New Mexico Department of Workforce Solutions Useless unemployment service.

Long story short it took unemployment 12 weeks to approve me and I got the backpay but that money went to three months of overdue truck payments, rent, food, gas, utilities, etc. They cut me off immediately after I got the backpay and said they have to reevaluate my claim, which is strange. Back at square one now, about two months behind on the same stuff. These guys are absolutely sick. People are going homeless out there and the unemployment staff is just there getting a paycheck not giving a crap.

Recommendation: Don't count on these guys. Take any job you can get while your'e looking for a better one.

Like many others I am complaining about NM Unemployment. I know this is pointless but we are getting ignored but I figured I'd add to the list and help create an awareness.

I got let go in June 2023 and it took unemployment 12 weeks to approve me and that's because I called so many times to push them and try to figure out what the deal is. Well I got the backpay and that's it. They cut me off immediately after and said they have to reevaluate my claim and I have to start over. That backpay paid for almost 3 months of overdue truck payments, rent, utilities, gas, food, etc. So it didn't go very far. Point is here we are again back at square one. I emailed unemployment and someone replied with a real snotty comment telling me to be patient. That was the whole message I received.That's the only communication I've gotten from these jerks since they cut me off. Communication is a major issue here. They leave people in the dark and when we finally get through to someone they are snotty and not helpful. I'm almost 2 months behind on my truck again and I have to borrow money to pay utilities and food. I literally ran out of food and had to ask my parents for money for food like some homeless person. This is ridiculous. Luckily I just got a job today and I start Wednesday, no thanks to NM unemployment. They are just awful people who don't care about their claimants. I can only imagine what other people are going through. I hope no one ends up homeless because of these guys.

New Mexico Department of Workforce Solutions Canceling unemployment claim

I called on November 3, 2023 to cancel and unemployment claim so that I could file in my home state. (I worked in NM on a project from March-July 2023). I was advised they would document my case and have the claim cancelled in 24 hours - customer interaction #2338494 for that phone call. The claim still has NOT been cancelled. The state of TX has sent an email requesting the claim be closed on 11/27/2023 and documented within the hub. I called back on 11/30/23 to speak with a supervisor to escalate the case and the blatantly refuse to transfer you and I spoke with Erica who states her supervisor would contact me within 24 hours. I still haven’t received a call.

Claimed loss: 4 weeks of unemployment benefits on my home state as well as delayed processing of my claim in my home state.

Desired outcome: Cancel the claim!!!

New Mexico Department of Workforce Solutions Unemployment Payments

I was let go from my job last week of September 2023. I have fulfilled all the rules, did all my job searches, reported all of them, filed my weekly claims. I have not gotten a single bit of communication from anyone. I call every week to speak to someone and I get treated like I am inconveniencing them. I have not received a payment. I have been told they are investigating. That is it. Before that, it was that the employer hadn't responded. How long are they allowed to drag this out? First I was fired for an non-fireable offense, which cost me my paycheck, and now my ex employer is still hurting me by not responding and unemployment is facilitating that. Rent is due, my power is about to be cut off, and I have 4 children I provide for on my own. I did my job. I did what I was supposed to do. Why is it taking this long? It has been well over 6 weeks.

Desired outcome: Immediate review of my file and release of my benefits.

Ive been approved for unemployment benefits since july 2023. It is now almost november and I still have not recieved a single payment. I keep calling and I keep getting told they are giving my employer time to respond to my filing. How long do they get to respond or appeal cuz I was barely given a week to appeal if I didnt agree with their decision. This is outrageous! Im bout to be evicted and utilities cut off due to this.

Claimed loss: Im about to be evicted and i have children.

The whole state of new Mexico is so not right there are no rights or law protecting someone who’s being discriminated or bullied sexually harassed or a Mother of the Brutally Murdered Daughter, I have followed protocols I’ve complained I’ve called I’ve emailed to no avail, but I have rules to follow on here as well, I can’t cuss and can’t use capital letters and so on, I’ve been waiting for 15yrs for Justice for my daughter’s murder, still nothing. I filed for unemployment because I was wrongfully terminated after a couple of months I was just denied, for whatever reason they make up, forgetting I had a job I did my job I was responsible I am a 56yo woman who was in a volatile extremely hostile environment, followed protocol, 4 years, nothing, I am on here to let other people know about the state of this State of new Mexico I cannot understand how out of control all of it is. I am not crazy. I am truthful.

I applied for PUA on April 12,2020 the agency kept making me appeal from [protected] of August my file was audited in March 2022 I provided all my business information and I was told in December 2022 I didn’t certify never gave me opportunity to certify due to there system I received everything in correspondence but to certify in December 2022 next when I was able to certify I had to appeal Had a hearing January 2023 I was decline because I didn’t certify in a timely matter I appeal in February 2023 and I had to submit to the jurisdiction that I did live in April 2029 in August 2023 I was told I wasn’t in the right jurisdiction I was dismissed this agency needs a investigation I have emails and documents dated back to 04/2020 up to 08/2023 my hearing in December 2022 Question was I affected by Covid the whole country was especially that State that didn’t open up to the public this organization is corrupt

New Mexico Department of Workforce Solutions Unemployment Benefits.

My unemployment benefits have been on hold for 9 weeks they placed a hold on it for fraud and didn't even tell me what they needed after I provided my ID and social it was on hold for 2 weeks they kept the investigation I only have one pending issue which is my employer. My previous employer did not respond within the 10 days and now they're just sitting there waiting for an adjudicator when I call they talk to me like I'm an awful person they're rude they make me feel like I have no right to call they give me no answers and they treat people like they are better than anyone else I just would like to have an answer and I don't understand why it only has one pending issue and it's been sitting dormant for 3 weeks and when I call they act like I'm an inconvenience and a burden

Desired outcome: I would like to know if someone is going to actually work on it at any time I don't know how they can be so rude to people they should at least tell us what's going on and how long it's going to take

New Mexico Department of Workforce Solutions No determination being made for or against benefits 12 weeks in.

This is my 3rd and last complaint. This to test the process that there is no known solution for a resolution using this platform. As you see there is only 1 complaint having been resolved. So this platform is primarily a place to blow off steam? Either way here goes.

I called the DWFS of NM twice last week regarding a determination on my claim which I filed on 5/18/2023. I called 6 weeks into the process with the gentleman I spoke with stating I should be receiving a determination soon. He also seemed a little upset that I would call to question their process. I again called 9 weeks into the process and was told at that time I needed to be assigned to an adjudicator. The female I spoke to said she had e mailed whom ever to see that I get assigned. That evening I used this platform to iniate my first complaint. The following morning I received a phone call from what I thought was an adjudicator. I had to pending issue one of which involved my pension and at the time of this phone call it was ceremony there would be no effect on my benefits if eligible. I was told that I would be receiving a determination on my other pending issue which involved my discharge from the employer that I would be receiving a determination early the following week. That week came and went. I called once again the following Monday. Mind you on hold for 56 minutes because I was determined to speak to someone. Someone who has no idea what's going on but stated I needed to be assigned another adjudicator so once again I was told she emailed someone to see that thru. I called again on Wednesday who once again looked at my claim and stated that the adjudicator who by the way was the one who called me the first and only time had not yet made a determination. I asked why would he tell me early next week and then blow me off. Well you see it matters how many determinations have to be made and where you sit in the process of I am guessing thousands of determinations needing to be made by this sole adjudicator. When I asked if he was the only adjudicator I was told no that there were many adjudicators. She stated there are many different things that affect a determination and they have to make sure they abide by labor law both federally and at the state level. So my best reality here is that this adjudicator must have thought a determination could be made in as little as 5 working days in my case but then something must have tripped that up delaying a determination to be made in a timely manner. I am only guessing here because I do not know why this process is once again being delayed and trying to give them the benefit of the doubt.

My issue now is this. I need a determination to be made, am I eligible or ineligible? I at this point don't care which, only to be able to move on to the next process of appealing a denial if it is deemed I am ineligible and for which I am fully prepared to do having all these weeks to get ready for that if it be the end result. Instead I am forced to wait weeks for what reason? In the hopes I will give up and they won't have to bother with me and my claim? Even if I were to obtain employment at any point in this process I won't ever give up fighting for all these weeks I have remained unemployed. This separation from my employer has devastated me and my life. To the point that I am unsure if I will be able to find employment again at my age. I am 61 years old and eligible to retire next year. Who wants to invest money and time training an individual such as my self who could leave them hanging to retire? Although I do use this in my interviews that I am far from ready to retire and don't plan to Lord willing until I am at least 70 years old. So this tactic isn't working. I would much rather gain employment than keep filing weekly certifications for unemployment benefits. Yet I will continue to certify and to fight for all the weeks I have certified even if I gain employment in the meantime. Just to make it known that this platform will avail you nothing and that I believe it will be the the Secretary of the State of NM whom I believe I was told to contact in order to get any results for this ridiculous waste of time the DWFS has put me and others like me thru. The fact that we are at these peoples mercy to play God in our lives must be there attempt to deter us from becoming unemployed even for those of us who are in no control of this tragedy occurring to us. I am now at the point of becoming an additional number to those homeless with my credit I worked so hard to build being lost to my inability to pay and my debts added to our ever growing cost of living because some one has to pay for these companies loss. All because I haven't been able to obtain employment and have no means of any kind of financial help to pay any of my bills because every dime I have is now gone. I am so afraid of what is going to happen and it is that fear that pushes me to keep fighting for a determination to be made on my claim and my next course of action in contacting the Secretary of the State of NM.

Desired outcome: A determination to be made in my claim for unemployment. At this point I could care less if it is determined I am ineligible for benefits because I am fully prepared to appeal and win this decision.

New Mexico Department of Workforce Solutions I am complaining that there has been no determination made on my claim having verified for the 9th time yesterday.

I filed a claim for unemployment on May 18, 2023 after being terminated the day before. I called the week I had certified for the 6th time to question why there had not been a determination made yet. The gentleman I spoke to was irritated I had called asking this he stating it is a lengthy process. He also stated I should be getting a determination soon. I called again today this being the 9th time I certified only to be told I had not been assigned an adjudicator. When I asked why she said sometimes it falls thru the cracks. I call this a nice way of saying some one didn't do their job. Including the gentleman who I called and spoke to the first time. I am aware that NM law states that an employer has 10 days to respond to the initial claim. If the company fails to respond a determination can be made by the adjudicator if you are eligible or not. The employer may appeal their decision within I believe 15 days from the date of adjudicator determination. I was never assigned an adjudicator so I have no idea if the company has responded or not. I also have 15 days to appeal if it is determined that I am not eligible. Which I am prepared to do. This company has failed to provide to me in writing the reason for my termination. Now if they have provided in writing to NMDWFS a reason then I should be provided whatever it is in writing before they submit something to NMDWFS. Either way this is going to be what? At the very least another 2 weeks and that is only if an adjudicator gets on it right away to make a determination that should have been made at least 6 weeks ago. Then if I have to appeal the process is going to take however long it takes to get a court date which is another lengthly process. I feel my claim has totally been mishandled. Causing me so much stress while I am actively seeking work and having no such luck. I am a 61 year old female who could retire next year if I so choose to. Although this is not my plan I feel that companies are not willing to invest training and money into someone who could leave them hanging in a year. Which I have used as a reason to hire me because that is not my plan. I was told by the woman I talked to that there are laws protecting me in this situation. True, I am aware but just how am I going to prove it? I can't even get a determination made that I should be getting unemployment. Because this woman could not answer my questions I should have been transferred to some one who could. My claim is not important enough after having been made to wait 9 weeks to be told why and when I should be having this determination made. When NM rules and statutes have stated mandatory time lines for the employer and employee I believe that the NMDWFS should be held liable for not making sure they follow these rules and statutes. I was hired by this company at the beginning of COVID. When people were afraid to work with the public. In fact this company paid me to go to work as an added bonus weekly. I had no intention of leaving this company until I retired but they obviously had other plans for me. So I made my complaint not that it will bring me any hope for this process be set for the next step appeal or pay I only wish!

Desired outcome: A determination of my eligibility to be paid for all these weeks or for me to wait however many more weeks it takes to get a court date after I appeal if I am found ineligible. I can't handle the stress of this.

New Mexico Department of Workforce Solutions Regarding UWC discrimination against me, James Jaramillo O2

June 17, 2023

Below is a letter that I (James A Jaramillo) wrote in response to UWC/United World College at their Montezuma, NM Campus-for not pursuing me to be their Spanish-English Teacher-yet there is no other applicant for the aforementioned job who has credentials as good as mine. Secondly, virtually all of the teachers there are women and yet there is a 50-50 percent gender ratio in the US-so I am being discriminated against because I am a male-and-moreover-when I looked at UWC’s Teacher Roster-there were no Hispanic Surnames-thus-I-am being discriminated against because of my ethnicity!

Look-there is no way you (United World College-in Montezuma, NM-have chosen a better candidate than me because my background is unique (that is) via my teaching of Spanish & the other Romance Languages, Latin, Greek, Chino Mandarino, the Slavic Languages, Athapacan Languages, Japanese & the Germanic languages. Moreover-I speak twelve-languages plus parts of other ones along with their varieties/dialects!

And-I have also presented my pedagogical & romance-language-research to NAHLS where it is published in! Moreover-my article-entitled “Vygotsky’s Sociocultural Theory & his contributions to Constructivism” is also published (in the 1996 Ed Journal) and these works are available throughout the world via multimedia!

Lastly-my Spanish - BLE & ESL lessons are also published in ERIC and are also available throughout the world. In closing-I-also have won several awards, such as the Embassy of Spain Veca one (and there are only 100-each year that are selected from maestros de los estados unidos), the COLT Award along with Scholarships, Fellowships & 4.0 GPA awards & numerous other ones!

Thus-unless-you cooperate with me-I shall contact one of my attornies Thus-please re-think what (unethically) you have done to me!

New Mexico Department of Workforce Solutions Customer service

I have been trying to get unemployment insurance through New Mexico workforce solutions. Dates for starting unemployment claims around the end of April of 2023. I told the customer service agents this was my first time filing for an unemployment claim, and had explained that to the.customer service agents that I was not sure how to navigate to get unemployment benefits. Everytime I have been calling since the end of April to get assistance, the agents are rude, insulting and try to push me off the phone. The worst customer service agency I ever dealt with. The customer service agents don't want to help yet they get a paycheck because of the customers., Very rude employees/agents. I have been waiting almost three weeks and I had followed all the correct steps to able to file unemployment insurance claim, however still nothing. Also the website for this agency is a disgrace. This place needs all new employees agents that a empathic that know what their doing and want to help customers.

New Mexico Department of Workforce Solutions Fight for payment due to account takeover

Mid August 2021 my direct deposit info was changed to an unknown account. I reported the issue. My funds were reissued. I had to set up a whole new account since my account that got hacked was locked. I did my last 2 claims over the phone after my new account was secured October 28 or 29 of 2021. I’ve being given nothing but the run around on when I’ll receive my funds! No one can seem to tell me anything reguarding why I had to request my funds again on the 2nd of February 2022! I still haven’t received payment going on 6 months now.

New Mexico Department of Workforce Solutions Circle k I’m complaining about unworkable environment

Circle k makes there employees work with or with out covid and then make there employees scapegoats. Never worked for a piece of crap company in my life. I couldn’t believe that this company made me work with covid and I have other employee's to back it up they hid the results and still made us work because circle k is 24/7 made us work to compete with 7/11

New Mexico Department of Workforce Solutions Return to Work Bonus Payment Denial

I was advised that I do not qualify for the return to work bonus payment because I did not have 2 work searches the week I returned to work. There was nothing that stated that I still needed to search for work only that I need to report that I returned to work which is what I did. Furthermore, why would I search for work when I was offered and accepted employment. It was stated that I would receive $1, 000 if I return to work the week of 07/04/2021. Returned to work on 07/06/2021. I think this is extremely unfair and it feels like New Mexico Department of Workforce Solutions just doesn't want to pay out benefits that THEY are the ones that promoted and offered to people on unemployment. I submitted an appeal and was told that was also denied. No correspondence was ever sent to me stating that I would not qualify, that my appeal was received or reviewed.

My complaint is about customer service. After a long period of being closed I finally got to talk with someone and I told them that I had an upcoming court and they confirmed that I would be participating in court and even took my number so that I could be called. On my court date I never got a call. Turns out that was not the person to confirm that information with and now the judge won't even heard my case because he says that is not probable cause for missing court and I never got to state my case even though I was assaulted by my employers family member who is also an employee.

Desired outcome: I would like to be heard since I am the victim of an on the job assault

Get a probono attorney and take them to court. File fir loss of wages, damages and punitive damages. Make them pay yiur Lawyer if they charge. It could also be lawyer hired on contingency. Make lots of phone calls and ask for referrals. Good Luck.

New Mexico Department of Workforce Solutions NM Dept of Labor office in Albuquerque who handle unemployment claims

I had to file for unemployment back in 2020 because I was eligible I was working for a Motel in Carrizozo NM and becaue of CoVID and the travel restrictions I could not get hours and I ended up homeless. Prior to my getting locked out back in March I had a claim going for a job I held briefly with family dollar. During this time my acct with Unemployment was locked and I was unable to get a hold of a live person until 6/21. I went through all the calling for days until finally by the grace of God after submitting my identity requirements through NMUS by fax I was able to apply. I got approved in late July and received back pay . Not even a week later I was given a notice by NM UI that I needed to send in my tax documents which I did and they deemed me ineligible and are now saying I owe 7840.00 back because of eligibility question. I had tried by phone and had actually talked to a live person almost 3 times a week to make sure I submitted right information and they told me I had everything in. I am submitting a discrimination claim because I feel I am being discriminated against by NM UI because of a fraud issue back in 2007 that they deemed was fraud and I don't. I feel they won't talk to me and explain what was needed to resolve my problem. The last CSR I talked to said she already made the ineligible decision and if I don't agree with it to appeal it. I asked her how could I do that when no one was telling me what the ineligible decision was for. Please this has gone on with them for over 10 years they are rude and hateful and they don't explain what they need me to submit. I also filed a appeal but was unable to attend due to a domestic with my son who is abusive towards me. Because of them and the approval at first I was getting current with my bills and housing and now I am back to possibly being homeless. It's not right I have a mental disability and I really have ptsd with these people I am terrified of having g to talk to them I was even yelled at by the last csr. Please look into it can someone please have them audit my messages and conversations my actions were all in Response to their information to me and how am I ineligible and owing money due to their unfair assumptions please help

Desired outcome: To be deemed eligible because I am eligible and I have submitted all my information to the best ot my knowledge

This response is 6 months late, hopefully all has been resolved. I know full-well how many of these offices operate, by the seat of their pants! They do nothing for taxpayers and have no accountability. I would contact your state representative's office, best to go in person; have all your information, you will probabky be referred to his/her assistant/s. At least they can try to get you housing and make necessary contacts for you.

You can also call or write to the governor's constituant's office, tell them what you are needing.

There is always NM Legal Aide, they might help. Best of luck from one who has been there.

Since March 2021, I have attempted to contact Stacy Johnston, Acting Public Information Officer for the NMWFS with no response. To date have attempted to reach Stacy Johnston as outlined and distributed by NMDWS News Release and have followed the proper procedure. But feel that this publication is false and misleading in a way to divert or reflect people who received overpayments in no fault situations. I have filed numerous complaints to include New Mexico State Governor and apparently only fall on deaf ears, as no one can answer my questions or at least acknowledge me in any size, shape, form. And has violated my Civil Rights on so many accounts unbelievable.. And NMWFS sending me redeterminations that I am eligible for benefits. But due that I had complained and asked where was my first check that was issued but never received by me triggered an investigation and determined I was not eligible and the NMWFS collaborated with each other to include Cabinet Secretary Bill McCamley.

Desired outcome: To be acknowledged and issued the waiver of overpayment that was caused by NMWFS

New Mexico Department of Workforce Solutions Waiting 14 months for my unemployment, And Spoke to several people and my account has been locked 3 times and no payment of any kind

To whom it may concern,

My name is Phil Rivera and i applied for Unemployment in October 5th 2020 and i didn't hear
anything for 3 months until i called and got ahold of someone Finally i did talk to someone
And they told me i owed $1.200 in back pay and i said ok, So i was making arrangements to pay, and I received papers in the mail and the papers stated that I i needed to fax papers to them for proof of who i was. And they were asking for other documents. So i faxed them on December 5th 2020 and i haven't heard anything back since then. So i thought they were just backed up. So i waited until August first 2021 and they locked my account for a week so i got ahold of them at the
office and they said my account was locked because they needed proof of my id and social so i faxed them in and i waited another 8 days. And today is August 31st and my account is still on lock.
Iv waited a year and 2 months and my wife has been diogionsed with a rare cancer and we have been without of everything and almost homeless. please help me .
I do not deserve what is happening to us i have worked hard all my life and i am honest and don't understand our system. Thank you Phil Rivera.

Dear Phil, I feel for you. I am in a similar situation, thankfully without rare cancer though so I can't even imagine your despair. I am furious about how DWS treats us. There is a class-action lawsuit in the works. I suggest contacting New Mexico Center for Law and Poverty.

I was laid off due to covid pandemic... Filed for benefits and began getting payments.. Months later received overpayment notices and expected to pay back. They said their was a waiver which I filled out that could get rid of overpayment.
