First Premier Bank withdrew money from my account with authorization and did not post it to my account. It has been 8 days now and counting. First they told me it was some sort of security hold, I asked to speak to the security people and was told. "they don't have a phone in security", Then I was told by another person that they have the right to withdraw funds my checking account and hold them for up to 20 days.

My attorney see's things a bit different. We believe that First Premier holds funds in order to 1, collect interest past the grace period, 2, may not have the capability to process more than one payment per month. In either case it is wrong.

We are seeking others who have had similar experiences to join me in a class action lawsuit against First Premier Bank. Contact me at email if you have had similar experiences with these guys.

Thank you,
Richard.

I am having the same experience, which is what lead me to search for others.

I sent a inquiry about why my payment shows posted, but my available balance does not reflect it... they gave me the 20-day spiel.

So I sent another inquiry asking how can they do that and as a new customer at this point I am very dis-satisfied with their service. Their reply... we'll make a note of this in your account. What jerks!

I having a big problem with Premier Visa, first of all i am disable and my credit got bad I decide to open a account with premier to try to build my account back up, i do my bills online they charge 7 dollars to do a online check they charge 4 dollars to set your account up online. they said if you pay your bill on time they would give you a credit increase I pay my bill every month on time and they want give me a raise and on top of that they billed me an anual increase which made my account be over limit. They got the nerve to send me another credit to open for a master card i threw it in to Garbage can (they sent it to me 3 times) but they want give me a credit increase. Im thinking about filing fraud on them

Hi everybody. I would like to inform you that this is the case of many here in PR province as well. Hopefully, we are making every possible effort to post a claim under the FICO (Financial Institutions Commission) which is a Federal Agency that regulates those institutions. If anybody could do anything, it is the FICO and I hope they get punished for playing around with our emotions (because of the headaches) and our wallets (because of the fees).

I agree. This is thee worst credit card ever. If you want to rebuild your credit, this is not the card to apply for. It took up to 21 days to post my initial payment --making my funds unavailable to me. For one payment, the availability date of funds changed twice. At another time, I was told by a rep. that it was okay to just pay the min amount due. Because I was close to my limit, I later got a call from them saying that I was over the limit, because there was a $7. charge for making the payment by phone which was taken from the available funds on the card, and not from my current payment. PLEASE THINK LONG AND HARD BEFORE YOU RUIN YOUR CREDIT EVEN FURTHER.

Jesus these guys are a total ripoff. I didn't even need another card, but I got this one because I thought I needed to chalk up some more good marks on my credit before buying a house. Well, just like the above posts note, the card came in the mail, but with a note saying the contract had changed. There was about $50 of "credit" left when I opened the envelope! I started to set up an online payment situation, but something about their website made me a little skittish. I don't know, something about how the whole site was one great big jpeg image with links mapped in the image itself. I got as far as putting in my credit card number, but never actually entered my bank information. The statement came and I was billed $3.95 for an "internet access fee." WTF?!?!?! Are you kidding me? I bought one $50 item with this card two months ago and somehow I have a balance of $222.00. Huh? Yes, really. Oh my God, I just want out. I'm afraid if I just pay down the whole bill, they'll charge me another "fee," or if I call them they'll "fee" me for that too. Jesus these guys are scammers and I bought it big time!

Yes

I ended closing the account with a settlement. This is for the same reason that everyone else has mentioned here. I hate this credit card company. Once I settle the account and once the account was closed since 2006, today is still the day that they are reporting negative information on my credit report such as Key Derogatory** For the month of Feb and Oct of 2007.

**Key Derogatory = Claim, Term Default, Government Claim, Paid by Dealer, Bankruptcy Chapter 7, 11 or 12 Petitioned, or Discharged and Bankruptcy Chapter 7, 11, or 12 Reaffirmation of Debt Rescinded.

I don’t know much about credit but I know enough to say that if my account was close as of March 2006, this company should not be feeding any type of information towards my credit report.

I contacted all 3 credit bureaus to see if I can provide proof of settlement just so they can have it in their records in the event that First Premier decides to post it again and no lock. They won’t accept it.

So what am I supposed to do? Is a back and forth with them. Once this negative info is removed then in the next couple of months is back. This is really frustrating.

I am completely disgusted with First Premier. They make it impossible to make a payment on time. Somehow my password for online accounting keeps getting changed and my account gets locked. I've tried to call to make a payment and either can't get thru or I get disconnected. They do this on purpose because they know every person in the free world is too damn busy to deal with it. They make it impossible to pay them so they can add more and more fees and then do worse to your credit. It should be illegal and they should be prosecuted. Did you notice on all of their websites there is no way to contact them? How convenient! They should be ashamed!

If anyone knows of a class action case against FIRST PREMIER BANK, please email me at SEND2YUSUF@GMAIL.COM. I am in total frustration with no resolution with this credit card company. I believe this is definitely a form of PREDITOR LEADING. They go after high risk individuals trying to get credit. They then take a bite out of you with the ridiculous initial fees and continue to slowly eat you alive with the outragous fees and overall (I feel) illegal practices. I would like to join with anyone who is trying to have this company stopped!

Hey guys as we all know, we have been a victim of First Premier Bank.

The state of New York took action against First Premier Bank

Please read

First Premier Bank Settles Probe of Credit Card Marketing
Posted on Wednesday, 15 of August , 2007 at 6:22 pm
NEW YORK—The First Premier Bank has reached an agreement with the state Attorney General’s office to resolve an investigation into the company’s illegal and deceptive marketing of subprime credit cards to thousands of consumers statewide with poor or no credit.

Under the terms of the settlement, First Premier, based in South Dakota, will pay $4.5 million in refunds and $105,000 in penalties and costs. The company will also reform its illegal billing and deceptive marketing tactics.

“Subprime lenders like First Premier are luring financially vulnerable borrowers into unaffordable high-cost cards trapping individuals and families in a cycle of mounting debt,” said Attorney General Cuomo. “This agreement ends First Premier’s abusive and unfair credit card practices, sets a new standard, and provides new protections to borrowers across New York State.”

Subprime credit cards like subprime mortgage loans are typically marketed to “high risk” consumers with poor or damaged credit ratings and with limited potential for repayment. Many opt for these cards to establish a credit rating or gain access to basic financial or consumer services. Instead, borrowers find themselves mired in credit card debt due to snowballing hidden fees, high interest rates, and very low credit limits.

“First Premier turned out to be an irresponsible lender,” said Mel Nielsen, a 63-year-old Saratoga Springs resident, told the Attorney General’s Office. “I was looking for an opportunity to move up, instead the company knocked me down with a debt trap and a false credit report.”

Nielsen says he was trying to build back up a weak credit rating when he received First Premier’s solicitations by mail claiming he was “pre-approved” for up to $2000 credit limit and two Platinum Visa cards. Nielsen applied for the cards, received a $250 credit line, and even before using the cards once, First Premier billed him upfront fees, leaving him with less than a $70 credit. Nielsen says he canceled the cards almost immediately. But, First Premier, he continued, imposed finance charges and his balance ballooned to $1,000 within a few months.

Nielsen says he made several unsuccessful attempts to resolve the matter with First Premier. But, when he started receiving harassing calls from a collections agency and discovered that First Premier had reported his “false debt” to the credit agencies, Nielsen called the Attorney General’s Office and filed a complaint.

The Attorney General’s investigation, sparked by complaints filed by New Yorkers across the state, revealed that First Premier Bank lured consumers by falsely representing they were pre-approved for a credit limit up to $2,000, at “9.9% APR Fixed,” and promising “no processing fee” for opening an account. The bank also solicited consumers directly, marketing subprime credit cards as gold or platinum cards, repeatedly touting their prestige and member status without disclosing the associated risks.

In reality, most consumers received a $250 to $300 credit line at a 9.9% interest rate that could more than double without notice. Even before consumers had a chance to activate or use their credit card, First Premier billed $178 upfront fees for processing the credit card application. As a result, consumers’ found themselves with $70 - $120 in available credit, perilously close to the credit limit, and strapped with bills most believed they were obligated to pay. Additionally, most consumers reported their balance ballooned within a few months, sometimes from $20 to $400 as a result of hidden fees.

The Attorney General’s investigation found that in addition to the $178 upfront “processing fee,” First Premier charged account set-up and participation fees, annual fees, late fees, overlimit fees, credit limit increase fees as well as fees for paying online, accessing an account or additional card fees.

Under the terms of the settlement, First Premier is prohibited from charging consumers until they activate or use their credit card to make purchases or obtain cash advances. The bank is barred from fraudulently advertising or soliciting consumers in the subprime market and must refrain from marketing subprime cards as “Gold” or “Platinum” cards unless it clearly and prominently discloses associated features and risks. First Premier is also banned from promoting credit cards as having “no processing fees,” if it charges consumers for applying or activating a credit card.

First Premier had discontinued the practices of misrepresenting the fees and credit limits associated with the credit card prior to this settlement. The bank cooperated fully throughout the investigation and worked with the Attorney General to resolve the matter.

Individuals who believe they might be eligible for a refund must file a complaint with the Attorney General within 90 days by calling the Attorney General’s Help Line at [protected] (Option 3). To obtain a copy of the settlement agreement, visit www.oag.state.ny.us 8-15-07

I do not even remember signing up for this credit card. Then I get a card in the mail for myself and for my husband with all of these initial fees that I never would have signed up for! I am more than willing to join into a class action suit! I can't believe what a ripoff this credit card company is! I can be reached at my email address: peacefulady@gmail.com

These people do not have any idea what customer service means, they are rude, and just short of EVIL! I made an honest mistake when putting in my checking account number when making a payment, which was on time and over the minimum payment due... I was ONE number off, this honest mistake ended up accrueing almost $100.00 in fees, fees which my bank didn't even charge me for, which was one of the reasons why I didn't even know there was a problem to begin with. No one bothered to contact me and because of this I was immediately sent to their "in-house" collections, all the while I am thinking everything is fine because I made my payment on time and for more than what was the required amount. Until one day I get a call at work from a collections representative telling me I now have to pay $100.00 MORE than what I had originally made the payment for because of a returned check? I was shocked. These people refused to omit these charges, they could have as a one time courtesy, they would not have lost anything by showing their customer a little appreciation and empathy, instead they were rude and tried to act tough by talking loudly over me and refusing to let me speak to someone higher up to plead my case to, I was even hung up on... AWFUL, just AWFUL! I have no recourse and that makes me sick, I have no choice but to pay these nazi's in order to protect my credit so that I can one day buy a house with my soon to be new husband, I feel violated!

I am in the middle of trying to pay for a wedding and this has caused even more stress for me, I have done the best I could in repairing my damaged credit which was why I got myself this credit card to begin with... I am sick over the whole thing an honest mistake just cost me over $100.00, beware people, dot your i's and cross your t's because they will get you! I understand why people go "postal" now, because when you feel like you have no other option but to give in to them you feel very angry and helpless!

My husband signed up for a card. He had never had credit and it seemed like the way to go. We received the first statement and made the first payment toward the "fees" online with a information. Then we didn't receive the next months statement. They called my husband while he was working asking him to verify his bank account number, etc. He told them that he couldn't talk right now and to call back later. They went ahead and put the entire balance on the card thru the bank. When I called that night to find out why they had called him, I got agravated and told them to tell me what we owed and we'd cancel the card. The rep came back and stated that a payment had been made at 11:27 AM today. Luckily, I thought ahead and got the confirmation number and the name of the employee that took the payment. I think stated we wanted to cancel the card. The rep made me hold on the line and since we had never used the card, offered to refund the entire amount of fees and everything to us in 60-90 days. After I laughed that this was ridiculous, she stated that was her policy. But again, I asked if there was a confirmation number of the cancellation and her name. I have all of this and am email the vp of risk management agraff@firstpremier.com to explain to him why he has such a horrible company.

I need some serious help against 1st Premier Bank, too, and if you can get together this class action lawsuit, count me in. I activated a card, the card hit my mailbox 65% maxed out. After buying a book advertised on TV (about getting out of credit card debt, of all things), the bill balooned to $281.70, already over limit. And after seven days, a collector demanded the full balance.

I've mailed a scan of the first bill to a local TV station in hopes of getting an investigative report going. I would much like to see these thieves exposed.

I have recieved a card yesterday and I have not even activated the card but guess what I received a bill from them today that I owe them $179.00. What for... I have no idea when I even asked them to give me a card.

After looking at all these comments I am scared they are going to screw me up. Include me in the lawsuit against this card.

A few months ago, I had been behind on my payments and I had called First premier to set up a payment to get ahead. I had spoke to a man(name unknown) and he had told me if I were to make two payments by a certain date, I would be back in positive standing. The first payment of 370.00 I had made over the phone using check by phone, the following week I made another payment of 370.00 Which I had seemed to have clearly followed instructions of the two payments by the date I was told to make two payments by. A few days after I had made the two payments. My bank account was charged an additional 370.00. Which in this case I am stating that it was an unauthorized transaction. They have been calling me continually to set up payment arrangments, at this time I am very keen on setting up payments with this establishment. I asked many times to speak with somebody on the higher end to help me with this situation, and all they seem to do is tell me we'll make a note of that, and two days later I get somebody else trying to set up payments from me. I feel that they are not even trying to own up to the fact that they cold heartedly stole from me. If I have a chance to put these people in their place please contact me for more information. Remember they charged my bank account twice in 1 month time period, from my understanding that is illegal in itself. Thank you, and have a pleasent day.

1st Premier STRIKES again...these people are totally rediculous, I can't fight with them anymore because I GET NOWHERE, I am utterly drained and tired and ready to go postal. The reps are all a bunch of jerks, none of them are customer oriented and they talk down to you!
Obviously they do not notate accounts after speaking to you about matters because when something that was promised to be done for you doesn't get done, which is very common and you call back to follow up, no one knows what your talking about...how convenient!
No one tells you the same story twice, no one has told me the same thing since i first became a card holder!

Hi guys.
Rule number one: never deal with them on the phone. Send everything certified mail, return receipt requested. It'll cost you like $3, and save you hassels down the road.
Rule number two: check out creditboards.com, the forums. If you are willing to read, read, read you will learn enough to answer at least 90% of the questions on this thread.
And probably bump up your credit score in the process.

I have been a customer for years with this company. During the summer, I make minimum payments as I have no salary for approximately 3 months. I made a payment of 15.00 and should have made 20.00. Instead of allowing me to repair what was an honest mistake, they sent their in-house collection leg breakers after me. They accused me of not making payments. When I went to my on-line account and read them all the dates of the payments I had made (often times double or triple the minimum), they then said the reason they were saying I had not made a payment in March (due March 29) is because they received the payment for March on March 3 (huh?). If they had received it March 5th, the day after statements went out, I would not be listed as being late or missing a payment that month. Does this make sense to anyone? I intend to pay off my balance as soon as I am back to work and will never use this card again. This is no way to treat loyal customers of long-standing.

I RECEIVED MY FIRST PREMIER BANK CREDIT CARD TWO DAYS AGO, THOUGH I WAS LOOKING FOR A CREDIT CARD, I EVENTUALLY DON'T REMEMBER SIGNING UP FOR THIS CARD. LIKE MOST OF YOU, I WAS SHOOCKED WITH ALL THE FEES THEY BILLED ME, WHICH LEFT ME TO $71 LIMIT SPENDING. I HAVE NOT USE THE CREDIT CARD YET, AND DECIDED TO COME ONLINE TO SEE WHAT OTHERS HAVE TO SAY ABOUT THIS CARD FIRST. I NEVER HAD A CREDIT CARD BEFORE BUT WHEN I SAW THE STATEMENT AND HOW THE CREDIT CARD WAS ALREADY ACTIVATED, I KNEW SOMETHING ISN'T GOOD.

I AM GOING TO CALL TO CANCEL THE CARD/ACCOUNT TODAY. I HAVE A BAD CREDIT ALREADY AND I DO NOT WANT THIS SHIIT TO ADD ON TO IT.
AFTER READING EVERYONE'S POST, I AM SCARED, THIS IS A NIGHTMARE.

WE'LL SEE HOW IT GOES AS TO CANCELING THIS CARD. I'LL KEEP YOU GUYS POSTED.

FEEL FREE TO COUNT ME IN AND EMAIL ME ABOUT THIS AS WELL. THANKS!

This credit card company is very deceptive. I used to pay my bill early to get the payment out of the way but then I would get a late payment fee because somehow I made the payment too early and did not make the payment within their time frame. Other credit cards I have, accept my early payments with no problem. Just yesterday, I received a call from Premier Bank stating that my account was referred to collections because I was "past due". I had not made a "late payment (in there terms)" in many many months because I caught on to their trick. So I was shocked to be receiving this call...I told this person, who said his name was Eyoe (that's how he spelled it), that I would make a payment through my online banking immediately. He then told me that I needed to make the payment over the phone. My husband overheard and took the phone from me and started to tell him that we would make the payment online, but "Eyoe" kept insisting I needed to pay over the phone. My husband then began to yell at him and "Eyoe" agreed to "let me" make the payment online. I have had many issues with this credit card company. The also have let magazine companies charge me for subscriptions I DID NOT authorize. I have received magazines that I never subscribed to only to find out they had been charged to this credit card.

Count me in to this Class Action Lawsuit!

Hey all...well once again...
I have been struggling with First Premier Bank MasterCard for a long time now, many years. First let me just say that in March of last year, 2008, I had set up a payment arrangement with someone, I didn’t write down her name because I didn’t think it would be a problem, I made the necessary arrangements and stuck to my end of the bargain like clockwork, I was told that once the payment arrangement was complete that I would have a closed satisfied account. To my surprise about 2 months later I get a call stating that I was delinquent, I said how can that be when all the payments were taken out of my account as arranged and the account should have been closed and at a zero balance. At that time I was told that the agent didn’t see all of the fees that would be tacked on throughout my payment arrangement and did not take those into consideration, I asked how that was my problem since I am not the one that gets to look at an account screen on their end? I got extremely angry and refused to pay……..fast forward through countless harassing collections calls every day to July. I finally gave in, having become very frustrated and worried about my already damaged credit and wanting to salvage what I could. I spoke to a Renee in July of 2008 and she was actually very nice so I decided to work with her since all of the agents I had spoken to before were downright rude and seemed to have a great time being sarcastic. I spoke with her at length and agreed to set up yet another payment arrangement. I asked her 3 separate times, “Is this it? Is this all I have to do to be done with you people? I’m not going to get a call after all of this telling me I still owe more money right?” She assured me on all questions that after my 6th payment SHE would make sure that the final payment was zeroed out and that she couldn’t do that until the last payment in my arrangement was paid. All of the payments go through and I am breathing a sigh of relief that the First Premier Saga in my life was finally over.
Low and behold at the end of December I get yet another call from an extremely rude agent telling me that I am “past due and how would I like to take care of that?” You can imagine my shock and horror and surprise and dismay when I get this call. I questioned the balance and am told that whoever made the arrangement with me was wrong in the amounts……….AGAIN!
I ask to speak to the agent that set the arrangement up with me and I am told that there are no direct extensions but I could speak to a manager, I opt to do just that. The “manager” gets on the phone with me and I calmly explain the situation, trying very hard not to get angry because I am in the early stages of a high risk pregnancy. I tell her exactly what happened and she puts me on hold. Again she gets back on and of course was NOT a nice person at all and proceeds to tell me the same thing they told me back in May …..“The agent didn’t see all of the fees that would be tacked on throughout my payment arrangement and did not take those into consideration.”
I am mortified and get very angry and explain that I have paid over $600.00 in fees because they can’t get their sh*% together and that I am now refusing to pay another red cent to them.
A few more months go by and I receive about 4-5 calls a day from my friends at First Premiere asking me if I can make a payment and warning me that my balance is just climbing again……I say “thank you very much and tell them all to F&*K off” and hang up, I am not normally like this but I am on fire angry with these ruthless crooks by now.
On February 22nd I get a phone call from Darla, I was not nice to Darla but she politely asks me to give her a chance to review my account to see what she can do for me……how nice of Darla. I allow her to place me on hold and a few minutes later she comes back on and APOLOGIZES and tells me that she can see what happened and ASSURES me that this will be cleared up by her personally. I tell her that “I apologize for not jumping up and dawn for joy and that I would believe it when I saw it.” She again ASSURED me that she was going to get a “supervisor involved and they would clear it all up for me.
On February 25th 2009 I get a phone call from my friends at First Premier asking me when they can expect a payment, I say calmly, I spoke to Darla on the 22nd and she told me she was going to clear this up. I was then told to hold. Then I was told that Darla was wrong and that the balance is correct and still owed.
These people have brought me to tears, I am truly at the end of my rope, I am helpless, they are milking me and not keeping up their end of the bargain and I feel robbed, I feel taken advantage of and I feel like a true victim. What can I do, I can’t afford an attorney………Do I just keep paying them for the rest of my life? I need help and I need it fast. Please tell me what to do?

You are all idiots. Seriously, over half of you can't even type. Which maybe explains why you can't read either, because if you did take the time to even skim over the terms and conditions none of you would be upset. Also this is a sub prime credit card, that means high risk, and that means high fees. And if how I summed it up for all of you isn't understandable enough, you don't deserve a credit card nor should have one.

Towel Heads Suck! What happened to the pretty little voice on the other end of the customer service telephone conversation and how the hell do we AMERICANS get those jobs? We need to take our country back! And our credit card companies! It wasn't very long ago that this country was 2 Trillion Dollars to the good. Now we have a 3 Trillion Dollar Deficit... That's 5 TRILLION DOLLARS, for those of you that can't do simple arithmetic. (How's that, Miss Spelly?)... spent by WHO? It seems to me, that kind of revenue could have generated enough "RED BLOODED AMERICANS with BALLS, to build one hell of a wall around this fine country! Can anybody spell [censor]?

I am glad I came across this site. I thought I was the only one going through it with this company. I received a letter in the mail a couple of days ago stating that my payment did not go through and that I was now required to make a late payment, fees added on. I believe they used the "hold for 20 days" tactic on me and am not too happy about it to say the least. My balance on the card was around $150 and now with all these fees and the fact that APPARENTLY my payment was never credited, which, by the way, makes sense now since I never saw it appear on my bank statement, although I had sufficient funds. I have a new balance of $311.11. To top it off, they upped my minimum payment to $100 instead of $30. If I don't make that payment, then what? They're going to report me to the credit bureaus? The only reason I got this card was to help build my credit and now I feel totally robbed and back where I started. I wish I had the money to just pay them off and be done with this card, but after reading thru all these horror stories I can't help but wonder if it would just be best not to give them one red cent and let the damage be done. It seems they are never satisfied and people who are trying to do the right thing get no where. I would so love to join in a lawsuit against them, it really ticks me off that this type of thing happens. I live in GA; If anyone wants to talk about any similar experiences, etc., email me at xtinawllmsn@yahoo.com. Everyone have a great day.

I have also been experiencing hardships from this bank's business practices. I have received a statement for minimum payment due which was later increased before payment billing cycle was due to close. They claim I am over my limit, however I cannot even make purchases that exceed my limit. So what over- the - limit are they charging me for.

I am having multiple issues from fraudulent charges to late fees after the bill was paid on time. When I call I have been hung up on multiple times but in the end they reverse the charges so I know it's a scam. They have even credited me an amount different and of course lower than what I actually paid. What a nightmare for people trying to rebuild their credit. Please tell me there is FINALLY a class action suit against them that I can join?

I have also had money taken from me from FPB CR card. Took forever to talk to someone, since they was no option to speak to an agent. Then when I did cancel the credit card application I didn't apply for they said 6 days before I get my money back. I call today and now they say 7 to 10 more days before check is mailed. This I ridiculous. Did anyone get there money back?

I have the First Premier MasterCard. Made a large payment to have the credit card for a hotel stay for a trip for cancer treatment. They require a Credit card for motel. They took money out of the checking account but my account shows I have no credit available. Cancelled appointment and given spiel about 7-2- days to make it available. What? Payment posted but no available credit.

Richard I had the same experience would like to be added to class action, is there any way I could do so without posting all my personal information on public media? I would like that. Is there an email I could go to or website.

Thank you very much for stepping up. Not all of us have the means or know how to seek legal action or even know when a company is acting outside of the law, so I appreciate your actions as well as you sharing this information and invitation to join in.

I also have had the same exact experience my account is now closed and dropping my credit score due to a full balance but both statements plus all of my payments are credited it shows returned payments in the transaction log but the money never came back to my bank account and shouldn't it say on the payments returned not credited? Plus when I made the payments my balance would go down and I would get conformation emails saying payment confirme. I would like to be added to the lawsuit my email is dawnbladewarlock21@gmail.com
