company as I have seen with Countrywide. I have a convention loan. My Mortgage was "slammed" sold by the original bank to Countrywide right after the closing.
We have been on time with all payments.
Countrywide had my many "official" documents with my address listed IN THE WRONG CITY. The title has the correct address, closing documents had an address in an adjacent city (not far away). At the closing as you probably know there are hundreds on documents with different addresses (IE of the Title Company) - we assumed that the Title Company and the mortgage company had their act together. Wrong. The original problem was not countrywide, but when they bought the loan they could have "should have" review documents o note the discrepancy. That is an area of their expertise.
When Flood insurance was up for renewal the notice was sent to the non existing address, and the mail came back not delivered. Countrywide bought Flood Insurance (at exorbitant price - TWICE what it cost me a couple of months later, and applies charges to my escrow. They sent this to my home address. Once I was notified I promptly reinstated my flood insurance with the original company (Liberty Mutual) who had also sent me notices to the wrong address and had the mail returned.
I don’t feel like it is fair for me to pay $650 dollars for three months flood “coverage” for an address in another city. God forbid we would have actually had a flood during that time. I don’t believe I would have had coverage. Had that occurred, and the insurance company was asked to shell out $200, 000 in coverage, they may have had a problem with the fact that the address was in a different town.
Countrywide has repeatedly said they were going to get his resolved – but they have not even notified me that the address information has been requested. Finally, last month I called the Title Company (who really screwed up originally) and told them to get things straight. They at least admitted the mistake and apologized. They handled it quickly and let me know.
Countrywide want something ( my interest payments) for nothing (total lack of service)

I completed all necessary paper work they took my money for the appraisal and i never heard from them again
On April 30th, 2008 I started a refinance process on my home of 20 yrs from avariable rate to a fixed rate with an Account Executive Sally Vance who's office was located in Orlando. Funds were taken from my checking account to in the amount of $315.00 towards the appraisal fee which was done on Fri may 9th, 2008. All my required paper work was signed and faxed back as requested prior to the appraisal and I have not been able to touch base with anyone since. my maine contact was [protected]@countrywide.com and all her emails are returned undiliverable. my % quote was locked in at 6% for 45 days until june 16th when they actually had all the required papers signed and faxed back before 6:00 am om 5/8/08

My case is similar to Laurie's,
I contacted Countrywide, our lender when we fell a month behind in March and they suggested we refinance. We spoke to a woman in CW's Pennsylvania office named Lisa Chorpenning-Manes who said she could lower and fix our rate AND roll in the March payment! We gave her just under $500 (which we were saving for the March payment) for an appraisal and submitted all the other necessary documentation to her.
The whole process dragged out for three weeks, until she disappeared. We finally spoke to someone else who informed us that she didn't work there anymore and we'd need to talk to her supervisor, Stanley Coakley. When Mr. Coakley reviewed the loan, it was revealed that Ms. Chorpenning-Manes had been working out a deal that was NOT what we had originally discussed, and that we didn't even qualify.
After some salty language, I asked Mr. Coakley what our options were and if he would please send us a copy of the appraisal. He promised to over night it. That was over ten weeks ago. I've talked to him since, begging for a copy of the appraisal, and I left a message on his voice mail last week.
Anyone who has any advice on how to get a copy of the appraisal, please let me know.

Upfront advertising fee for selling property
I got a call from Natasha Caldwell from Countrywide saying they had a buyer for my timeshare. She wanted me to send $1250 upfront (to cover their advertising fees) and would call me back the same day with a closing date. I told her I was sceptical because I had been scammed out of $1400 a year ago by a company called Land Ahoy Properties in Orlando. They were going to list my property and "guaranteed" either sale or rental within 90 days. Yea right. Never heard a thing for a year (funny - 1 year to the day I get a call from this co. called Countrywide). Countrywide says Land Ahoy's out of business and they picked up the listing. When I told Natasha I'm not comfortable because I've been scammed before she had her "supervisor" call. He went on and on with this canned speach about how they have an offer for $23, 500 (I paid $10, 000) for my property, but I must send them the $1, 250 to cover the title search. When I told him Natasha said it was for an advertising fee he said she was misinformed and he'd have to talk to her.
At any rate I told him I'm not interested because I don't want to lose another $1250 on top of the $1400 I lost last year. He asked to speak to my husband. We had a hard time getting him off the phone. Finally he must have gotten frustrated because he told my husband he would transfer him back to Natasha - but of course Natasha never got on the line so he hung up.
Today, I got another call from the "supervisor" at Countrywide (Mr. Boros). Again, it was this long canned speach about how legit this offer is but he can't show me anything that proves there is a bonifide offer because that would be against the law. I told him unless I have some proof that I can take to a lawyer he's not getting any money. He went on and on but I finally had to tell him I'm not interested because I'm not comfortable and hung up on him.
PLEASE, PLEASE, PLEASE - BEWARE OF THIS COMPANY! THEY WILL TAKE YOUR MONEY AND YOU'LL NEVER HEAR FROM THEM AGAIN.
I tried to contact my attorney general but have been unsuccesful.

This is all the same that i have experienced with sun property networks since october 0f 2008. same exact start, promises of the timeshare being sold, paperwork in the mail. sent the termination of contract within the specified timeframe. i did it all. they took my money and i have absolutely nothing to show for it. no documents mailed from the closing people that they said were mail. yes clay alexander james slocum and many other familiar names. i cannot tell you how many times i have called, left messages on their infamous voicemail - answering machine and still have YET to receive a single phone call from the company...not one. i also contacted the attorney general's office in boston. which was useless. they wouldn't even provide me with a copy of the paperwork that they had sent to sun property - which makes me very spicious of them. i am very sorry for the other individuals that i have read about...it is the same exact frustration that i have been through. i hope that the company does get shut down and the little snobby so called receptionist looses her job. no real company in their right mind would ever hire someone with her "customer service" attitude.

I had identical dealings with these scam artists. I was cold called and told They had a buyer. I dealt with Kathryn Garten who said she was a licensed realtor as well as an attorney in their closing department. Was told they couldn't divulge the buyers by law but that the up front $2500 they got from me was to pay for title fees and other closing costs. They wanted payment by check. Fotunately I paid by credit card which offered me some consumer protection.
They never produced the promised closing documents within the seven days. I called MS Garten to request cancellation and was told that is not possible because they have a buyer and it is in closing. Told her I never got any closing documents. She assured me they were mailed already. I said I wanted to cancell anyway and was told it had to be in writing via return receipt mail to the Boston location. Never got any signed receipts from them. A couple days later I got an advertising contract in the mail requesting my signature. It said they would advertise my property till sold. Called and got Ms. Garten who this time was extremely rude. She said they have a breachable situation now if I back out. I informed her that she perpetrated a fraud upon me. She LAUGHED at me and said to sue if if I want but I'm not getting a refund because they have me on tape saying exactly what they wanted. (it took them three calls from the verifyer to record what they wanted since I didn't answer perfectly. Each time Garten would call me back for additional coaching on how I had to reply to make it legal).
I sued her and Sun Property Networks in small claims court and won a default judgement. I also filed a complaint with the MA Attorney General. They never returned her calls either. Go figure. Their investigation found no record of a business at the 71 Commercial St. Boston address listed on their documents which explains why my return recepts were never signed. At one point I asked the receptionist (screener) who answered the phone what the address is where she sits. It is in Orlando. Countrywide timeshares and Sun Property are one and the same. I refiled my court papers to serve summons at the Orlando address so they would get them either way. My Credit card did permanently reverse the charges thankfully. I would like to figure out a way to place a lien on her house ( have info on what property she owns)for the judgement that will never be paid and to inflict some pain for their fraudulent practices. By the way, I was never able to verify any state bar associations to back up her claim of being an Attorney. These people need to be in jail for fraud. Why do these and other companies remain free?
Sara did call me back today to let me know that Jim Brown told her that he has been in contact with me which he has not and that he told me that he has just had inquires about my timeshare again not true. But anyway the bottom line is that sara said since I was not happy with the service that they would refund half my money which would be 900.00. At this point I have spent a month of my time trying to take care of this that I have had enough, lesson learn do not trust anyone not unless it is all in black in white. Sara was the only person that I talked to at this company that did what she said she would so if anyone has a complaint ask for sara sights she is in the Boston office. I will update this when I get my check.

I am now calling sun property back thanks to geralds comment to let them know Jim Brown is doing it to someone els. But it really does not surpirse me. I agree also. I was contacted out of the blue by Jim Brown of Sun Properties Networks with an offer that was toooo good to be true. They wanted a check for $1850.00 for title search and their expenses. They faxed me a contract (looked bogus) (even had the wrong name) today (late) and He called to really push me to fax back the signed contract along with a copy of a check (to be sent). I've been scammed once before, and you know the old statement about once bitten - always shy [TRUE]. I'm really glad all of this info is accessable on the internet.

Talked with carman she answers the phones for sun property networks she was very nice and leaving another message for a supervisor she said that they are in a meeting. But did read the notes back to me that was left by Emily. As I explained to her I hope this company is not a scam because I don't want to have to hire an attorney or send out my letters to the attorney general office of each state that I now of that this company is doing business in. Lets see what happens hopefully I will get a call back tonight the time is now 4:08
Scammed for advertising fee
BEWARE BEWARE BEWARE! I got a telephone call from this company telling me they had a buyer for my property. I told them I wasn't interested in selling, they quoted me a price of $36, 960 and had a bought already. I said I would think about it. A few weeks later I was called again and they told me the seller is serious but will walk away if nothing happens in a few days. I said no thank you. This was all from an agent named Jason.
The next day I get a message from Morris Saul telling me crying that he would lose his job if I did not send them the fee because he listed the property as available. Then the next day Bryan Cole called me and said the sale will be processed as soon as my credit card got billed. I signed the form, my credit card got billed and everyone disappeared. No sale, no word from anyone all I could do was leave a message and someone would get back to me. Yeah right never a call again. Finally I get an honest answer from a lady named judy and she told me to request a refund, so I did. I follow up a few days later to see if she got it and I find out she was fired, probablly for being truthful! No one knows anything about my request.
Now a few weeks later I get the supervisor he was going to look into my case and call me back the next day. Of course no call back and I called again after being on hold for 20 minutes I get him on the line. He apologized and told me a few of their agents were using dishonest practices, I said I can give you a list of 5 of them. He was nice and is getting me a partial refund $350 out of the $1350 I put out and I am on the priority sales list whatever that means and that check is on the way I will let you know what happens.
I will keep you updated if anything further happens but BEWARE of this dishonest company because it is a scam and beware of this company because if you believe there lines you will get beaten out of $1350. If this company reimburses me of my $1350 or sell my timeshare I will gladly retract my words. But until you hear from me again BEWARE!

Jessica Ortiz called me and asked me if I was interested in selling my time share . She said the customer was ready to buy my timeshare for 13, 500 dlls. and I question her and asked if he was really ready to buy right away. She said yes and I fell for the scam of my life. I try calling back many times I spoke to Jessica Ortiz and she said she would credit my account. It never happened. I called again and could never get a hold of her again. I called again and I spoke with her assistent Armando Cazas and he promise to refund my money since they fail to even send me the contract, he said the finance depatrment will contact me and that never happened. I try callin again and spoke to Raquel who also said the same thing and nothing happed she never called me . I try again hoping I could speak to somebody with more authorty Jennifer Ramirez answer the phone and said she was a Manager and I explained to her that they had never send me my contract and they had failed to comply with what they had promised. She put me on hold for the longest time and never return to the phone. I called again and again she even put me back on hold and said "I have ANOTHER customer on the line, and I don't have time to be lisenting to your excuses you are just lying and just want your money back " and she hang up on me. I called again and she kept sending me to her voicemail. I called again and asked to speak to some body higher than her and she said there was nobody higher and that she was not going to refund my money anyways. I asked her well ARE YOUTHE OWNER OR WHAT. She said yes I am so what.Then she hang up on me. I try to get other numbers but there are none available. I called my credit card department and I will dispute the charge they told me that they can help me get my money back. So let's hope this true. I have never been treated with so much disrespect as Jeniffer Ramirez treated me.
I, too, have been scammed exactly the same way from this company.I had a timeshare week for sale so I thought it was legit when I got the call. I am a single mom of 6 and now I am out over $800.00. There goes my kids' birthdays and Christmas. I am seeking anyone who knows what my next step should be . I not only want my money back, I want to stop them from doing this to someone else!
I was glad i found this site to check them out. I too got contacted today. It was too good to be true and, of course they wanted the money up front. I'm so happy i didn't send them any thing. Thanks for your input.

I was also told by Judy to fax in a refund request which I did and of course she doesn't work there anymore and no one has seen my faxed letter. I am now working with Jenifer who has been little if no help.I still am working on getting a refund. I plan to appeal to the credit card company on the basis of fraud.Has anybody taken their complaint to the attorney general? I feel that this is fraudulent business practices and might be something an attorney general could help resolve. Everyone beware of Countrywide.

Scam collection practice
Be wary of FIA Card Services offering to settle credit card balances in collection. Last year I made a deal to pay off several Bank of America credit cards for a fraction of what was owed. The FIA rep put the arrangement in writing. First, they changed the cc number to a new number. We established an automatic draft arrangement and each month for 6 months they drafted my account for the agreed amount. I made the last payment on 12/31/07 and all was fine. Well, up until recently when FIA Card Services started trying to collect on the same debt using yet again different cc numbers. They refuse to provide the original credit card number and call constantly trying to intimidate me into paying. They have gone as far as telling me they never made any arrangement with me in the past. I still have the written agreement they sent me and refuse to give it to them because they are scam artist. I would prefer litigation. The point isd, my credit report was to show these cards paid as agreed but instead it shows I am in collection. They run a scam and so does the creditors. They make you believe they'll take less when in fact they have the upper hand. My suggestion, make the creditor take you to court. The judges will never make you pay more than you can afford and there is nothing more secure than a court order.

Just received a call from [protected], saying they're from Card Services. Didn't catch whether it was FIA or not, but in my opinion they all fall into the same category.
These numbers/calls are irritating and seems like they just keep coming and coming and coming without any means of stopping them. Well, I at least found a way to slow them down.
By accident I didn’t hang up the phone immediately, and then I realized that they were still on the line wanting me to hang-up. It seems like something within their system doesn’t allow them to hang up the phone. As long as the line is active, they have an opportunity to get info. It’s probably set this way so that the callers must make every effort to obtain the desired info.
I spent an additional 4-5 minutes and the woman on the line seemed very irritated. Now I know this didn’t help me getting less calls, but it does offer some satisfaction on two accounts. First, I got some pleasure in it, and then it was less time they could spend trying this with others.
Your particular call might not be exactly the same or have the same type of system, but if it helps please repeat what I did by accident. It might not end their schemes, but it might slow them down.

Have had a BoA credit card account, got fired, fell behind on payments. Got Fedex'd an offer to settle this morning by a certain date, but with past experiences with other "settlement" companies and judging by the stuff that's said here, I'm not going to take them up on the offer, because chances are I will pay and it will never show up on my credit card report (has happened with other companies). You know how it is...if it seems too good to be true, it usually is. Don't take the risk unless you can afford to lose.

Bank of America runs a scandalous business based on fraud, theft, and greed. Yesterday I checked my account being that payday is literally around the corner. Shock, awe, and surprise do not even begin to describe what I felt when I saw my account was overdrawn by $219.95. On April 30, my paycheck was directly deposited into my account. So far, it's all copacetic. On May 1, I make 2 purchases and a withdrawal. One of my purchases came with a $35 overdraft fee. On the same day I paid 3 bills online. Now I am aware of how this works. The payments don't always go through at the time you make them so I did what everyone does... leave the money alone. On May 2, all my payments went through along with a $35 overdraft fee on each. How do I go from having $400 in the bank to being overdrawn by $219.95? The bills I paid only amounted to around $200. So let's do the math.
Yesterday after work I went into a Bank of America Branch. I spoke to someone who obviously did not know what she was talking about. I was told that it is Bank of America's new policy to charge overdraft fees on pending transactions. So even though at the ATM the receipt stated that I had funds available, B of A still hadn't processed my direct deposit. All of this makes no kind of sense to me. How come I was able to withdraw $40 from the ATM if there were no funds available? How was I able to get gas if there were no funds available? How was I able to get my morning coffee and bagel if there were no funds available? By the way, I was charged a $35 overdraft fee on a $3.54 purchase at Safeway.
I am a poor, single working mom trying to keep a roof over my family's head and food on the table. How do you explain to a seven year old you're sorry but those new shoes they need just aren't going to happen or that the fridge is empty because B of A took literally half my paycheck in overdraft fees? To say that I am angry, furious, livid, again, is an understatement. Bank of America took food out of my child's mouth and I am enraged. Today I am going back to the bank and speak to the Branch Manager and let them know that they stole my money and they will be putting it back into my account immediately and I will be using every outlet to let the public know what they have done. Ok back in nov or dec of 04 i opened an account with my mom then on jan 4 05 or we closed it cause we moved out of state, or so we thought. I recently tried to opened an account with a new back close to where i live. They said i couldn't cause of pass due charges i was like what the hell we closed it and i never used my card or anything. So we call today and they said the account wasn't closed till may of 05. 5 MONTHS AFTER WE WANTED IT CLOSED. We never got any letters saying we owed money or anything. That bank is a joke they don't know what they are doing and now they screwed me out of getting a good bank account.
I was recently scammed out of $250 from bank of america. Here is how the scam goes: B of A will approve a small amount of money to be withdrawn, even if there is not enough money in your account. This way they can charge you $35 overdraft fee for each transaction. By the time you figure out what has happened they have already stolen the money from your account. Great scam huh, start a bank!
BofA student account, yes student accounts can draw money out of their account EVEN IF THEY DO NOT HAVE IT IN THERE ! a $35.00 fee is charged everytime. My 17 yr old experienced this with a $275.00 overdraft total fee charge. To be fair, after numerous phone calls and demanding, the did return about 150.00 back. NOW when I called they said they can FLAG the account to NOT let the student withdraw if there is no money. Well unfortunately they told me after my daughter overdrafted $140.00 again, that not all merchants put the transactions through. I do know that may happen, but they also may insert just one dollar to let the bank know a charge is coming in.
I argued again, that we had the code put on and she still was able to overdraft. NOW they will not refund anymore, even though there is a safer way in addition to the FLAGing that they DID NOT TELL US. That to ask for DEBIT instead of CREDIT. You see BofA makes more money when you say credit.
Yes, my daughter should have been more responsible. However, some adults don't even balance their checkbooks; they can't possibly think they are servicing a community when they set policies for "STUDENT ACCOUNTS" that will rake in a ton of money for them. HELL they may even add that into their yearly budget.
This is fraud. Remember when you could use your ATM bank card (without a visa or mastercard logo on it) and it would take the money out of your account right away? What was wrong with that system? Well, seems the banks weren't making enough money make it too easy to be responsible with our bank accounts.
We can't find this as individuals, but we can as a group. We could get bumper stickers, I would provide at an extreme low cost.

age with your people and my jeff gordon credit card since i have had the loan that i cannot take it anymore. jacking my intrest rate from 7% to 29% for having a total of 4 late payments in my history (wich i made up for by paying extra to you people) no grace periods like most sane banks have and a 40$ late fee? what the heck?. then you jack my payment from 48 dollars a month to 150.00 a month when i am current on my bills, i think you guys are scam artists on loans and your qaulity of customer service is so bad that i dont know how you can say the words "customer service" more like "customer rapeist" so i will be paying my loan off with UTAH FIRST CREDIT UNION. a place where you can have a 10 day grace period if needed with no late fees, and a place where customer service is the finest that i have ever dealt with, and a place where the intrest rates are always lower than your circus act you have going over there. by the way i think i will let my local news in on this as well and maybe get one of those media personell that fights for people being ripped off.

trick to charge the late fee
I pay all my bills in the beginning of every month. Because I pay full amount around same time every month, I dont check all the detail of the statement, especially on this credit card. I seldom use this card. I use other card more. This month I noticed that BOA charged me the late fee. I am not complaining about the late fee. There is a reason my late payment. I checked the due date was 5/3. The due date is around the 8th of every month. I checked the previous due date online;10/12, 11/1, 12/7, 1/1, 2/1, 3/8, 4/2, 5/3.
I dont know why BOA keeps on changing the due date. I found out that I had paid the another late fee on Feb, too. If I had balance on other months, I would have paid more late fees.
All my other credit cards dont change due dates like this. They only change 1 or 2 days if they change.
I dont think it's fair to change the due dates like this. All I can think is that this is a BOA trick to charge the late fee to its customers.

I am having the same frustration with Bank of America. This is my first credit card with Bank of America, and I have NEVER seen more trickery than this. I always pay on the day that I receive my bill. But, almost 3 weeks after making my payment, when I logged online to my account, I noticed my payment was still pending and scheduled to process 21 days AFTER! This is not right, as the date they change to process the payment is dangerously close to the payment due date. My boyfriend has a Bank of America card as well, and was slammed with a late fee for this reason.
Something is very fishy here. Perhaps we all join together to file a class-action suit?

robbing folks with nsf fees!
Bank of America is in the business of robbing people. Their rules constantly change to benefit their pockets and there is no consistency from one rep to another. In the past year, they have managed to rob me of over $900 of my hard earned money. I only know this figure because it was thrown in my face today by a so-called customer service manager that I’m doing a poor job of managing my finances. Never mind the fact that I'm a single mom and a business owner trying to keep my head above water in the mortgage industry. I have been monitoring my account on-line constantly to prevent this from happening, and no one could offer me an explanation, all I know is that in 5 minutes I racked up $210 in overdraft fees for $30 worth of transactions. When I questioned why they process transactions from biggest to smallest instead of in the order they are presented, I was told that this was intended to benefit the consumer so the most important items are paid. OK, so if I have a $100 light bill and I go on a shopping spree for $110, how is it more important to pay the shopping spree first? They have no method as to how long credit transactions and debits show as pending before that money is out back into your balance. All they can tell you is to write down every time you use your card, and do not rely on the online banking as a ledger. I may be wrong, but I thought debit cards were created as a convenience to the consumer, and on-line accounts were an added convenience. If I have to write down each time I use my debit card, wouldn't it be easier to write checks and have carbon copes so I can transfer it to a ledger when I have time? Their customer service reps are rude and have no clue what they are talking about. They just love to point out that it's your fault and they stick together like glue no matter how wrong they are. Bank of America is definitely an institution with no heart. They are extorting millions of Americans and they have absolutely no remorse whatsoever. If anyone knows of a class action lawsuit against them, I would love to voice my opinions. I'm not usually a vengeful person, but I can't wait for the day when they get what they have coming to them.
If anyone gets a class-action lawsuit going against BofA for these NSF fees...post it here...so we can all get involved! We have a small home-based pool maintenance business. One of our vendors gave us a check for $350.00. We had $46.00+ in the bank at the time that we "cashed" the check. BofA cleared the check. Two weeks went by---all of a sudden, we hear that we have a negative balance in our business checking account...what do you know, the check that our "vendor" gave us bounced! So consequently, ALL of our online banking account payments bounced along with it! Because they cashed the bad check, and it bounced, all of a sudden it was "OUR" problem! We are a low-income family, and today we have NO FOOD to feed our 3 kids (ages 9, 7 + 6)...they start school in 2 days, and I cannot go out and get them the shoes and school supplies they need...my car registration is due tomorrow...what happens if i get pulled over by a cop...they will be sooooo understanding, right? Long story short...manager cashed one check for $90.00 for me, only after I completed DEMANDED it, but they would NOT clear these "fraudulent" charges from my account! They said that because they have given us "credit" for overdraft protection (their fault-another long story, another day...trust me, THEIR fault!) ...that they would NOT be able to credit us the fees...Remember that these fees were due ONLY because of an NSF check that was someone elses...I do NOT want to hear that our "past" should have ANYTHING TO DO WITH THEIR DECISION...Wake up people...they made BILLIONS of dollars off of ripping-off hard working Americans! We need legislation pasted to STOP THIS ABUSE! I am going to research HOW exactly this can be done...they are taking complete advantage of us...AND I JUST WANT TO GIVE BANK OF AMERICA A BAD NAME, , , , , , ...THAT THEY CHEAT THE AMERICAN PUBLIC OUT OF THIER HARD EARNED MONEY! I also used to have an account with Bof A they screwed me so bad with their credit card charges, like raising the interest rates, when I was late one time, then the late charges put me over my limit, then they added over limit charges, before I realized they were hitting me for so many charges I was getting deeper and deeper by the month, with out even using the damn card. I eventually called Take Charge America to help me. They put a stop to all over limit chgs, got the interest lowered again, I made payments thru them and now 5 years later I am free from them forever. I believe I would have been better off to borrow from a loan shark, talk about legal theft!

I agree that BOA completely and utterly sucks, but what I dont understand is that you alone are responsible for balancing your accounts.
The fees suck however you wouldnt have them if you just took the time to balance your account. Most people assume that ol/b will balance their acct's for them, but its only a tool to see what has come in. I was a BOA customer for years and never od'd my account because I balanced it. All these comments about fee's, well you have the control of getting them. They are a bank and they do suck, they will suck ever possible fee out of you that they can. Not just maintaining your account but, you have to be deligent and check every aspect of your account. What relationship did you sign up for and what are you in now? Did they slip you into the bogus Privacy assist? Their stupid A&D insurance? In January they're getting rid of alot of accounts and starting new ones and the theme is "a way to pay" It's basically more BS and having to pay a high balance qualifier to waive the monthly maintenence fee. Before you people only had to have a direct deposit to waive maintennece fees. In January that all changes. I don't understand why people stay with BOA. You people [censor] and complain, so leave. There are smaller banks and credit unions that offer real free checking. And, by the way I work at a call center, hate it and going to college fulltime to have a real career someday. I have to say, I dont know who I hate most the bank or some of you ignorant [censor] who call on a daily basis who have no business even having an acct anywhere because you cant do simple, basic arithmetic.

So I deposited my last unemployment check ( last as in the last one being issued to me by the state as I have exhausted all benefits) BofA pulled out 962 from my account because they say I owed it back in 2008. I just recently reopened my account in January of this year and I was never told that I owed anything. They opened my account and let me deposit and withdraw as needed for over 2 months. Now Im stuck with 30 dollars to my name. I have two small children to feed, rent, and a car payment that I have to take care of. So I feed my kids on the 30 dollars, lose my apartment because I wont have rent money and will have to live in my car until the bank repos that.

Already asked about welfare but they wont give me any money because I recieved that check that I deposited and had stolen from the bank. They say that my last check would help me live this month and dont care that the bank took that from me.

I agree! I personally was just charged over $350 in NSF fees recently. Some of the charges were charged an NSF fee on an NSF fee. Which took me further into the red. It is bogus and unfair. I HATE Bank of America and have been with them over 10 years. When I went into the bank to speak with a personal banker, he was at least able to refund $180 of that amt. but I still had to pay close to $200 in NSF fees. I don't know what basis they used to refund at least that amt. Absolutely ludicrous!
Gosh, I just got NSF charges THREE times, for $35 each. And you guys were right - they purposefully processed the biggest charge first. Otherwise I would have been charged just one time.
We need to do something about this. I've been banked with them for many years and thought they're great to do business with, but from my last conversation with a customer service rep and his supervisor I came to a totally different conclusion. Rip Off!
Info please: We paid in over $900.00 in escrow account with Bank of America and they took it saying we didn't have insurance on our home which was a lie because we paid for a FULL YEAR on our insurance!
My husband called them and told them he wasn't paying them another dime till they put that money back.
Now for 2 months we have not gotten a house payment billing statement, nor our escrow account amount that is empty.

If your son was serving active duty during the time that his account became delinquent or over the limit there is a clause that all creditor must honor “The Sailors and Soldiers Relief Act”. Which is a law that would force the bank to go back to the date of active duty and change the interest rate to a fixed rate of 5.9 percent and waive any late fees or over limit fees that occurred during that time.

My son has been a patient in a New Jersey mental hospital for 30 years -- sentenced NGRI (Not Guilty Reson Insanity) for a violent crime. He will likely spend the remainder of his life in confinement.
My son ran up some charge card debt in spite of the fact that his address was clearly that of a mental hospital.
Good Old Greedy Bank of America even phoned my son at a hospital ward PAYphone in May 2007 and offered a man who has not been employed since 1979 a loan of $20, 000. My son is on high dosage of anti-psychotic drugs that reduce anxiety to the point that he is not fully functional -- so when offered the loan over the Payphone, he accepted.
Now the harassment squad at FIA Card Services is calling multiple times daily with very belittling words addressed to my son in spite of my letter to FIA Card Services explaining my son's situation. This harrassment will likely cause the doctors to incrase the dosage of anti-psychotic drugs and thereby increase the already debilitating side effects.
My son does not even receive Medicare disability pension because during the Clinton administration there was a change made that declared that persons judged NGRI could not longer receive Medicare disability pension payments. Incidentally, he does still have Medicare Part B but the Social Security Admininistration (unlike the Bank of America and FIA Services) has declared that my son is without any means to pay the premiums for Medicare Part B and apparently Social Security has a system which pays the premiums for such an indigent person,
