I hope someone is investigating TD Bank's posting practices. I wrote a check and placed it in the RENT DROP box of my apt. complex office on Tuesday morning. As of late Tuesday night, the check had not been presented (as you would expect). Every Wednesday morning, my direct deposit goes in. The rule for direct deposit is: funds are available at the opening of business that day.
When I next checked my account, the rent check had been posted prior to the direct depost, and I was charged 35 dollars, which caused another overdraft and another 35 dollar charge, and a third...
How can a paper check presented at another financial instituion (I confirmed w/the rental office) hit my account on the same day and before my direct deposit, when it was not showing that night? How can they post debits BEFORE credits? Why do online payments go though when there is not suffcient funds and hit me for 35 bucks, instead of generating a no-cost message that my payment did not go?
Customers should be closing their account and fleeing these financial pirates in large numbers.

TD Bank in East Northport NY has so far charged over $570.00 in overdraft charges on transactions of a Debit Card. The Debit card is NOT a Charge Card, and when I complained several times I was unable to see the Bank Manager in person. He was unavailable during the working day and unavailable during working hours. Naturally, he is unavailable at other times. His response to my inquiries, related through an employee named Elizabeth was a curt "NO, we cannot help you" ...left on my answering machine.
The problem: Dunkin Donuts in East Northport NY had decided on 36 Mar 2010 to put through transactions, debit and otherwise, that for some reason did not get processed since mid-february, even though the transactions were approved by the banks.
The customers were hit with debit withdrawals-one for each transaction. TD Bank immediatey hit me with a $175.00 FEE, and then other substantial feees for over a weeks time to again over $570.00. I was unable to stop the process as the 'YES' Bank was not co-operative at all. I am still unable to have representation in this process and I believe ot is time for the Atty Generals office to get involved.
I expect the bank to work with me, the consumer-customer, to NOT CHARGE ME for Dunkin Donuts Error.
The transactions were approved and initally shown on-line as being taken by the bank.
Yes, You are correct, it is MY Money. The banks have taken the right to charge usurious fees against the consumer/customer without government approval, and without my right to take action against it.
This is equal to taxation without representation, and I for one, bristol against it.
We are being robbed by the banks and I will never trust them again, and if you cannot see it, you are either blind, too trusting, or a banker. The world needs to revolt against the banking system and make it more equitable.

BEWARE ALL BUSINESS OWNERS. TD Bank may offer a small business loan. You may get the money. BEWARE that you may not be able to adjust or increase your credit line. I have 810 credit score. I was commended on my business plan. We broke all projections by two accounting offices. One of the accounting offices was even reccomended by TD Bank. I received a credit line from them however I beleive they lend you money to get you "in" and then LOOK OUT! I beleive they are purposly approving loans with a prommise of more funding after "they see how it goes". What is really happening is they are giving just enough for you to sign the paper and then they walk away. This allows them to keep collecting intrest without getting in deeper. This intrest is paying off their bad banking losses. After 25 years in business and with a long history of owning several businesses, this bank is the worst bank you can possibly do business with. If your are considering a loan or credit line with a bank do not sign with the devil. Borrowing from TD Bank was the worst thing I have ever done in business in 25 years.

TD Bank ruined me totally. They stole over 150K in insurance money for a property that I owned that suffered a fire. I later as a result of this fraud and deceptive lies, , , lost my property, lost my business, and have spent nearly 100K in attorney Fees. And to those slick that always jump saying ohhhhhhhhh if you dont have the funds dont used it, well...I do have the funds but they trick you in all the ways to hit you with the fees. The goverment doesnt do nothing, the law enforcement doesnt do nothing, the bank and our local politicians doesnt do nothing...My bank account is [protected], I hope that someday 1 judge makes them refund back all the overdraft fees that they have take from us like they ruled in California to Wells Fargo.

i made a deposit with a paper check @ the new check scanning ATM's for $444.51 and all was well for a week.When i was online banking i noticed a debit for $259.60, knowing that it was not mine i immediately contacted TD Bank and they said that this was a check that was deposited and the bank the check was drawn from was returning the check.so far i have been getting the run around for about 4 bussines days, "where is my money TDBANK!" there was never a deposit for $259.60. America- Don't Bank with TDBANK... It's not Convienent. Don't listen to Regis Rippa & Kelly Philbin. it's hard enough making a living. without the banks taking your hard earned money.

I did receive the green book. It was basically "...bla bla bla we are adding new fees including maintenance fees bla bla bla..." Because of that, I went to the Newark, DE branch on Jan 29 and closed all three of my business accounts which all had zero balance. Comes Feb, 1st. All three account got charge the $25.00 maintenance fees taking the balances to -$25.00. I have been demanding since then that the accounts be closed to no avail, maintenance AND overdraft fees keep coming. I have filed complains with the BBB, FTC and Delaware Bank commission and I am waiting to see how it goes. Yes I would love to be part of a class action lawsuit and put that bank out of business but unfortunately, the chances of that happening are slim.

I made the mistake of choosing a "Simply Free Checking" account. I must have missed the letter in the mail about the change. Since the change that they decided to make I am charged $15.00 per month. According to bank staff it's my fault for not taking time out of my busy day to change to another account. To top it off I was issued $ 140.00 in charges due to an electronic deposit being processed days after it cleared the other account. Avoid this bank. They will make middle class America poor if we are not careful. I'm going through the hassle now of changing to a Credit Union. Do yourself a favor & choose a Credit Union. Please tell your friends also so that we can protect people during this recession.

On the morning of February 17th my debit card was fraudulently charged for over $600 dollars. That same morning we notified your bank and cancelled the debit card. My wife (the business owner) and I even went to a local branch to sign papers and speed up the process. To date your bank has done nothing. We have even given your bank a copy of one of the invoices charged to us and your bank failed to act. I finally had that charge for $192.89 reversed by talking to the company while your bank did nothing. I reported the incident to the FBI and your bank has done nothing. After talking to numerous employees and numerous managers and without action on their part, I can only conclude that your bank does not care for its customers and might even loathe them.
You see my circumstances are different as I explained over and over again to TD Bank's "do nothing help". And I use the word help very recklessly. I am a heart patient who cannot buy his heart medication because of the hold on the account. We have over $300 in checks that we cannot deposit because it will get swallowed up in overdrafts and negative balances. We cannot cash even one of them because of your business policies. All your "help" knows this and does nothing to free up the account even partially so I can get my medication. So tomorrow we will start the process of finding a new bank that actually has customer service and employs it in their day to day practice. We now know the questions to ask the prospective bank and have as a model what we do not want in a bank... YOU TD BANK.

Ever since TD Bank took over for our beloved Commerce Bank here in south jersey, there have been hints at some of the recent troubles. From the entire offline fiasco which cost me 200+ in overdraft fees, to the change in policy overnight. However, the recent realization that TD Bank intentionally holds your money after you buy something on debit set me over the edge. I have recently had a debit for a gas station in the amount of $40 take 7 full days to post. My girlfriend had a mortgage payment take 19 days to come out of her account. 19! And since they held it for 19 days, every debit she made in those 19 days was taken out AFTER they finally took the $1000 mortgage payment out. They charged her account for 7 overdraft fees.
On top of all that, we have found that TD Bank has changed their policy towards insufficient funds. You will never have insufficient funds again with TD Bank! You know why? Because even if you have 0.00 balance in your checking account, they will still allow money to be taken out. Lets say Ebay is set up to take out whatever you owe on a monthly basis. Prior to TD Bank taking over, if I didn't have the funds, the money would not come out until I did. Same with Netflix. They would just keep trying until they got their money. I'm talking minor transactions of less than $20 here. But TD, oh yes, they want you to go negative. So they now allow any merchant, no matter who it is, to take your money out of your account, no matter how much is in there or how much the transaction is. If you have $2 in your account, and you have a huge bill that automatically comes out, it comes out, along with $35 overdraft fee AND a $35 insufficient funds fee. Now here's where it gets good. Since they've been holding your prior debits for about a week, they take that opportunity to run them all through at once, causing multiples of the $35 fees. Honestly I could go on and on with little discrepancies here and there, but you get the picture, and I'm certainly not the only one experiencing this absolute joke of a companies shady business tactics.
Now, is any of this illegal? Not necessarily, but it is predatory. It was changed from previous policy under dark of night sent in a document the size of an unabridged dictionary, and they've been shoveling it down our throats. If anyone would like to start a class action lawsuit, I would be very interested.

I have tried every possible means to pay my bill with them, fred meyers jeweler uses them as their financier for their retail credit cards, i have spent over 3 hours on hold with these people to be disconnected or rerouted to the very beginning of the automated service. I have emailed them AND EVEN MAILED A CHECK to these [censored]heads to pay my credit card even though ive never received a bill (tried changing my address multiple times but could NEVER get to s rep and when i did theyd put me back on hold to get mysteriously redirected to the start or disconnected again) cant even use their online service cause i had no account number. Filed a BBB complaint. They are blatantly inhibiting my ability to pay of my loan and adding 75 bucks of late fees for every WEEK its late
Here in Canada I have closed all of my TD and TD related accounts.
This included insurance policies, pension deposits and credit cards.
They are extremely mercenary and predatory when it comes to fees.
You can sense it when you simply deal with any of their employees and agents.
I learned about this stupid practice of allowing your check card to still authorize charges back in December. You have to opt out so that your card gets declined. I opted out. Guess what? My card still won't declined. So I called today because of the $270 in overdraft fees that I have due to a $3.95 charge not posting to MY PENDING transactions until 5 DAYS LATER and she confirmed that I had opted out but that it's not guaranteed that the charge won't go through if it's a negative amount.

This is a perfect description of what I have noticed as well. I have no issue with items "pending" for a while...but when they finally post they should certainly post on the day they occurred. The bank has literally decided it can change the dates of multiple debit transactions so that they can wait for your account to overdraft and charge multiple fees. The closest word I can think to describe this situation is SCAM. It really is.

As a former employee of Commerce Bank, I must say that while I do not believe that Commerce did their employees justice (minimal pay, lousy benefits, etc), the customer service and perks of being a Commerce Bank customer were phenomenal.
Now, TD Bank has swallowed Commerce Bank and regurgitated this disgusting, pathetic example for "America's Most Convenient Bank". Overdraft fees are through the roof. Personally, I'm very upset that the interest checking account (a min. of $1, 000 gains interest and reversal of foreign bank ATM fees) is obsolete. And now I hear from my former colleagues that the new system (the old system was by far more friendly) is creating huge problems for customers.
For all of you bankers out there, know this inside info: When a bank tells you that they are merging or a new system is coming along, MAKE PREPARATIONS TO MOVE YOUR MONEY ELSEWHERE either temporarily or permanently. Trust me. You will save yourself a lot of headaches.

This bank should be shut down. Go to Ocean First or any other bank. My aunt wrote me a TD Bank check for $25, and TD wants a $7 check cashing fee, or $15 to open an account with them. The nasty manager suggested I take my business elsewhere almost immediately, instead of explaining the policy to me clearly.
Why do you people have accounts with TD? You are all fools for letting them stay in business. My aunt is considering switching, this isn't the first time she has been burned by TD. If you have a TD bank account, shame on you, you are feeding monsters. Look at all the other complaints - much scarier than mine! First I made a deposit on Sat. suppose to go through on Monday the deposit actually went through Tuesday but showed that it was available Monday. Yet on Sat. and Sun. the Available and the “balance” were different. Yet on Monday I went to an ATM, and did some shopping looked at my balance Tuesday and it was fine, Wednesday there was a $210.00 fee on my account, an overdraft fee which my account statement NEVER showed negative. Without getting into all of the boring details of the back and forth conversation I am very disappointed after 10 YEARS of business they pretty much said too bad we don’t care. The withdrawals were made on Monday the deposit was made on Monday why the fees. This has changed as I have been with them 10years plus and never had the issues I have had in the past few months. To top it all off last month I emailed them about OD fees when my account was not negative and they just emailed me back saying we have reversed the charges, I was assuming they made a mistake and never thought twice about it….So the $210.00 fee they said they would not reverse cause I had the other two reversed. I proceeded to tell her that I thought the fees were a mistake they made that no one explained anything and I have the emails, they didn’t care at all. I continued to tell her that there are numerous times I have had an available balance different form my total balance and that there are times that I hit an ATM and try to grab $200.00 only to realize I only have $180.00 and it denies me but now all of the sudden you are telling me that I can overdraw from an ATM? Horrible to a long time customer like myself. After $210.00 four weeks before Christmas Three kids living check to check, they now say that I can cancel out of this program? Thanks a little late for that!
Opening a new account (NOT with TD BANK) unless you have millions maybe! What’s up with all the fees? I got so many fees from this bank from when I opened it to now I can’t take it anymore. I have a small business just making it month to month and the fees are just too much! The only time I have problems is when I write a checks let me explain. I deposit checks on Sunday but I don’t have the funds until Tuesday and that’s ok. What’s not ok is when I write a check out TD gets the check does not post it in pending transactions and then on Tuesday they take it out of my account and say they got it on Monday then give me a fee for it because I did not have funds in my account yet! Wait I’m not done anything I did on Monday like take $40 out of a TD atm get gas and go to walmart now puts my account off because of the check they say they got Monday! I now have $140 in fees one for the check one for taking cash out of my TD atm one for gas and one for using my debit card at walmart. It’s how their software works it’s designed to fee you any way it can so make sure you have lost of $$ to wast if you open a account with TD.
During Christmas season, I was a bit careless with my money and spent more than I had. I still managed to pay off the overdraft fees I received for this. January comes and goes, and I never went into the negative. I was somewhat responsible with my money. February 2nd, I get a $140.00 overdraft fee. I only had $129 in my account at the time, so obviously I'm in the negative. I wasn't aware of this overdraft, so I spent money on food, gas and clothes. A few more fees later, and I'm now at -$270.
I've included a picture of my history (The black bars are censors. Don't want to show where I live). I can't include my entire January history, but believe me when I say that I never went negative, so there should be no fees. Did I do something wrong, or did TD Bank screw up?
TD Bank allows large transactions to be paid under the guise of overdraft protection. This allows them to collect hundreds of dollars in fees of subsequent smaller transactions. This is in effect theft as there is no recourse to dispute these charges.
TD Bank took over Commerce Bank which had an excpetional approach to customer service, and to no surprise, won the JD Power and Associates Award for exceptional service. It is no surprise that this ranking has dropped for the past years that TD Bank has consistently destroyed Commerce Bank's customer service model. Sneaky fees, delayed availability of funds, and long wait times on the phone. I hope JD Power sends me a survey for these creeps so I can voice my dismay. I'm sure I'm not alone though, so whoever gets the surveys should SLAM these crooks. I paid $210 in fees, mostly on transactions valued between $1 and $5, due to a single overdraft mishap. These practices are foul. We don't expect this, coming from the excellent service provided by Commerce Bank. I am seriously considering switching banks and I hope others will do the same because that's the only way it will really have an impact.
i opened up a bank account with them in jan of this year and ever since they seem to make up new rules and fees.. now im a working mother i have had called them many times to question there methods and all they can say is oh well basically how right is this.. now on more then few ocassions they have robbed pay check because i wasnt well informed i had explained this to them and they say well we cant grant you a fee removal we already wave you one and im like are you serious ..they are nothing but bloody robbing pirates and they needed to be taken down.. i plan on closing my account this week because of there fees i never felt so robbed in my life...and cant believe they get away with this i even called my local newspaper on this .. i wrote them an email and stated when times got bad you guys had the great bail out from the american taxpayers...what about us poor people..
Since TD has taken over for Commerce they have been horrible. Apparently, and deposits made at an ATM take much longer to process then if you wait and go to a teller (not very convenient). Also, we had protection where our debit card would be denied if funds were not available on our business account (I took a lot of time to specifically set this up) but apparently $175 later in fees, it never existed. I will be switching.
After a visit to a branch and a phone call was informed that TD Bank now charges a 5.00 per check cashed fee for all checks cashed whether they be personal checks or payroll checks drawn on their bank if you are not a TD bank customer. I feel this is an unfair practice for them to charge people to cash checks drawn their bank.

So i have been a customer with Commerce/ Total Disaster Bank (TD Bank) for the last 3 years an i figured i would stay after this whole problem with the system, but as today i am offically dumping TD Bank for my banking i have switched over to an account at Wachovia.
After receiving 4 straight months of $200 plus dollars in over draft fees i have fought with them countless time and have got no where all i have been told is to write all my transactions down, when i informed them that i only work part time an make $150 dollars in my paycheck and that i would be unable to pay the overdraft fees they told me that there was nothing they could do because they had credited my account in the past.
I informed them i would be taking my business else where due to their lace of being "America's Most Convenient Bank" their only only response was sorry to see you go. I figured that they would try and keep their customers but from what i went through on the phone i have come to see that they really do not care about their customers.
A little tip don't go to TD Bank unless you have a lot of money to spend.

Here's another pile of crap they are serving, my wife goes in there with a letter from an online payment service, stating that they made a draw on the account in error, instead of useing the funds from the online service, they took the payment from the TD bank account. She goes to the branch with the paper, and they tell her that the payment was already made, so they cannot reverse it. Since then, over $600 has been sacked from the account, however usually when I call the 800 number, they refund it, and here is the best one...
Because the balance went over $100 at any time during the month, they took a $15 service fee, which bounced me again, followed by a $35 overdraft, leaving my account with a -$49.35 balance... I have been told that the next deposits placed into this account will have all negative draws assuming a $35 fee...
They refused to refund the $15 but did refund the $35. so I am still getting hit for another fee or so on the next deposit...
Two things I suggest, don't bother going to the branch, because the so-called "Customer Service Representatives" are powerless, more likely worthless, second, use the 1800 number that used to be the Commerce line, if you ask them to remove the one OD fee that sent the account into abysmal compounding fees, once they correct the original, you usually get hundreds back when all of the other payments all of a sudden are found to then have been sufficiently funded...
Second thing, throw out the Debt card and go to another bank...
Yeah they hit me with the $15 fee for my checking going below $100. This is a monthly recurring fee & the first I've ever heard of it. The rep over phone (800 number) told me that my "trial period" ended because I've had the account for a year. This is BS because my girlfriend has had an account with them for a shorter period of time than me & got hit with the same fee.

TD bank switched my account so that now anytime the balance drops below $100 there is $15 fee charged, which never was the case. They apparently mentioned it in one of those mailers in tiny print on one of the million mailers they send out every month trying to get me to buy some program I don't need. They also said they would put overdraft protection on my wife's account and failed to activate it multiple times, invoking numerous overdraft fees. They are also guilty of the very slimy practice of switching daily transactions to process the largest first, thus making it more likely for you to incur overdraft.
I've had it with them and am switching to Bank of America. It's a royal pain to move so the money and to switch all the checks, but I'm through with TD. Commerce Bank was the best bank I've ever experienced, then TD came along and ruined them. My rent check in September even bounced because the jerks screwed up their computer system and nobody could do any transactions for SEVEN days. Stay away from TD bank, they're horrible.

Don't listen to Tired of Being Stupid she is going to IM you and try to become your friend then tell you she will fix it for you IF you give all your account info to her. She is a con by the name of Becky Purcell a partner with another con Harry Keane. Both will be going to jail soon so they probably will be trying to get as much quick cash as they can. So I owuldn't put it pass them to try to steal money using this scam.

I am having a difficult time with a chargeback issued by Kelley's Music Emporium in Massachusetts. They ordered a guitar neck from my online store, I shipped it, they received it, then they filed a dispute. I responded with all the docs and signed Fedex Proof of Delivery to my merchant bank. I also talked to KME by phone. They told me their mistake and they would call their bank to reverse the chargeback (now the owner denies ever talking to me). Months later, TD Bank ruled in KME's favor and took the money out of my merchant banking account. I contacted KME by phone and emailed several times without reply. When they finally replied they claimed TD Bank never issued them a credit and KME was not going to pay me twice (at least they admit to making the purchase). KME said they would call TDB to clear this up. I am still waiting to hear from them weeks later. I have called TDB on my own with their Debit Card Investigations only to ask if they have issued the credit or not and when. They said they could not do that but I did find out that TDB issues refunds 10 to 60 days after the dispute is filed by their customer. KME's order with us was May of 2009, dispute filed in June, so KME should have received a credit before the end of summer. Without cooperation from KME or TDB I don't know who is telling the truth or is there a clerical error?

excessive fees and vulnerable customers
I had made a purchase from a company online that promised a 30 day trial period before billing one's account. Once I completed the transaction, my account was immediately charged. Upon discovering the immediate charge, I phoned TD BANK'S Customer Service to freeze my account. They failed to timely freeze the account, and as a result, they wound up charging me $380.00 in fees. I went through hell with this bank trying to get some customer protection. I tried dealing with their so called "chairman services center, " with no satisfactory results. It was a waste of time, meanwhile, the fees mounted. I then went to the main branch in my city to see the manager, and was told that I would be well taken care of. I was then given a woman to talk to who informed me that all the fees had been reversed, but she lied. As of this moment, the fees are still there. The site I requested the trial period from was somewhat scamming people with a trial period offer, and they are based in Malaysia, so taking legal action there would be pissing in the wind. The transaction happened through PLIMUS, the online banking thingy. (Similar to paypal). Once I recognized what happened, I called the bank, this company PLIMUS, and tried to call the company from Malaysia, but no one answered.
I find it amazing that the Banks are screwing their own customers, and doing more to protect scammer vendors than they are their own customers.
Something needs to be done, legislatively, to stop banks like TD Bank from screwing their most vulnerable customers, or any customer for that matter. In this case, I am on disability, and almost every cent goes to rent, food, and utilities. I cannot afford this crap, and the typical response I get from them is, "well, don't buy anything online."
I've watched this Bank's processing of deposits and debits, and I've witnessed this bank process their debits before deposits, especially over weekends, I can also prove how more fees are assessed to an account by "their" failure to process transactions for the benefit of their customer. It's robbery if you ask me, legalized robbery!
In this circumstance, I took screen shots of each and every step of the process (the 30 day trial promise) and TD Bank would not listen, or even meaningfully review the documents. I also had my screen recording at the time of this trial purchase, and they didn't even want to see that.
I am very angry over this conduct by TD Bank, and plan to take some serious action immediately.
I believe ANYONE with direct deposit accounts with TD Bank are vulnerable, and could be getting screwed with fees.
I will be lodging complaints with the federal trade commission, the federal reserve, as well as filing suit in the US District Court here in Boston. I will also contact all of my blogger friends to write about this incident, and many others like it, to warn people with direct deposits of these tactics.
Online banking can be extremely dangerous, and as far as the TDBank is concerned, their fees take precedence over their customer's financial stability and security. I had definate proof of being scammed and they were apathetic to that reality. $380.00 in fees can really hurt a guy, especially when he's on disability.
I would NOT recommend TD Bank to anyone in the future, in fact, I would warn against getting involved with them, period! You will be lied to and considered "wrong" for their failures.

TD Bank is quick to process withdrawls & fees & in my case they were slow to accept an electronic deposit.While the other other bank had already withdrew the money a day before TD Bank kept it in pending status & then charged me $35.00 times 4 for $140. They don't seem to care about their customers. Switch to another bank like Citizens Bank when you can. (Free checking with no minimal balance) or a credit union. I vented in a positive way by raising consumer awareness at times when TD Bank was seeking good PR at charity events in on line newspapers or with the opening of a new branch. This bank is highly unethical and their customer service is terrible. They smile and say "have a nice day" as they rip you off any way they can. Then -- if you go to customer service for help -- they give you the run around. The just ripped me off for $450 due to their bad service and inability to inform me properly about the terms of a transaction. In the end, they get my money and they are not apologetic... but "have a nice day!" as we steal your money. I have never experienced anything like this before -- they do steal! Horrible people. I am closing my accounts.
TDBank is robbery! We have struggled since April when they began to impose a 15.00 fee for not keeping enough money in our "simply free" checking acct. SInce then we have had to pay them large fees for bouncing their monthly fee! This bank needs to be closed down! When I make a purchase using my debit card on a Monday this bank will hold this purchase until three days later when it will bounce because I think I have enough money in my account. They also wait until I have large purchases go through so that the smaller ones bounce. Even when I made the smaller purchases several days before the large one. I deposited a government check into my account on a Saturday. On my receipt printed from TD bank, it said my available balance was $269. Therefore, I went and paid a bill, and used my debit card for little transactions. Then I checked my account and I have overdraft fees. That was impossible because I keep my receipts and a spreadsheet for all of my transactions, plus I use online banking. I went to the bank and was told that since it was a Saturday, even tho the receipt said my available balance was $269, the balance was not available until Monday. So all of the transactions I did through out the weekend were all charged a fee.. the total fees charged were $560! First of all, I’m in the “opt out program’..anyway.. I was furious because my account was not overdrawn..and the receipt I have from the bank told me my AVAILABLE balance. So I was told from the bank where I live that they need to call my 'home bank" (where I opened the account, which is 2 hours away from where I live now) because the bank where I live has no say in what goes on in my account. Which i thought was ###..they can take my money..but they cant refund it? So anyway, where I live they said we understand the confusion and your account was not negative, it only became negative because of the charges. They explained this to the manager at my "home bank' and the manager did not want to refund me all of the fees. I was furious because my account was not negative to begin with..i never knew that if the receipt says my available balance..and its a weekend..its not really available until that next Monday. so with all of my fees refunded I would still have 50 bucks in my account.. but instead they refused to refund them all..AND on top of that my bill was returned and not paid..so now I'm going to end up getting a bounced check fee from my bill company! Absolutely ridiculous! I decided to call the 800 number because not being refunded fees i shouldnt have gotten to begin with was unacceptable to me. So as of now, all of the fees have been refunded…this morning I withdrew all of my money and closed my account.
The point of this complaint is, TD Bank is a very manipulative company. They are changing the policy of the previous Commerce Bank Company and not sending those who have had an account with Commerce a policy change. Therefore, they are charging everyone unwarrented fees, and basically robbing tons of people. When someone calls to find out what is going on, they manipulate people into thinking they are wrong and TD is right. BUT this time, they got the wrong person. For those of you inquiring about a lawsuit and are interested in becoming a class member, there is a lawfirm working on putting a class action lawsuit together. Here is what you should do:
1. Keep all receipts for your debit card transactions to support your actual date and time of transaction.
2. Print the daily transactions reports off of the website DAILY, EVERY SINGLE DAY (This REALLY shows how they are re-ordering transactions, if you could see mine you would shake your head! BIG TIME... I got these thieves GOOD).
3. Print the pending transactions as well.
4. When complaining to TD Bank, rather than calling them - email them through the website for documentation and proof.

I do not get a nsf fee at my new bank for using the line of credit. It works like a credit card except it has a better interest rate. It has literally only cost me pennies when I've needed to use it for a small amt & for a short period of time.

I have no complaints now at my new bank. I have a free checking account, that bears interest with no minimum balance requirement. I even have a line of credit of $500 at .0725 interest in case I ever need it. It pays to shop around. I'll never open an account at TD Bank again.

I know people are saying that it is this person's fault, but believe me, I completely understand with the complaint. There are multiple problems here. Once you get an Overdraft Fee deducted then it all snow balls from there and you can never catch up. When Commerce officially transitioned to TD Bank's way of doing business is when all of this terrible stuff started happening. This has been non-stop with my fiance. He has an incredible amount of child support to pay every week and cannot afford to have his banking account messed up all of the time. He did not sign up for this service, TD Bank took it upon themselves to automatically enlist the Commerce customers into this program. I think it is a VERY low and sneaky way of doing business. Starting as a Commerce customer for many years and now dealing with TD Bank - I have never dealt with a bank so terrible. I feel like they are a scam to their customers and very far from America's most convenient bank.
Their system is terribly slow in updating your account - so you would think that everything is ok with your account, but it's not because it takes a while for transactions to post. Meanwhile, you have 6 NSF charges and your next weeks paycheck doesn't bring you into the positive and you can't eat, pay bills, etc when this is on going. The longer it takes TD Bank to help you, the longer it takes to correct yourself and you live without money. AND, to top it all off... the NSF fees come out at very random and sporadic times. So I could make 5 purchases for $3 and 5 days later get $175, SO you think you think everything is OK and then they hit you and it MESSES EVERYTHING UP OK.
I work for chase bank. The first rule in life is you have to understand how the bank works or you will end up working for the bank and not the other way around. The banks can not always see what is not there. I admit it is not fair but pay more attention to what you know you have. The total fees could not be 560 That is against the law. They are only able to charge a max of 35 for each items and 6 items a day. So that only 210. So enough with the exaggeration. If you have 200 dollars on friday opening business day and you bought a few items say : 75 dollar coat, 50 dollar belt and 75 dollar TV that is all of your $200 but what if the TV did not post? So you wake up saturday check your balance and its telling you you have $75 left. You are so stupid you go buy 7 $10 items and one $5 which comes out to $75 and all of those post. So you think you did a good job and you didnt overdraft. Monday roles around now you have a MAX of 6 OD fees which is 210 dollars... But you are wondering what if he bought the 7 $10 dollars items and the one $5 dollar items friday and bought the tv saturday wouldnt he have just one OD fee? We all could live with that right? WRONG The bank pays highest to lowest for that reason. We say its because say if you had your mortage come out but you bought some shoes we didnt want to return your mortage and pay for your shoes... but we all know its a bunch of crap. So it would come in like this :$ 75 coat, $75 TV, $50 belt, $10NSF $10NSF $10NSF and ECT... So take it as a hard lessen learned and keep it wrote down or dont use the debit card at all. PERIOD.

They have taken $2017 + from me by charging overdraft fees on FUNDS ALREADY DEDUCTED from my account ! My name is Frabrizzo Agnello and i have recently been involved with bank fraud via and ATM machine. I have been victimized twice in the past 30 days first on May 7th 2017 in the amount of $141.75 and the second time was May 29th 2017 in the amount of $121.50. I never used those ATM machines nor ever made those withdrawls. I have filed a police report and have talked to the managers at TD BANK. They are refusing to return my funds claiming that they have no proof it was someone doing this to me being there are no cameras on the ATM machines that were used. Tired of Stupid is a fool. With today's technology the bank should be able to deny any transactions if there isn't enough in your account. Just flag it as "insufficient funds" and have the transaction denied. Commerce Bank was able to do this without fail more than 10 years ago.
It's clear that TD just doesn't want to make this option available so that they can quadruple their fees.
But it's wrong to push customers used to the old convenient Commerce Bank way of life (no need to balance account, transactions denied if no funds, up-to-the minute online banking to get accurate balances, and absolutely no fees) into a new environment where they're forced into Overdraft Protection schemes and transactions take a week to post. That's just wrong and shady.
At the same time, they proudly show off the JD Power awards that Commerce won for them, yet proceed to do the opposite of what Commerce did to gain those awards.

I fully admit that I made a mistake with my bank account. I did not receive my banking statement from TD in September or October and completely forgot to go to a branch and request one. That said, I used my debit card for a purchase which caused an overdraft. However, I was not notified by TD Bank for over a month about the overdraft and although I continued to use the debit card with no problem, each purchase caused another overdraft along with high fee. When I finally received the notice from TD, I immediately went to a local branch to speak with a representative. I was told that she would "Attempt to get the overdraft fees either waived or reduced". I then deposited enough money into the account to cover any other purchases made prior to my knowledge of the original overdraft & to cover half of the overdraft fees. I was told the representative would call me the next day with an answer. No call the next day. Two days later I called, was told she was with a customer and would I hold. I replied I would. I was on hold for 20 minutes and finally another rep got on the phone and told me the rep had left for the day. I called again the next day and was told she was out to lunch and would call me on her return. Again, no call from the rep. We are now up to the fifth day of this nonsense, I call, am told that the rep is out until after 'the new year', which was 9 days from my call. I then drove back to the branch and spoke with the manager who told me he would attempt with 'Regional' to get some of the fees waived and he would phone me the next day. No call came in the next day, however; he called the 2nd day and told me that the request was denied. He also told me "TD Bank only waives fees if it is their fault". I feel it is their fault, had they notified me immediately of the problem, I could have stopped it. Instead, when they withdrew the original overdraft fee (outrageous amount), it then created a domino effect causing each use afterwards to be an 'overdraft'. If TD had sent out the statements in September and October, none of this would have happened. They were in the midst of their 'change-over' from Commerce and royally messed up not just my account, but thousands others. Why will they not take responsibility? I am willing to pay 1/2 the fees, but not the full amount of over $500 (for four overdrafts!) plus a $20 fee for low funds in the account, whatever that means. I had overdraft coverage with Commerce, why was it not carried over when TD took over? I now understand why so many have left TD since their takeover. I am leaving them also and I will not pay any monies towards the overdrafts because of their non-cooperation and rudeness. I have CD's in their bank along with a trust fund that deposits bi-yearly. I will withdrawl my CD's (taking a penalty if necessary) and stop the auto-deposit of trust fund and will take my money and business to another bank. Beward of TD, they are not customer oriented and it is disgusting that the taxpayers have bailed out all these banks and the result is they do not care about their customers.

If a debit card is supposed to be used like a credit card, then like a credit card the user should be notified when they have reached the limit! TD Bank is taking advantage of customers who grew to trust Commerce Bank and they're profiting big time. My daughter, with a STUDENT ACCOUNT has just learned the hard way by losing $510 to them! Vernon Hill, who was responsible for building Commerce Bank is now involved in starting a new bank called Metro Bank. It is being formed from the merger of Pennsylvania Commerce Bancorp and Republic First Bank. I'm closing out our TD Bank accounts and going to Republic First. They don't have as many branches right now, but I'm sure they soon will.

I went to the teller and asked her to pull my account via my bank card and requested couple hundred bucks from my account. She nodded then replied "Sir you dont have money in the account". I told her it cannot be, I viewed my account online earlier and I have plenty of funds. After arguing with me for 10 minutes, she was like "ouch, your bank card pulls 2 accounts up on my computer, one account is yours and other belongs to a different client who have the same name!
I did not panic or anything, just asked her to fix it. She said I have to speak to a rep at the branch... After explaining the issue to the rep, she said "well, everything looks fine with your card, i dont know why it pulls up 2 accounts.. next time if you want to take money out of your account, write down your account number, not let the teller pull it by your card! Since the representative is obviously ###ed, i decided to call customer service and explain the issue as I became concerned that the other customer (with similar name) can take money off his account (if he were to have enough money in his account, the teller would have given me his money !)
So i called customer service and explained the issue, hoping they take corrective action. The call center person said after i explained the matter in details " Sir, until now, i dont understand what the issue is?!, what do you want me to do ... you told them at the branch, that is about it... if they can do something they will do it... is there anything else I can help you with... ""
I have never been angry at any organization before, but as much as i loved commerce bank, I totally hate TD... and I hope they burn in hell.

TD Bank's check posting policies are paramount to fraud.
I check my account online regularly, and when I don't check it online, I call the banking line to check my account balance. I had paper checks outstanding I knew were going to post to my account. On 5/5 the check still hadn't posted, so I went out and picked up a couple of things, knowing there'd be more money in my account on 5/6. At 12:01AM 5/6 the check outstanding still hadn't posted to my account. On 5/6 when I got up in the morning, the check posted to my account, but my bank statement claims it posted on 5/5, even though it wasn't there the previous night and even after midnight this next morning. So TD Bank not only posts the check to my account, and they paid it, but they charged me overdraft fees, not for the check, but for the two transactions I made the previous day that did not bounce the account, because those transactions were still pending, but when I made those transactions, I had plenty of money in the bank.
Now, another issue I have with them is this. I make purchases for oil, and it shows up on pending transactions. We use oil heat, and it's expensive. So I have $400 pending when I buy the oil. The next day, the pending transaction is gone, it hasn't posted to my account, it's just gone, and the money is back in the account like it never happened. 3-5 days later, the account actually goes through. That issue has never actually bounced my account, but what's the excuse for disappearing pending transactions?
I hope that sometime in the near future the banking regulations change specifically with this bank in mind. In the meantime, I will have to choose between Wachovia, Bank of America, Lakeland Bank, or Chase.
I just opened an account with TD. I deposited $250 cash via the ATM on 12/1. My receipt says $101 of that is available...ok fine. I then go out to get dinner and used my debit card. I got home and checked my account to see I was in the negative and the deposit I had just made didn't show up. I called and asked WHERE my deposit was and that I was in the negative when I shouldn't have been. Rep said he could see the deposit was made but there was nothing available to use due to the 'new account hold'. I asked well why is that not reflected on my receipt? He gave me some gibberish and I was telling him if I had used my debit card and been humiliated bc my card was rejected I would have closed the account and gone right back to Chase. Funny how fast that $100 became available. As of this AM 12/2 I now see the $250, of which $150 is pending. MESSED UP!
While I agree with Tired of stupid I just had the same problem with this bank and yes I am very diligent with my record keeping and I never overdraft. I went to a movie and purchased some refreshments then the next evening my mother bought the wrong food for my dog, he is allergic to corn and certain kinds of nuts. I called her and she said if I fixed the problem she would pay me back only after I explained the situation to her, when I got home she went back on our deal. I scrounged up the five dollars which I deposited the next day to cover the transaction. They kept my deposit pending until the next day intentionally (cash is cash and should appear immediately nothing needs to clear) so when the other pending transactions came through it would overdraft my account. The problem is 2 of the 3 purchases were from the same vendor and they should have posted them chronologically by date or by vendor they place the one that was from Sunday night first, then Monday night and last the final Sunday night purchase. There are two larger issues here, first what they are doing is unethical and I have seen many businesses be shut down for such practices, second unethical and all what they are doing is also illegal and could be classified as borderline extortion, see definition.
In the United States, extortion may also be committed as a federal crime across a computer system, phone, by mail or in using any instrument of "interstate commerce." Extortion requires that the individual sent the message "willingly" and "knowingly" as elements of the crime. The message only has to be sent (but does not have to reach the intended recipient) to commit the crime of extortion.
Basically they are willingly and knowingly doing this but will not admit the offense because if they do it would incriminate them for said crime. In my case the message was not only sent but received via the online banking.
Remember, almost all of the banks in this country are a member of FDIC who's job at the moment is to insure and protect 250, 000 dollars of a person's money and it is my understanding that any bank who has entered into an agreement with the FDIC has therefore agreed to protect peoples money. While some fees are fair and necessary there are limits and should not be allowed to con us hard working blue collar citizens out of their money.
It would be absolutely fantastic if someone out there would do the right thing and create a bank that was honest and fair. There are ways to make money without deceit.

It's amazing that TD Banks policy is to post the largest amounts to your account first. The reason they do this is so when your deposit brings your account into the POSITIVE they can take out that large chunk of OVERDRAFT FEEs and put you back in the negative and then charge you for the six withdraws after that (which average 3-6 dollars). It's a total scam that lets them make money on a $2 cup of coffee. In 2 days I deposited $750 out of which they took $385 for overdraft fees... and they wonder why people can't make it today!
Why don't they charge a % of what they cover for you instead of a flat fee? Why because they'd make no money that way... The customer service rep I spoke with assured me that the BANK is not making any money with overdfaft fees.. HAHA What a laugher... I told her that I knew she worked at the bank so she had to be "PRO-BANK" I beleive that there is a special place that BANK big wigs will go to EVENTUALLY.
