After filing my initial claim a year ago my claim inaccurately flagged for fraud and i didn't receive any information or notice on way i had zero luck on getting a hold of anyone at the contract center when i would call untill i finally got a call from a lady from the benefits department but she was no help but week after week i would still file my weekly claim just to have it say my payment was suspended or no payment issued for a whole year i did this then finally i got told the reason why i had not received a payment was because my claim was flagged for fraud then back in September a lady from the fraud department called me and said she was calling to clear up the fraud flag and just needed to ask me some questions i answered all her questions afterwards she informed me that everything turned out good and that she was putting in the request to have the flag removed and for me to be paid out I waited a month nothing changed i called and finally got to speak with someone they told me i needed to send in my identity verification documents i done that another month has passed by and still no change and everytime i call i get the se piss poor excuse that their waiting on the next department to lift the flag referring to the fraud department and that the only thing that they can do is send the same lousy email that they all keep sending but nothing happens and no one contacts me and no change happens its going on 2 years now and i still have not received any payments to me it sounds like Kansas department of labor has a bunch of employees that dont want to do their jobs and need to be fired i requested that someone contact me multiple times but they don't i requested thar my claim be expedited and move to the front but they don't and say there is no phone number to contact the fraud department and all they can do is send an email

Paralyzed and plundered by the very gov't provisions we've paid into our whole lives. This is unspeakably devastating. I have heard this same complaint about the negligence or nefarious intentions of the KSDOL Fraud Dept. and related unchecked Fraud status cycle to its many KS citizens, myself included. We're told that nothing's wrong with the account, we pass the phone identity interview and told our accounts are fine and that the account will just need one final admin step of removing the flag which would only take a few days. Many of us have been told this and months have passed; losing our homes and all we have because the taxes we've paid into for decades, that is in place for us to utilize during a period of unemployment, is so negligent in it's management and concern of outcome for those who've paid into it, have now caused us to lose everything. How does this make sense? I pay into this for 40 years. I finally need to use these benefits b/c of job separation, and they throw me into an endless limbo of misflagged fraud, holding my benefits hostage, told all is ok and account will be reactivated, no one at KSDOL with any answers, no one at gov't level available to help or provide advocacy, and in the end losing everything while waiting. An absolute travesty that needs to be addressed publicly, through media sources. They will not listen to the outcries of those whose lives they dismiss with every vague template answer they provide. For the Love of God, is there anyone out there who can help address this and call KSDOL to make transparent and rectify the damage that they're causing?

Not getting my back pay.
My name is Shelby Carson. I have been dealing with trying to get the rest of my back pay I am owed. I have received part of it. I've had to get some weeks moved to the right spot to receive the rest of it. When I've called countless times and have been told by representatives that yes my weeks have been moved to right spot waiting for payment to issue. Then when I call again I get told that no my weeks have not been moved and there is now a block on my account. I'm fed up with it. I don't know who to believe what to believe. I'm fed up with the representatives not all knowing the same information. I just want it fixed and receive my money to pay my bills. I had to wait over 6 months to receive the first part of my payment am I going to have to wait over another 6 months just to receive the rest of it?

Hello I am a concerned Kansas unemployment applicant. I applied for P.U.A and received a non monetary document (K-BEN 4211) that was mailed to me on 09-03-2021.Non Monetary documents are facts and final unless appealed. I included this document in this email stating that I am eligible for unemployment according to K.S.A 44-705 by examiner 306 from the Kansas department of unemployment. K.S.A 44-705. It states
44-705. Benefit eligibility conditions. Except as provided by K.S.A. 44-757, and amendments thereto, an unemployed individual shall be eligible to receive benefits with respect to any week only if the secretary, or a person or persons designated by the secretary, finds that:
(a) The claimant has registered for work at and thereafter continued to report at an employment office in accordance with rules and regulations adopted by the secretary, except that, subject to the provisions of K.S.A. 44-704(a), and amendments thereto, the secretary may adopt rules and regulations that waive or alter either or both of the requirements of this subsection.
(b) The claimant has made a claim for benefits with respect to such week in accordance with rules and regulations adopted by the secretary.
(c) The claimant is able to perform the duties of such claimant's customary occupation or the duties of other occupations that the claimant is reasonably fitted by training or experience, and is available for work, as demonstrated by the claimant's pursuit of the full course of action most reasonably calculated to result in the claimant's reemployment except that, notwithstanding any other provisions of this section, an unemployed claimant otherwise eligible for benefits shall not become ineligible for benefits: (1) Because of the claimant's enrollment in and satisfactory pursuit of approved training, including training approved under section 236(a)(1) of the trade act of 1974; (2) solely because such individual is seeking only part-time employment if the individual is available for a number of hours per week that are comparable to the individual's part-time work experience in the base period; or (3) because a claimant is not actively seeking work: (i) During a state of disaster emergency proclaimed by the governor pursuant to K.S.A. 48-924 and 48-925, and amendments thereto; (ii) in response to the spread of the public health emergency of COVID-19; and (iii) the state's temporary waiver of the work search requirement under the employment security law for such claimant is in compliance with the families first coronavirus response act, public law 116-127.
For the purposes of this subsection, an inmate of a custodial or correctional institution shall be deemed to be unavailable for work and not eligible to receive unemployment compensation while incarcerated.
(d) (1) Except as provided further, the claimant has been unemployed for a waiting period of one week or the claimant is unemployed and has satisfied the requirement for a waiting period of one week under the shared work unemployment compensation program as provided in K.S.A. 44-757(k)(4), and amendments thereto, and that period of one week, in either case, occurs within the benefit year that includes the week for which the claimant is claiming benefits. No week shall be counted as a week of unemployment for the purposes of this subsection:
(A) If benefits have been paid for such week;
(B) if the individual fails to meet with the other eligibility requirements of this section; or
(C) if an individual is seeking unemployment benefits under the unemployment compensation law of any other state or of the United States, except that if the appropriate agency of such state or of the United States finally determines that the claimant is not entitled to unemployment benefits under such other law, this subparagraph shall not apply.
(2) (A) The waiting week requirement of paragraph (1) shall not apply to:
(i) New claims by claimants who become unemployed as a result of an employer terminating business operations within this state, declaring bankruptcy or initiating a work force reduction pursuant to public law 100-379, the federal worker adjustment and retraining notification act, 29 U.S.C. §§ 2101 through 2109, as amended; or
(ii) new claims filed on or after April 5, 2020, through December 26, 2020, in accordance with the families first coronavirus response act, public law 116-127 and the federal CARES act, public law 116-136.
(B) The secretary shall adopt rules and regulations to administer the provisions of this paragraph.
(3) If the waiting week requirement of paragraph (1) applies, a claimant shall become eligible to receive compensation for the waiting period of one week, pursuant to paragraph (1), upon completion of three weeks of unemployment consecutive to such waiting period. This paragraph shall not apply to initial claims effective on and after April 1, 2021.
(e) For benefit years established on and after the effective date of this act, the claimant has been paid total wages for insured work in the claimant's base period of not less than 30 times the claimant's weekly benefit amount and has been paid wages in more than one quarter of the claimant's base period, except that the wage credits of an individual earned during the period commencing with the end of a prior base period and ending on the date that such individual filed a valid initial claim shall not be available for benefit purposes in a subsequent benefit year unless, in addition thereto, such individual has returned to work and subsequently earned wages for insured work in an amount equal to at least eight times the claimant's current weekly benefit amount.
(f) The claimant participates in reemployment services, such as job search assistance services, if the individual has been determined to be likely to exhaust regular benefits and needs reemployment services pursuant to a profiling system established by the secretary, unless the secretary determines that: (1) The individual has completed such services; or (2) there is justifiable cause for the claimant's failure to participate in such services.
(g) The claimant is returning to work after a qualifying injury and has been paid total wages for insured work in the claimant's alternative base period of not less than 30 times the claimant's weekly benefit amount and has been paid wages in more than one quarter of the claimant's alternative base period if:
(1) The claimant has filed for benefits within four weeks of being released to return to work by a licensed and practicing health care provider;
(2) the claimant files for benefits within 24 months of the date the qualifying injury occurred; and
(3) the claimant attempted to return to work with the employer where the qualifying injury occurred, but the individual's regular work or comparable and suitable work was not available
A appeal can not be made on this claim because the definition of non monetary determination based on KDOL's guide to Security Act Handbook and the Security act handbook states
Non monetary Determination: A determination that is not based on wages (money). It advises both the employer and the claimant that either a denial of benefits has or has not been issued. Both parties have appeal rights. The appeal must be filed within 16 days of the mailing date.
The KDOL guide to Security Act that both the employer and the claimant have appeal rights. The appeal must be filed within 16 days of the mailing date in which the non monetary document states was [protected]).
Legally no redetermination can be made according to UI Reports Handbook 401 (ETA 207) Non Monetary Determination Activities. It states

These corrected determinations are not based on new or additional information or protest and should not be reported as redeterminations. Also, if the claimant objects to a nonmonetary determination, listening to a repeated earlier statement and explaining the determination does not constitute a redetermination. I am emailing this because KDOL is failing to abide by federal regulations, their own regulations and handbooks. Refuses to abide by guidelines set by UI Report Handbook No. 401 (ETA 207) and Kansas Security Act (K.S.A) and must be addressed and payments processed. Somebody must hold them accountable. Yes I have been waiting on my pua unemployment for close to a year have done all requirements sent all documents reached out to governor kelly senator jerry moran legislative office stephanie byers julie menghini cindy holscher and they all have tried to help i've even done the law enforcement verification and nothing I just keep getting told waiting for flag lift.. I was fired from my job on 06/05/21. I had a severance agreement with my employer to pay me through the end of June. I began the process of filing unemployment on 06/07/21. I never filed a weekly claim until the first week of July. I spoke with rep from the unemployment office who said I would receive a determination letter in the mail. About 3 or 4 weeks later I received two letters in the mail. One stated my claim was approved and the second said it was denied. I called the unemployment office and after about 20 attempts I got ahold of someone and they said it was because they never received my severance paperwork. So I scanned it and sent it while she was on the phone with me. She then told me there was nothing else they needed and they would make a redetermination and notify me when a decision was made. After approximately 4 weeks and nothing had happened and I hadn't received a letter I decided to call and inquire about my claim. I spoke with a lady that told me that the severance agreement wasn't signed by my employer so it was not accepted. She told me that I must have it signed. Later I found out that this was not true. However I made several attempts to get my previous employer to sign it and nobody would call me back. So after two weeks of trying I called KDOL and pleaded my case and told them they won't sign it. The man I spoke with said don't worry about that it doesn't need signed by them just you. GRRRRR…. He then said the only hold you have is because of your resume isn't updated. He said get that done and you should be good to go. That was at the beginning of September. Here we are the second week in October and every time I call to ask what the hold up is they say it's still under determination. So this determination has been going on for almost three months. Need I remind you my claim was already approved 4 months ago. Please can someone help. My savings account is almost to 0.00.

Kansas Unemployment - Fraud Investigations & Resolutions
I have not received the unemployment compensation for 9 weeks for which I am eligible due to a fraudulent claim on my account last year (for which I had no involvement).
I have filed all of the requested paperwork and identification validation (drivers license attached here for reference) to have my case resolved - yet I am unable to speak with ANYONE who can help me resolve this issue. Additionally - I am unable to get any type of estimate for how long it will take to resolve my account - making it IMPOSSIBLE to create a plan to manage my expenses. I have called in repeatedly and had agents tell me that they can't let me talk to anyone that can help me or they risk getting fired - surely that is not true.
I am unable to continue living on credit cards forever and would GREATLY APPRECIATE any feedback on my situation. This approach of leaving people in the complete dark is untenable. Please help me get in contact with someone who can help me.

Understaffed, incompetent, unresponsive. KDOL lost so many hundreds of millions of dollars to fraud last year that they freaked out in early 2021 and suspended every legitimate claimant who was receiving PUA benefits. They then took their sweet time (still counting) going through every claim trying to find any possible way to deny payments or request paybacks. If you are owed federal benefits you must fight KDOL until you are payed. Put your foot down, and don't give up. They owe, and they will pay. Good luck.

Never received any benefits. Faxed and mailed many letters in regards to this issue. ( faxed and mailed tax records showing pass employment, pay stubs where I was working when laid off and SSN number. ) Did get a call about 6 months ago stating I would get benefits and backpay. Never got it. I have called about 500 times. This has been going on since July 2020. Never got a denial letter. When I was able to contact someone they stated they had all documentation and no notice of fraud. (just in case someone else had used my information) I would like to Know Why Please I did just get a job.

I have been trying to receive unemployment benefits since July 8th when I was fired from Casey's while I had covid-19. I have spent day after day calling five days a week and speaking to different representatives to get my account to where I can sign on online and still nothing! My card was mailed to an address from 2015 so I cannot even get a new card issued because nobody can update my address to be what was on my application to file a claim even! I have lost my car and just about to be homeless and have not eaten for several days while waiting on a card that has over $6, 000 on it. This is absolutely ridiculous that there is not one representative that seems to be able to help me and nobody they can transfer me too! I was hung up on 28 times in the last 5 days. Mind you it is NOT because I am being hateful because I have not been. I have worked my whole life and paid into this and the time I am fired wrongfully I cannot even get any help from our government. This is the worst service I have ever seen in my lifetime! I can not even get to a claims specialist or just someone that would be willing to try to get it fixed. Everytime I get someone that seems to want to try to help once again I get hung up on. I spoke to US Bank Reliacard and they cannot change my address they mail the card to because it has to be updated in the Reliacard portal from unemployment end. I have been fighting since mid Nov 2020 to collect unemployment, I have supplied all information requested but still nothing. I had a fraud hold which took 3 days to resolve because the website was down. Then informed on phone I needed to file a form which I did over 2 weeks ago but got the same form in the mail. Each week claimed shows a determination has been sent but never received anything. I have not received a paycheck since Jan 15th 2021 which at the time I was under a medical leave. I am getting no response or help with this issue. My employer let me go 1st of Aug because I was on medical leave to long. Again have not received any paycheck since Jan. Why can't the state take care of residents that are truly unemployed and in need of assistance !?!?!?!?!?

I called to speak to someone about fraud with unemployment. She told me she was in the claims dept. She said she didn't know who to transfer me to. Was very rude and condescending. Asked multiple times why I was calling, I told her the issue we were having with multiple people filling out online applications, we call them to set up an interview and then they are not showing up for their interview. As a tax payer I would like to make sure that I am not paying for these individuals unemployment when in all actuality they are not showing up for the job interviews. She said "Well you could call the fraud hotline (which is what I called) but I don't know why you would want to do that? I explained again to her why - she continued to be rude and unhelpful and I told her she was being very rude and I asked for her name - Sonja and she hung up on me.
Desired outcome: Just do the job you were hired to do and if the call is not for you - forward it on to someone who can help me. And be nice and helpful - it's not that hard.
Getting a payment
I have been contacted several times by kdol and kdol fraud investigators and answered all questions asked, give any information asked for, and have been waiting going on 2yrs. now to be paid my PUA unemployment and I haven't received even one paymet. I've had to borrow money 4 times now to even pay my rent and I shouldn't have to borrow anything. When will I ever get paid?

My name is Jermaine Wiley i have not recieved payment since Dec 29 2020 .When the new verification system was set in place i was lock out the system told i failed Lexis Nexis which was false had no way to contact kdol in Jun 2 2021 i finally was verified and proofed by Fraud dept which i had turned in and uploaded every possible document.I was help by a specialists who herself filed all my weeks from Jan2 2021 to April 17 and told im clear payments will be payable within weeks ..I was told told file the rest because had to fill out quarterly which i did 4 within 2 weeks ...Ive been hung up on told i dont know what im talking about..i need action now i have lost electricity next my home ..Ive exhausted every resource..I have yet to recieve a single email with any updates since April 2021..I need legitimate resolve so i can repair my life

I filed for Unemployment on 5/7/21. It is now 9/8/21 and I still have NOT received my benefits. I have called over 30 times and talked to 5 different individuals who EACH have told me that I have done EVERYTHING needed that my case waits on a judicator... I find that 4 months is a bit insane to complete someone's Kansas unemployment benefits. The website says they are going to send me something and I have NEVER ONCE received anything from KDOL asking me for anything or telling me that I need something. I had to wait MONTHS and me calling them and the representative each time I called, tell me something new. How disheartening and poorly ran. Does one need to obtain an attorney to actually get their benefits? Or is it normal to take over 4 months with 0 responses?

Lack of knowledge / disregard for callers
I would like to start by saying I am a single mother, who has submitted over 750 resumes in the last ten months. I am a hard worker, and eager to do so. However, being a single mother during a pandemic, is equal to being a leper! No one wants the liability with the fluctuation of school closings and the overall perception of a mothers' role in a child's life!
I filed my initial claim on November 4, 2020. Today is September 3, 2021 and I have yet to receive one penny. I have over 600 logged hours on the phone with kdol since January 2, 2021. In eight months, 1200 hours equals a full time position. I have half that, in phone time only. That does not include the time I've spent preparing documents. Repetitively sending/submitting the same documents…attempting to ascertain exactly which program I belong in. Proving I am, who I say I am. And the shortcomings just keep flowing from kdol!
Can someone give me a straight answer, because my next stop is the governor's office…and believe me, I have documentation stating that not only was my appeal denial inflated versions of the truth, but every course of action I've taken, has been a direct reflection of orders given by the incompetent staff on the other end of those phone lines! Yet, here I sit, fighting to survive, begging for handouts, all while being told "we're sorry, we can't give you an estimated time frame. Just be patient." oh and: even though we can plainly see how wrongly you've been handled, "we're unable to escalate your case. We've been given strict instructions that no one's case is a priority."

I cannot get a hold of anyone to fix my account. When I do get a hold of a live person I am transferred and then put on hold. My account is suspended because of severance I never received a severance. I was told a month ago I would receive paperwork in the mail to fix it and I never did. I was told to call PUA. For days I called but the Que was full every time. When I try the virtual assistance I am told to call so this cannot be taken care of online.
