I accept that from now on I should read the “terms & conditions” a lot more closely, but I just couldn’t conceive of a company offering a trial that starts the day you place the order. Well that’s exactly what this fraudulent crook of a company decided to do and I get some third world inept operator taking my call that tried her hardest to up-sell me on another month of a product I didn’t even want one month of.

So I tell her that I received the acai product on Monday it was now Wednesday and I’m wondering why they charged me $89 after 3 days, she replies no it is charged 10 days from the time you place the order, you failed to call us back in time. I exploded! What sense does that make to start my trial of something before I receive it? I didn’t get to TRY it! She say’s oh well since you’ve already paid for it now why don’t you try it for the rest of the month. This crap went on for way too long and finally when I was frustrated to the verge of tears did she give me the cancellation instructions.

Can you believe after the 10 times I said I didn’t want it had I hung up too soon I would have still been in the system to get hit again next month! Scam artists! I am pissed and still out of money. And the cancellation process is so detailed and ridiculous, and they cover their criminal butts by putting this stupid info in the terms they know people rarely read through completely. Uuuggghh!

I was on the Racheal Ray web site and there was a promotion for Acai Berry (a weight loss supplement). Racheal Ray, CBS, Fox News and some others had positive comments on the product. I thought I would give it a try. A one week free sample would be sent to me for only $3.95 shipping & handling charge. I received my bank statement and had surprising charges on my account. I was charged the $3.95 from the Diet offer store, $29.95 from Fit factory and $89.31 from the Diet offer store. I looked up each of the Business on-line and found a contact number. I was able to get a credit from Fit Factory who told me they got my information from Acai Berry (AKA - Diet offer store). I called Acai Berry and told them of the charges they told me that I would be receiving the product in a week and I do not receive it then I should call back to receive my refund. I originally called in the middle of November of 2008. It is now March 6, 2009 I have not received the product and they refuse to give me my money back. I have talked to Joseph, Barbie, Chris (Jr. Manager) and some lady named Princess? They all have given me a different story about my account. If you look up the Acai Berry web site it clearly states 100% guarantee satisfaction. I don't have any satisfaction dealing with this company. I have opened a claim with my States Attorney General and I don't think they are having any luck with them.

Please do your research about a business before doing business with them on line. They may just be fraudulent as Acai Berry.

I ordered Acai Berry pills from a site and cancelled it before the end of the 30 days. I was charged the full amount. That wasn't so bad. Associated with that charge was a charge from Self Help that I did not authorize. I called my banks fraud department and they removed the charge but it was there again this month. There is a phone number on the charge that you have to call to get them to stop some alleged program you signed up for. Call it and get them to take you off their list. These sites are illegally charging your charge cards. Keep an eye on them.

It is possible that you ordered through thier direct website and therefore were able to read the accurate terms and conditions. However, the advertisng links through the testimonial blogs (i.e. as seen on Rachel Rae, Oprah, etc.) do not specify those terms and conditions. Additionally, when you click on the "refund and return" link, you are provided with a number that is not in service. Tell me, if this company was reputable, why would there be SO MANY complaints? Why would there be more than one website? Why would a website copyrighted as recent as 2008 provide a non-working number? Why once you "do" cancel your order do you continually get billed as I have been? Why will they not allow you to speak with a Manager or Supervisor? Why do they refuse to send you something in writing or by e-mail confirming your cancellation?

I am sure that if I "wanted" this product and continued to buy from them - they would be as "nice" to me as they are to you.

I being a sucker and not doing any research went ahead & placed an order for the free trial of ACAI BERRY DETOX (F.W.M LABORATORY). [protected] is the # listed to call customer service. I have been trying to call that # for 4 days, all i get is a busy tone. Which made me feel uncomfortable & wondered what I got myself into. (idiot) I called the bank to see if the charges went through and FWM charged me twice. one charge of $2.02 & $1.97 whiched totaled to $3.99. My bank debit has a # listed which is [protected]. You can actually speak to a LIVE rep if you push option# 3. The rep cancelled my order, said I will not get charged in the future and that my trial bottle is for me to keep. The web site stated that I had to return the bottle in 14 days not to incur future charges. The rep insured me that I will not be charged for my trial, it is compliments of FWM. Ill see how that goes in a few week. GOOD LUCK!

Alternate # to speak to a live rep. : [protected] option #3

I have been trying for days via email and phone and have never recieved a response. I ordered this product because I heard it worked however I did more investigating and found it to be a scam. I have tried several times to stop it from happening. So far I have been billed $5.95 and not recieved anything. Does anyone know HOW to reach these people?
I do not want to be a statistic!

I took the trial product that says I only had to pay for the s/h, I received the product and it did absolutely nothing but make me constipated, the opposite of what it was suppose to do. I looked on my bank account today and saw that they had charged me full price of $87.13. I called my bank immediately.

I called the company and spoke to Brian who explained to me that if I didn't call and cancel in 14 days I would be charged full price. I asked him where was that stated and he said in the "Terms and Conditions". Well who reads those things. He cancelled my account. I guess I better pay more attention to things I order off the internet.

My bank is helping me dispute the charge. This is truly a scam.

I started my free trial in December 2008. I was immediately charged with no idea it was going to be 90.00. I thought if it worked I would try it. I used it for almost 2 months. I noticed I was gaining weight, not losing it at all. I quit taking the pills and then had problems with my digestive system. I then begin making the phone calls to try to stop the shipments and charges. I finally decided i would cancel my credit card, or have my company help me. I called them and advised them of the problem. They were somehow able to call the company and get through and stop it.

I started looking at my statement and also noticed each billing it was at times, different names on the register for the bill. I am not being charged any more at this time but I would say I spent around $400.00 to try to lose weight naturally, yet I gained weight, spent money for it, and had stomach issues for a few days. I even had to miss work it was so bad.

I order the free sample which I never received.
Called to cancel further orders of product and request refund of shipping cost. The foreign speaking customer service rep
would not credit my credit card with shipping costs and I'm holding my breath that no more charges will appear.
Very bad experience. Wish I had read the complaints before I ordered. Dumb, I guess, but now I've learned. Please warn others!

At least I don't feel so stupid anymore now that I know I am not the only one ! I cancled almost immediately, the same day i ordered the acaiberry, the more i read the more I felt I DID NOT want this product, ( only 20 pounds to loose )when the 1st package came I sent it right back unopened, e-mailed them again and cancelled for the 2nd time, I didn't know I had already been charged before i sent it back, then the 2nd package arrived I called them and was given a ## to put on the package, I did this and returned that one also, UNOPENED then ALL the charges started appearing !$$3.95 on 2/5, $ 2.00 on 2/5, then another$, 87.13 on2/8 and$ 2.61, also on 2/8 then all of these on the same day !.6 cents on3/5, $2.00 on3/5, $2.50 on 3/5, $83.18 on3/5 and .6 cents, and one more for$1.95 ! they keep insisting they are out of florida but they ARE NOT, or there would NOT be international fees.. I have now gotten an e-mail confirming my cancellation but that has a date of 3/4 on it as my cancellation date, but I CANCELLED way before then, now they say I will NOT gat a refund for the 1st FREE BOTTLE, I'm hoping they will do what they say and refund the $83.18 for the 2nd bottle, this company is a total RIP OFF I have O of there product, I followed there rules and they have my $$$, I look at all these complaints and it makes me sad that as women WE are so unhappy with our size that we think this SNAKE oil is the answer, I think I will keep my 20 extra pounds and start taking some long walks ! good luck to all of you and GOD bless

I signed up for a free trial, and tried to call and cancel prior to the end of the free trial. However, I could never get an answer. About a week later, I received three bottles in the mail and my card was charged almost $200.00. Because I could never get in touch with anyone at the company, I worked with the bank to cancel that card and get a new charge card number. You may have to take the same drastic step in order to avoid being continuously charged for something you don't want.

I am believing that we will soon hear of a class action suit against these companies because this is fraud.

I signed up for a Free sample only for $4.99 shipping. Did receive the product, but was also charged $79.96 for a monthly membership which I did not join or know anything about! When calling the phone # there was a message saying to leave name, address, phone # and they would call me back. Never heard from them and cannot find them thru the address above which was on my credit card bill. With money as tight as it is, this is just a sign of what our country is becoming...rip off anyone you can ! Thank-you for letting me vent.

I cancelled Acai Burn on 2/23/09- a second order was shipped on 2/22/09 which I refused at the Post office. I had my credit card dispute it, (received notice that this has been resolved but not until March 26.
Another charge appeared on 3/06, 3/08/3/17, 3/18. These charges were for Transaction fee $1.00 from CYPRUS! The other CYPRUS charges were for WEB ACCESS $4.95, and MEMBERSHIP $9.98, and FOREIGN TRANSATION FEE*FINANCE CHARGE $2.28. When I called the [protected] MWMBERSHIP NUMBER and an entirely different operation, and was only now able to cancel that. Also another operation, The WEB ACCESS [protected] number was answered by a computer dialog, then went to Static! This then ment I was unable to cancel that part of this operation. Therefore, I called my credit card company and have cancelled my account to prevent any further charges to that number.

You have to file fraudulent charges with your credit card company to get your money back. It's your money!

THIS INFORMATION IS POSTED ON THIS WEBSITE:

The U.S. Food and Drug Administration is expanding, for the second time, its nationwide alert to consumers about tainted weight loss products containing undeclared, active pharmaceutical ingredients.

The FDA has identified additional weight loss products (Herbal Xenicol, Slimbionic, and Xsvelten) and new undeclared active pharmaceutical ingredients (fenproporex, fluoxetine, furosemide, and cetilistat).

"These tainted weight loss products pose a great risk to public health because they contain undeclared ingredients and, in some cases, contain prescription drugs in amounts that greatly exceed maximum recommended dosages, " said Janet Woodcock, M.D., director of the FDA's Center for Drug Evaluation and Research. "Consumers have no way of knowing that these products contain dangerous drugs that could cause serious consequences to their health."

On Dec. 22, 2008, the FDA warned consumers not to purchase or consume 28 different products marketed for weight loss. On Jan. 8, 2009, the FDA expanded the list of tainted weight loss products to include 41 additional tainted products. The FDA will continue to update this list as warranted.

The products listed above, some of which are marketed as dietary supplements, are promoted and sold on various Web sites and in some retail stores and beauty salons. Some of the products claim to be "natural" or to contain only "herbal" ingredients, but actually contain potentially harmful ingredients not listed on the products' labels or in promotional advertisements. These products have not been approved by the FDA, are illegal, and include the following undeclared active pharmaceutical ingredients:

fenproporex – a controlled substance not approved for marketing in the United States;
fluoxetine – an antidepressant available by prescription only;
bumetanide – a potent diuretic available by prescription only;
furosemide – a potent diuretic available by prescription only;
rimonabant – a drug not approved for marketing in the United States;
cetilistat – an experimental obesity drug not approved for marketing in the United States;
phenytoin – an anti-seizure medication available by prescription only; and
phenolphthalein – a solution used in chemical experiments and a suspected cancer-causing agent that is not approved for marketing in the United States.
The FDA has inspected a number of companies associated with the sale of these illegal products and is currently seeking product recalls. Based on the FDA's inspections and the companies' inadequate responses to recall requests, the FDA may take additional enforcement steps, such as issuing warning letters or initiating seizures, injunctions, or criminal charges.

The FDA advises consumers who have used any products containing these ingredients to stop taking them and consult their health care professional immediately. The FDA also encourages consumers to seek guidance from a health care professional before purchasing weight loss products.

The health risks posed by these products can be very serious and include high blood pressure, seizures, tachycardia (rapid heartbeat), palpitations, heart attack, and stroke. Sibutramine, a controlled substance, was found in many of these products at levels much higher than the maximum daily dosage for Meridia, the only FDA-approved drug product containing sibutramine. These higher levels of sibutramine can increase the incidence and severity of these health risks. Fenproporex, another controlled substance, can cause arrhythmia and possible sudden death.

Health care professionals and consumers should report serious adverse events (side effects) or product quality problems to the FDA's MedWatch Adverse Event Reporting program either online, by regular mail, fax or phone.

Online: www.fda.gov/MedWatch/report.htm
Regular Mail: use postage-paid FDA form 3500 available at: www.fda.gov/MedWatch/getforms.htm and mail to MedWatch, 5600 Fishers Lane, Rockville, MD [protected]
Fax: 800- FDA-0178
Phone: 800- FDA-1088

Originally ordered product in November 2008. I did receive product and then was billed full price. There was NO free sample as advertised (false advertising). I called to cancel and was told I had 10 days from date of order to cancel. I asked how I was supposed to cancel an order I had not even rec'd. or tried product. They agreed to refund my acct. (I returned unused portion of bottle). My acct. never credited. I did finally get an e-mail from address kmccracken@fxsupplements.com. "Kara" said she would be more than happy to assist me any way she could once I sent my original order number and zip code where shipped (it seems my order was not in their system - imagine that). When I tried to reply my e-mail was returned saying it had been rejected by the recipient domain. Evidently there was no mailbox by that name at this company.

I have sent other e-mails to this company and am repeatedly told I will receive a response within 72 hours. I have yet to ever hear from them again. Is someone in jail over this yet or has this become the American norm now? I will be trying once again to contact the company by phone as well as filing with the BBB and Attorney Gen'l. I simply want my money back.

It's ironic that we are expected to use the internet and technology for more and more of our dealings in life and yet I find as we swim deeper and deeper into this cesspool we are swallowed up in more and more corruption. What ever happened to the integrity that used to be so prevalent in America.

I ordered Acai trial order for 1.99. Then they also charged my card 39.95. 3 weeks later they charged another 44.90. When I called to complain, the girl (Rita) was as rude as hell and ended up hanging up on me because she said I was bashing the company by saying it was a rip off and I didn't agree to it. I also called in January to cancel but didn't get the name of who I talked to or the confirmation number and she pretty much called me a liar.

This is nothing but a HUGE scam.
