1. That the complainant in the instant complaint has placed above said order with Order ID [protected] and Product ID 1592341 with Banggood.in out of which present dispute has arisen.
2. That on dated 26th December 2019 the above said order was placed online at banggood.in for the product with title "Bmax B1 Mini PC Intel Celeron N3060 Dual Core 1.6GHz up to 2.4GHz 4GB LPDDR3 64GB eMMC Intel HD Graphics Wifi bluetooth M.2 SATA 12V/2A HD VGA - EU plug."
The product specification mentions "Solid State Disk: Support 1* M.2 2280 SSD." And its Package List mentions 1 x SATA cable, but neither said M.2 2280 SSD is included in the PC nor there SATA cable in the package rather there s a HDMI cable in place of SATA cable.
3. That since said M.2 2280 SSD is not included in said product or its package; therefore, the complainant buyer has to buy said SSD himself so as to increase the storage capacity of said product/Mini PC that he ordered with Banggood. Accordingly, prior to receive delivery of said product, the said complainant buyer inquired with Banggood customer service appropriate interface of said SSD so that it can be bought separately by said complainant buyer.
4. That on 27th December, 2019 the complainant buyer has received an email reply from the Banggood customer service that stated, "After checking with our related colleagues, they replied us that it can not be used with it because there only one gap."
5. That on sometime on 15th January, 2020 said complainant buyer has received delivery of said order. The package of the order specifically did not contain M.2 2280 SSD or a SATA cable rather it contained a HDMI Cable in place of said SATA cable.
6. That it became contradictory with the title of the order - that says interface of the solid state drive as M.2 SATA and said email reply from the Banggood customer service who replied only one gap (in the edge of said SSD). Therefore it was necessary for the complainant buyer to ascertain appropriate interface of said SSD before buying it separately.
6. That on 17th January, 2020, just a day after receipt of said delivery, the complainant buyer interacted with Banggood Support Agent named Walt so as to ascertain appropriate interface of same said SSD and complainant continued inquiring it on 18th January 2020 with Support Agent Mike, but there was not answer to said enquiry raised by the complainant buyer with banggood.in Customers service, thereafter there were several interactions between the complainant buyer and said customer service but there was no answer for a long time as claimed by the Bangood agents due to Chinese Spring Festival and later it was said that holiday extended.
7. That M.2 was designed to support SATA and also PCIe, so this raised a question in my mind in selecting an appropriate interface between SATA and PCIe. However, there is a M Key socket in the system board of the PC for the M.2 2280 SSD so possibility of SATA interface is eliminated considering that M.2 NVMe SSD typically wants PCIex4, so there's only one possibility - M key, as almost all M.2 2280 SSDs with SATA interface mostly have B plus M Key edges but I do not find such an SSD with SATA interface have M Key edge but all M Key edged M.2 2280 SSD's have PCIe interface i.e. PCI Express x4 Interface. Accordingly, I have purchased one Transcend 256GB NVMe PCIe Gen3x4 80mm M.2 SSD for the purchased PC in the mean time.
8. That on 12th February 2020, the Banggood Technical Team finally responded to me but with other questions, asking for Image and video of the PC as well as SKU barcode and Shipping Level of the parcel so as to verify the problem and probably to find a suitable solution for the problem with the PC. And I have complied with stated requirement of bang good.
9. That due to all these unanswered interactions and due to said Chinese Spring Festival many days elapsed unanswered since the time this complainant buyer received delivery of said order on 15th January, 2020. Therefore the buyer's ability to decide obligatory action on the received order could not reasonably be decided and have been delayed obviously for no fault of his own but for the delay from Banggood.
10. That on 18th February 2020, Banggood technical team finally decided on the issue and asked this complainant buyer, "Could you check if the item can be repaired in the local store or not first? Please inform us how much the reparation will cost before you start to repair it. Then you can use the item as soon as possible."
11. That the complainant buyer verified with local repairing workshops but came to the conclusion that doing private repairing attempt for a manufacturing defected item not only risks him natural product guarantee of the ordered item but also additional untoward financial loss for the inadequacy of serviceability of the received product from banggood.
12. That the said reply from said technical team clearly reflects that Banggood or its manufacturer do not wish to address a manufacturing defect with the PC bought by this complainant customer from Banggood website in India.
13. That the BMAX B1 Mini PC with Order ID [protected] and Product ID 1592341 is under guarantee for its intended service as described in the sales description and the description of the PC but it is not functioning as per the description and Banggod has confirmed its defect after verification but improperly asked this complainant buyer to get the PC in a local repairing workshop in order to make it run properly but this request is not reasonable.
14. That quality test by Banggood prior delivery failed to detect problem with the SSD, otherwise, this complainant customer would not have to suffer for buying the product from Banggood.
15. That Banggood and the manufacturer of the BMAX B1 Mini PC with Order ID [protected] ought to discharge the PC's guarantee that it performs as per the description and that is why it was agreed by the complainant buyer to order and buy the BMAX B1 Mini PC with Order ID [protected] and Product ID 1592341.
16. That Banggood is responsible to resolve the defect more than a private local repairing shop near the complainant buyer's locality, so that such a repairing shop may not be able to resolve a manufacturing defect in the PC without specific technical knowledge and without customized parts used in the PC.
Therefore, considering the above stated facts and circumstances, this complainant buyer prays before your goodness to intervention in the matter related to said Order ID [protected] and Product ID 1592341 and after hearing the defendant, pass necessary order or direction so that the complainant gets a conscionable natural justice and the BMAX B1 Mini PC is made ready for its intended use which otherwise is not possible right now.
And for your kindness, your petitioner shall ever pray.
