safe deposit box moved and cannot get contents back after 2 months
Bank of America closed my branch without much notice. I was traveling and returned to find it closed without any notification from them. They claim to have sent notice. I have never seen it. I had a safe deposit box at the branch. Employees opened my box, supposedly inventoried it and sent it somewhere. After 2 months of requesting it from an open branch I have yet to see the contents. I have requested it on three separate occasions and am always told it is coming. Apparently safe deposit boxes with The Bank of America are not so safe. Mark McLewin
sudden service charge on low balance
My mother is a senior city with very low monthly income from Social Security. When she opened her bank account with BOA in 2009, she was told that no fees would be charged on her saving and checking. Since last November, Bank of America started to charge $15 or $25 (depends on which month) service fee on her account. She does not in general read her bank statements in details since her balance is usally less than $100 and she just takes out the SSI money each month to spend. She just noticed that her balance is lower than her expectation. I took a look at them and found out that. Last night I spent almost two hours on the phone to figure out why. BOA never gave me a straight answer. The first rep converted the account to one "without service fee if we don't use the banking center", despite there was no fee to start with. But he refused to refund her the fees. Then we asked to speak to the supervisor, whose name is Jennifer in Dalas Taxas. She asked us to wait for 15 to 20 minutes before speaking about the case. She only allowed my mother to speak and forced her to take the solution of only refund part of the fees. She insisted that even with the account owner's permission, she can't speak to me. She obviously was trying to taking advantage of a senior citizen by not giving her reasons of why the fees were charge, but simply say that's the best she can do. I don't know how many other senior citizens are being treated unfairly like my mother. Image $15 from one person, how much money can Bank of America made from senior citizen group?

A similar sudden service fee was initiated on my account with Umpqua bank in Oregon. Kind of ironic how criminals are put in prison like everyday for doing the same thing. Its called Stealing.
world points ripoff
I've had an account with this bank for many years, always pay on time, almost always the full amount, and had been satisfied. I was approached to change my account to a World Points account where I would earn a point for every dollar I spent, sometimes 5 points during certain specials. I joined. I have such accounts with Chase Freedom and with Discover and with each of these two, each point is worth what it shows. If you gain 5000 points, it's worth $50. Great deal. It sure helps in today's economy-especially for those of us retired and on very limited incomes. Today I finally reached a little over 5000 points on my BOA account and went to cash it in. What am I told? I only get $25 in credit! THEY cut your points in half?! Had I been aware of this, I would never have used this card and stuck with Discover or Freedom to get my full points. Be aware of BOA doing this. In fact, last month I was going to cash them in and the fella I talked to had me believing that if I waited until I hit the 5000 points, i would get the $50 PLUS a bonus $25 for waiting until then to cash it in! I asked him again and again and figured it was well worth it to shop another month (needed new tires) and that would put me over the 5000 points to get the bonus $25. SURPRISE. Cashing in today-I ONLY GET $25! What a rip off. I am retiring my BOZ account and going back to using Freedom (where I can cash in any amount) and my Discover (where I have to accrue 5000 before I can cash it in for THE FULL $50). I hope people take notice that not all banks are the same when they award you points. I looked on line AGAIN and NO WHERE does it say how they discount your points when you cash them in. I feel really duped by BOA.
This was my complaint. I gave thought on it and the next day I decided to fight. It took talking to 4 different people, moving up the ladder and I finally got some satisfaction. I must say, after spending time and telling my story to 4 different people, the first 3 unable to do anything, I finally found someone that could help me and meet me to satisfy my request. We also have resolved the points by opening a different kind of account that guarantees 1% on all transactions, 2% on groceries and 3% on gas purchases. Once I pay off the World Points account (which will be next month) I can either keep it open and try to get my points to cash in (I doubt it-not worth loosing 1/2 % to try and gain them when I can gain a full point with other cards) or close the account. I will decide later which I will do, but most likely lose those few remaining points and close that account. As of now, I am okay with BOA but have a problem with the way they "sold me" the World Points account.
you have to read the term and condition when u sign up. points have an experation date. check u other cards ...

This bank is horrible. I filed to modify my mortgage over a year ago and they still haven't processed it. I call and if I do get through to someone they tell me i have to go through a bank manager they can't give me information. when ever i try to call the manager they rarely ever pick up and if they do they say my account is in review. I finally went to a lawyer and they looked over my paperwork and saw that what bank of america is doing is taking peoples money and putting it in suspension accounts. it doesn't even get applied to your principal every month and then you get all types of fees added to your account because since they put this money in this account they make it seem like your behind on your payments. I don't understand why they do this to people that actually make there payments. there basically trying to force you into foreclosure like if any one else is going to buy the house at the overpriced mortgage that people like me paid when the market was high. why doesn't Obama do something about this because I know bank of america is one of the banks that got millions in government funds for the purpose of HELPING people keep their homes not to force them into foreclosure and rob them blind.

three times now i have paid my credit card bill into a bank of america.the payment has been made on the due date but the money has not been posted untill 3 days later making me suffer a late payment fee of $39 plus a raising of my interest rate. when i raise the issue at customer service their reply is always this is the way we do business.surely this is fraud? my issue is when i go in the bank and pay my credit card on the 1st of the month,why do they stamp my receipt for the 3rd of the month?

back in 2004 bank of america let my wife at the time now my ex-wife deposit 6500.00 into her bank account without my knowledge or approval and now i'm going to be held responsible for it. very poor buisness practices for such a large corporation not to mention the were one of the banks that were bailed out by the taxpayers but still hand out triple figure bonuses for there executives
Bank of America allowed someone to open a checking account online using my name and social security number. They didn't even require anyone to come inside a branch and show ID or sign any paperwork. They issued a debit card for the account and mailed starter checks. All with NO verification. Luckily the crooks used my address so I caught it very quickly when I began receiving mail from Bank of America.
Bank of America frauded my copies of my account statements that they sent to my home that I listed. They even tried to fraud me thru my Alaska Airlines Platinum Plus credit card. [protected]. Exp. 09/09 Mileage Plan number [protected]. I dont know how to explain this because this ### is so crazy that i want to [censored]. my interest rate is 49% I havent used this card since 2007. So last week I logged on to the Alaska Airlines/Horizen Air site plugged in my mileage plan number and boom my name showed up (weired) and I have 33, 000 frequent flyer miles someone or bank employee took 12 trips tied to this card from 2008 to the last trip on 9/30/2009. What am I to do... Just take it up the rear and die...
In summary, I was the victim of bank account fraud five years ago. I worked with Bank of America to credit back my account and open a new account. Five years later the bank abruptly closed my account based only on the fact that they closed an account in the past as a result of fraud. On top of this, they charged my account $50 before refunding my balance.
I live in Seattle, WA and in 2005 I discovered a withdrawal from my Bank of America account from a bank machine in Alabama. I contacted Bank of America and they informed me that my mailing address was changed to an Alabama address in their system. Understanding that I had not been to Alabama and did not live there, the bank worked with me to close the account and create a new account for me. They credited my account and that was the last I heard about it, until now.
Over the next five years we were very good banking customers. We conduct most banking electronically; we did not run overdrafts, owned a premium credit card and even owned a savings CD. In 2010 we opened new business checking and savings accounts. Bank of America also issued us a business credit card. Everything seemed fine as we started using the account for a new business. About two months later, we received a letter in the mail concerning the business accounts.
The letter we received said that Bank of America has elected to close your account in accordance with the provisions of our Deposit Agreement and disclosures provided. It then stated that Bank of America may report the account to Chex Systems, Inc., an account verification service. This may adversely impact your ability to open an account at another financial institution for up to five years. While the letter included a phone number for the Risk Identification Center, it provided no explanation for the account closure.
Instead of calling the phone number, I decided to go into my local bank branch. The banking center manager told me there was nothing wrong with any of my accounts and did not know why the new business account would have been closed. The manager contacted the Bank of America Risk Identification Center and was told that the reason for the closure was due to a 2005 incident involving electronic transfers. They had no more information except to say that any time an account is closed by the Risk Identification department, the customer can no longer conduct business with Bank of America.
After I explained the 2005 event to the Risk representative he told the bank branch manager that she could try escalating the matter. Two days later I received a voice message from the manager apologizing for the policy, but that the bank could not reinstate may account. After getting the message, I paid a visit to the manager again.
She told me that the Risk Identification department has only been around for a couple years and was not even in existence when this episode happened. She asked if I had any paperwork about this incident from 2005 and I told her that Bank of America should have everything already. She stated that management would look at and consider any information I could provide about the 2005 incident. Apparently, the bank has very little information from five years ago and is asking that I provide it. Bank of America handled the matter in 2005 and did not provide me with any follow up correspondence as to the details after I reported it. She then stated that there was no risk to any of my personal accounts, the accounts I re-established in 2005.
I decided to call the Risk Identification department again to double-check if there were any other reasons for closing an account in good standing. The woman on the phone confirmed that the only reason for closing the account was the event in 2005. She reiterated that it is their policy to close all customer accounts no matter the reason, if the Risk department initiated the close. I told her that in 2005 I contacted Bank of America and worked with them to close the account and reopen a new one. She could not confirm anything in regards to the matter except the bank policy. She didnt seem to have any information about the event.
Also interesting is that the representative had no idea about the other accounts I had at Bank of America (not even the personal account I re-established in 2005). When I mentioned it, she looked up my account numbers and said that these may be in the process of closure as well.
With policies like this, Bank of America is passing the blame for security breaches to their customers. When this happens, the bank will blame you even if you are not the cause for the fraud affecting your account. In these circumstances, the Bank of America will close your accounts with no warning, post a notice on the Chex system for all banks to view and will even charge you a $50 fee to thank you for doing business with them.
In The Best Interest Of The Child
I am not sure how to classify this blog so I will just call it a vacation gone bad. And I guess I should tell you my trip is being hosted by the US Embassy in Manila and my former US bank. And if you are planning a trip overseas this story may save your life or at least your bank account. I guess I will call my old bank Bank Of Amerikano. I have had too many blogs deleted or taken out of browser search in the past to use their real name. There are dozens out there but good luck finding them without a direct link. Anyway on with the story.
It is now January 2005 and I was busy with the last details of my wedding trip to Tabaco City, Philippines. And as anyone needs to do before taking such a trip, I called Bank of Amerikano to tell them of my upcoming plans. I also talked about my concerns about being able to access my Social Security Disability payments while being abroad. It was explained by a very kind customer service lady which atms I should use and she explained that using machines with certain symbols would avoid any excessive service fees. She then assured me I would have no problems and if I did, I could contact them via their 800 number.. At the end of our conversation I told her that I had no idea of how long I would be staying in the Philippines. But I assured her that I would contact the bank when I had an address to give them. So anyway I left the US in January 2005. I Arrived in Manila nervous as hell about a wide range of issues but at least I was secure in the knowledge that I had a guaranteed income. Here in the Philippines a small payment even like SSD makes you rich. Honestly I was kind of hoping that if it was cool here I would stay. At least until my wife's Visa was done. My wife Bless and I were married on February tenth 2005 and life was great. But like many new marriages some times there is trouble with in laws.
And I was learning my in laws had bad affiliations with many criminal elements such as the NPA.(New Peoples Army) One brother in law is being sought after by the military. A sister in law who still resides in Tabaco is involved in much of the local street crime, scamming Americans via the Internet and is well connected from a former job as a reporter. Another sister in law is wanted by the Philippine government for embezzlement and is currently living in Saudi Arabia on a fraudulent passport. And between the lot of them they claim to have connections with bank managers, mayors, and the former Governor of Albay, not to mention local judges and many police officials. And from what I have seen at least parts of their claims are true. I had one major argument with my mother in law when she said she would like to shake Osama's hand. But then saying it's her life's dream to go to America. This was the last time I would see her until, the birth of our child.
Anyway we rented a big house and started to plan our lives. And due to our family problems we planned on leaving Tabaco City as soon as possible. Little did we know, February would be the last time I would see a full SSD payment. From that point forward half or more of my payments went missing from my account for the next 15 months. Money was being stolen even from a negative balance month after month. In the US it was not possible to overdraft an account solely by ATM transactions. Come on bank how could you let that happen? Well anyway, back to my trip.
We then learned of the happy news that my wife was pregnant and I was taking very ill. This condition worsened during the months that followed. But even through such hardship we got by. You can only ask my wife how. But things like going to Manila and keeping my visa up to date were just not possible. And good luck trying to save money for a baby on the way. Yes we got by living in complete poverty. We even lived in a house that got condemned and trust me condemned is a much different standard in the Philippines than in the US.
Life went on like this until two days before my daughter was born. And thats when my sister in law showed up after many months, raising concerns about my wifes pregnancy. She then talked us into going to a hospital by the name of Jaime B. Berces Memorial Hospital because the administrator is a close friend of hers. If only we stuck with our OBs' instructions.
So we went with my sister in law to her friends hospital and several hours later my wife gave birth by emergency c-section. Do you know what its like to hold your child for the very first time? The pride, the joy, that pure sweet emotion that just can't be put into words. I don't care how long you went to school or how many words you know. You just can't. And for that short time all my problems were forgotten. Little did I know that 3 days later my baby girl would be taken as collateral on a the hospital bill. And the word collateral is being more than polite. .We were prisoners, armed guards and the works. I could fill a book of the events that took place but suffice it to say that four days later I would be on the floor in the fetal position crying like a newborn myself because I had no idea where my wife and kid were.
The main players at the hospital were the hospital administrator, my mother and sister in law's working for a darker end. My sister in law, Cresther, who is in Saudi can only tell you what that is. The hospital administrator and my in laws worked in tandem using threats and blackmail trying to get me to leave or pay extortion money in order to keep from being deported. But their deepest wish was to change my daughter's birth certificate so they can ship her to Saudi. Then Cresther can gain inheritance from her dying husband. Under Saudi law, I've been told, she cannot inherit any money when she has no children. Also my daughter is worth a lot of money in arranged marriages. For those of you who do not know human trafficking and kidnap for ransom, they are big business in the Philippines. And she needs money in a bad way. Once her husband dies she will have some serious immigration problems of her own.
The events around the hospital lasted about two weeks but in reality we were kind of prisoners for the next year. It's hard to escape when you do not know who the guards are. We could not even go to the store with out getting a text telling us they knew we went out and where. We even got a text demanding to know what the fed ex guy delivered when my daughters passport came. We were in shock most of the time and were lucky to just be able to raise a healthy baby. We were able to learn that my daughter was entitled to get benefits through SSA so we applied over the phone to SSA office in Manila. They sent an investigator to our home in February 2006. We told Alex Eusebio the whole story of my payments being stolen even to that day and what happened at the hospital. He acted like it was all nothing. He wrote down nothing in regards to what we were trying to report. He just did what he came to do and left. Not acknowledging any of the things we have said. We were shocked by that. Reinforcing what was planted in our minds that our situation was nothing.
I posted letters to my Washington senators on their web sites. All I can say on that, is I hope you did not vote for them this last time. Now the bill in question was less than 1000 US dollars. And to add insult to even further injury, our last 200 dollars went missing from my bank while my wife was giving birth .
Then in September Typhoon Milenyo came and destroyed the house we were living in. We took all the money we had and fled to the Embassy in Manila when the roads cleared, fearing that my in laws would make another attempt on our daughter. And the word on the streets were not good for us. So we spent a week getting passed from window to window. Homeland Security said my wife cannot get asylum because I am American. Hmm how about a little consideration then. They could give us special circumstances under our situation. But I guess one would be willing to take a report someplace. The Social Security Administration said they sent my full benefit amount and their responsibility ends there. But they track down lost checks whats the difference? And never mind the fact I reported the thefts many times and they did not even stop the deposits from going in to my hemorrhaeging account. Even though I had a safe account already set up. For some reason it took three months to update their records. And when I tried to complain they explained how that would be giving me special treatment and I would basically have to wait like every body else..
American Citizens Services told me I can take my daughter to America any time. I then asked him what about my wife. The guy looked me straight in the eye with a smile and said “what about her” He was the only American I got to see at the US embassy. And my wife was standing right there and then burst into tears. I was never ashamed of my country until that very moment. He then passed our case off to a lower worker. Who then gave us the Tabaco City police telephone number. Did I mention that Tabaco City was in a state of calamity because of the typhoon? Never mind the fact that my in laws have many contacts at that office. What do you think they could do about Bank of Amerikano? We also went to the Bank of Amerikano in Manila. All they would say is that they only handle corporate accounts and they will not discuss my account. And when I grew frustrated with them they threw us out. No one cares that a traveler can have his bank account fleeced every time he puts his Visa Check card in the machine then be held hostage and be trapped at his vacation destination for what looks like very possibly the rest of our lives. It seems like someone should care just a bit. I guess US government wants to track all the other people's money but are not concerned to whathappens to US treasury money. At least they could have picked up a pencil ...any of them. They sent us to the wolves, broke, homeless and tired.
While in Manila we also sent a battery of letters to the bank, both my Washington senators (again), Fox News, and Bill O'Reilly and the Senate Committee on Veterans Affairs, Senate Committee on Banking and Finance and Vice President Cheney, US Ambassador Kristie Kenney, Mike Enriquez of GMA-7, Julius Babao of ABS-CBN and many more. Out of all the people I mentioned the Senate Committee on Veterans Affairs, Senate Committee on Banking and Finance and Vice President Cheney were the only respondents. They requested our mailing address but unfortunately at that time we did not have any address to give. Our house was just destroyed by super Typhoon Milenyo and we had just fled to Manila for help. We responded to the vice presidents intern Rose Folsom once again stating we had no address and that we were in serious danger. I guess they did not feel a need to respond to our many pleas. Several letters later Rose Folsom did send an email requesting I take her off my contact list. I have the dated letters of most of the people we contacted and it is a very long list.
With no more options we took the bus for what was left of our home. In the month that followed, my baby girl got very sick and lost much weight due to us not being able to buy her milk. But the following payday with my payments safe in a bank other than Bank of Amerikano, life has potential once again. Then in November, Typhoon Reming came and hit us dead on. We were in the stone age for two months.
So I even contacted my mother Marjorie residing in Kailua Kona Hawaii. I have not had any contact with her since Clinton's famous first term. She seemed happy to hear she has a granddaughter but she was too busy on her two books, Donna Quixote cartoons and condo meetings to even call one person on our behalf. Guideposts must be happy to have such a good Christian as a writer.
My brother sends me angry letters because I was mad at my mother. He says that I am crazy and only seeking attention. And I have no right to play the victim. He then tries to convince my wife the whole thing never happened and I need to get some medication. He then tells me how he is bigger than me now and he wants to kick my ###. I guess he wants to go on Jerry Springer.Mom if you are reading, I hope you finally understand me. I tried to work all this out with you. And you even cut the line with your own very sweet grandchild. As long as we live our lives wrapped up in ourselves, closed off to all other points of view, how can anyone say they are fair? Now being betrayed by even my own family, our mess remains and my daughter is still not completely safe. If I do nothing, I may have a shot of living a long life here. But that seems foolish. People may still be after my daughter. I have made multiple contacts to Bank of Amerikano via email. They said sorry to hear of your problems. The security of my account is important to them and to please join their online banking. The problem with that is I already told them, that option for what ever reason has never worked. Page cannot be displayed.
And people don't fool yourselves by thinking that registering with the embassy will help you. Hell their web site does not even have a contact us. So if you have no family to contact you are truly screwed. Did you know they take Columbus Day off? That was another day in Manila completely in the crapper. But I have to hand it to them; they have the best flushing toilets in the country. And it's not just me folks. I have seen other Americans in various banks holding their Bank cards with the Visa Logo in hand trying to get their own answers as to where their money went.
Day before yesterday my wife met another American guy and the same thing happened to him but in his case for two years. Different results but you can overlay our embassy stories. He called them after Typhoon Reming to ask help for himself, his wife and three kids. Of course they did not even offer him a slice of bread. Come on embassy, how about a little help for a foreigner?
There was a time that Americans would rally to the cause of one of its infant children. But that has all changed now. Our own press only rallies to the aid of the rich. It is not good business to do a story that will hurt one of its sponsors. I think Bank of Amerikano and Visa has advertising and sponsorships in all of the main stream media. Its hard to watch a US sporting event without seeing their blue and red logo some place in the stadium. And its the same with web sites.
After so much time I have given up on the bank ever doing the right thing. I have managed to fix my visa problems but bringing my wife to the US is impossible as it stands now. Because of Bank Of Amerikano's neglect, I have lost all ties in the US. And with out an address the embassy requires 60, 000 dollars in my bank account or a co-signer in the US before they would even consider a visa for my wife. And for me to go back to US to get established and apply for my wife, would take at least 10 years before I could even apply for her visa. Lets get real I have been on disability a long time and I have no work history for the last four years. In todays economy I would be lucky not to wind up on the streets after getting off the plane.
So I guess we will make the best of life here. What other choice do I have? It is my hope that one day this blog will pass the eyes of someone who can help on any aspect of our problems. It seems finding people who, it is not in their best interest to do nothing is very hard. If you want to help and do not know what to do perhaps send an email to anyone who you think may be interested in our story. Hell it would make a good book. Or at the very least pass this page to a friend and tell them to do the same. This, after all, is a fairly simple matter with road blocks every place. Whatever happened to what was in the best interest of a child. I wonder when that measuring tool for moral decisions in a moral society changed?
After more than a year of dealing with sheer hell of Bank of America hijacking my life, me, a faithful customer with excellent credit rating, who never missed a payment with them, of BOA trying to force me into foreclosure when they realized how quickly I was paying my mortgage and at the same time messing up my excellent credit score, I came online to post and found numerous websites with literally thousands of victims of BOA who have similar and other stories of being raped by BOA. Too often the victim takes the abuse and lets go of their rightful money and property because they feel like "just a little person." There is no such thing. I am not a little person, and neither are you. Plus, there is great power in numbers. Without its customers, there would be no BOA. Instead of talking about class action suit, let's do it. i had paid my monthly mortgage and the money was even debitted from my account
but the money was lost by the bank, but they started charging me late fee and harrassing me for a repeat payment.
when i called the bank with proof of payment and the debit from my account, they referred me to the research department.
they promised to look into the matter and stop the creditors calls and refund the late fee.
the following month my statement included double the payment plus the late charges with interest
i ccalled again and they said that they would look into that.
creditors ccontinued to harrass me.
this continued for subsequent months - for a period of 5 months during which time i spend atleast 3 hours a week talking to the morgage .
no one in the mortage department would give their last name.
finally they traced money and apparently resolved the issue, only to get the mortgage statement including a late fee of 402 dollars saying i had not paid it
i already have 3 mortgages with them, that was fraudulently given to me with misrepresentation and over and above that, they are continuing to harrass me,
i have just contacted an attorney to help me through this ordeal
please do not go to BOA for any of your mortgages or even banking.

So it turns out Bank of America charges 45USD for a Intl. transfer. This I knew.
Then BofA secretly charges BCR (Banco Costa Rica) a "Transfer Initiated Fee", (25USD) in this case, and BCR has the option of paying that themselves or deducting it from my transfer. It was deducted from my transfer.
Bof A is clearly in the wrong here, because the client (me) is only aware of this fraud, after the funds have been stolen.

on 5/09/12 i recieved a call from someone named sandra [protected]) she said i was appoved for a goverment grant for 50, 000 dollars, that her superviser would call me the next day before 12 noon i recieved that call from [protected]) on 5/10/12 when i spoke to him he said they would send 40, 300 through westernunoion and the remaining balance would go to my account. the superviser then instructed me to go to westernunion with 300 dollars for a security deposit to release the money. the 300 was sent to a daniel peter after sending the money through westernunion i received another call while still in the store from a representitive from bank of america([protected]) she told me to give her the money transfer control number after i gave her the number she told me she would call me right back with the info for the 40, 300 she had to release the money through to westernunion i got a call back but it was from the superviser who i had spoke to previously he tells me that she the rep had just sent him an email saying they were unable to release the money today because they were backed up with handling other clients they were very sorry that they would have to release the money the next day and give me a call 8am 5/11/12to let me know that i can pick up the money.while on the phone the superviser says i needed to pay 200 for them to break the money down the money is there but westernunion will not give you the money in a lum sum so it has to be broke down in 6 payments of 8, 000 .that 200 was sent to jaba suresh and again the same rep from bank of america called me while in the store again i gave her the money transfer control number and she gives me 5 money transfer control numbers and the senders info, and ended the call .while still in the westernunion i try ed 3 of the control numbers and non of them were right i called westernunion myself they said they did not have any money on hold for me lakieda hall

What happened to Customer Service? I would think that BofA would have better service. I have been a customer for 10+ years and I cannot wait to go and close my accounts. I was told that there was no reason to speak with a Supervisor as "authority couldn't do anything for me". I had to demand to speak with a Supervisor 12x's before I was transferred. Then when I did get to her, she told me she would take care of something that today they tell me she didn't make any notes of. In fact, the system showed that I couldn't verify my account, so I must have not spoken with anyone. Today, after speaking to another so-called Supervisor, when I asked to speak to someone who could help me, she stated that there was nobody else for me to talk to. Nobody in the whole flipping company?

Hi, yes i have applied for home modification 2 1/2 yrs ago what a joke...we have filled out all of the paper work they wanted they can never find it ... no one answers your call... calls u back @ the right number we have 3 phone numbers to be reached @ then they send us a fedex letter stating that they have made many failed attempts to contact us from a man i never heard of reserved the letter on june 28th 2011 and i had till july 1st or this matter would be closed hum hum...guess what know one answered there phone calls back when you leave message ...they say my escrow is in the negative the funny thing about that is i never had one to begin with...when we bought the house 7yrs ago i pay all that and we'rer in good standing with everything payment is always on time house, taxes& insurance..the letters they send are not signed by anyone and from what these letter state if the amount due is not received by the specified due date foreclosure proceedings may begin or continue? I have been involved in a scam using Craigslist to book some accommodation for my holiday in New York. I have tried to contact Bank Of America to converse with them the bank details and the name of the person who was involved in the scam. They have not replied in over 2 weeks now and i am still keeping contact with the person involved in hope of running checks and finding out who they are and bringing them to justice. It would be nice if the Bank cared a little about their customers being frauds and wanting to shut them down, but they seem not to be worried. I have complete bank details and have run my own searches all the bank have to do is reply and give me some details to help my cause. I bet if i owed them $1380 them would come looking for me in a hurry.
I scheduled on online payment to BoA of $4300. On the scheduled day, BoA made TWO withdrawals from my external checking account of $4300 each.
I was out of the country and did not discover the effect on my checking account until a week later. When I called BoA, they said they'd correct their --admitted-- error, but it would take 8-10 business days to get my checking account credited. Their claim is that it takes that long to "go through the clearing house."
If I call to make a payment to BoA from my external checking account, they could get it in one day. Why should it take two weeks to process a refund through the same clearing house? I call this a scam or an intentional deal with the clearing house to hold on to my money.

Why it is legal for Bank of America to charge us for Lender Placed Flood Insurance that is back dated? When we can not purchase back dated insurance through the existing flood policy we have through the National Flood Insurance Program to comply with Bank of America's demands.
Bank of America has extorted $31.03 from us. We were forced to use them for our mortgage company when Countrywide Home Loans failed.
Bank of America's flood insurance requirements apparently are higher than Countrywide's or FEMA's National Flood Insurance Program. And since they are using this to extort money from their newly acquired customers; they do not notify the new customers that they have this higher requirement.
The problem occurred when we purchased a higher replacement cost home insurance policy. Our home insurance policy expires January 29 and our flood insurance policy expires on June 29 every year. We have never missed or been late on paying either. We even exceeded the NFIP's guidelines using the higher replacement cost valve figured on the new policy.
We received a letter from Bank of America dated 02/17/10 claiming we owed additional flood insurance. We purchased the additional amount of insurance from Hartford 02/26/10 at a cost of $8 for 93 days (3/28/10 to 6/29/10) verses $31.03 for 57 days (1/29/10 to 3/27/10). And please note that from the date they wrote the letter until the date I paid for the additional coverage is only nine days. The letter was not sent next day delivery it was sent regular mail. So we took care of this in a timely manner.
Bank of America's letter instructed us to purchase the additional coverage for the period of 1/29/10 to 1/29/11 by 4/7/10. They knew we have our flood insurance through the NFIP with Hartford Insurance. They should know it is illegal to back date the additional insurance on our existing policy and knew we would have to wait 30 days for the additional insurance to take effect since that is a requirement of the NFIP that Hartford Insurance has to comply with. Also, they knew our flood insurance policy wouldn't expire until June 29, 10. Why would Bank of America require us to change the normal expiration date of our existing flood policy?
Also they knew they could extort the cost of the back dated coverage since they can conveniently get backdated coverage through their private insurance company and we can not with the existing NFIP policy we held. And we are sure they were probably hoping we would wait until the 4/7/10 deadline they gave us to comply so they could extort more money from us.
I'm appalled that the WYO is being used to scam innocent people like us. We have always paid our payments on time. We usually chose the upgrades in the Flood Insurance when offered, until this year. We would like to show FEMA just how we feel about them contributing to Bank of America's scam by never paying the upgrade cost of a flood policy again. We'll also never accept an offer for more replacement cost home coverage at a lower cost again or at least not as long as we have Bank of America as our mortgage company. So if it was FEMA, NFIP, and Bank of America's intention to create distrust and lose revenue then they have succeeded.
FEMA and the NFIP were right to hold all the participating insurance companies to high standards so policies would be honest and fair; so why let banks scam people with the WYO, who use the very fact that NFIP flood policy holders are held to rules that make it impossible to protect themselves from the money making schemes created by these greedy banks like Bank of America?
Please stop banks from using this practice. We would like to have faith in our country and its programs like FEMA and the NFIP, but it is hard when they give power of this kind to a greedy bank to use in this manner. Don't let Bank of America or any other banks get away with this kind of extortion.
I have a VISA credit card issued by Bank of America and used it to purchase foreign currency from a foreign currency exchange service in Birmingham, MI.
Bank of America treated this as a cash advance and charged me a hefty transaction fee of 4 % PLUS interest on "cash advance".
I explained to Bank of America that this was a regular purchase, i.e. the exchange rate charged by the foreign currency exchange service includes their profit. Bank of America is unwilling to refund these charges, the merchant claims he processed a regular credit card transaction (although his web site did not mention the possibility of such extra transaction fees).
I feel this is another example of credit card issuers taking advantage of customers by charging transaction fees on purchases that they deem to be cash equivalent, whereas customers think this is an ordinary purchase.
Mortgage increases with their so called cushion. They raised my mortgage $45.00 for a $60.00 escrow shortage. they call it cushion. They add the $60.00 shortage plus hike up $45.00 more for cushion. Bull crap BOA hard times are here and you do nothing to help it. this is not the first time this has happened. this is the 3rd time in one year. a total of $85.00 for cushion. and when you ask to waive for hardship they claim to remove but guess what STILL THERE HELLO. My husband and I are retired military. My husband is disabled due to a brain injury in Iraq. This is an account of how Bank of America uses the making home affordable program as a scam to get your home. It started when my husband had retired, his disability income had not come in yet and we were having difficulty making our monthly mortgage payments.
Though we were not behind, we talked to representatives at b of a and they suggested we apply for the making home affordable plan. For the next few months we faxed, fed ex'd, and phoned our information that they requested over 10 times. Also during that time they said I could no longer make my payments over the computer and that I would have to either mail in or phone in my payments. So each month, I would call in, ask what I needed to pay, and they would give me a figure which I would then give them my debit card info. For a few months they advised me that I needed to make trial payments which were $200 less than my regular mortgage payment. After a few months they started to inform me that I was behind. So I began to call every 2 weeks as they instructed to get a status and was told that I was behind due to them putting the partial payment into a holding account. However, when they started telling me that I was behind I started making my regular loan payment amount plus extra to make up the past due amount. Then we got a call saying that we were in foreclosure and that they could sell our home as early as the next morning. Scared I made some phone calls and got hooked up with Nova Debt. After speaking with them and having the representative from b of a on a 3 way call...we got the run around some more, they kept telling us conflicting information, but then assured me that I was not in foreclosure and that if I continued to make my regular monthly payments plus extra to chip away at the past due, I would not go into foreclosure.
Well, that was last month. As of 1/25/11 I was informed that my home had gone into foreclosure and they would not accept anything from me other than the total amount past due plus lawyer fee's and that they would have to order those figures and will fax them to me in 3 business days. So basically, after working with b of a for 1 year, calling each month, doing as they instructed, and never getting the same information twice, I am now in foreclosure and have to come up with a large sum of money next week to keep my home. This is very disturbing to me that they would treat one of our nation's disabled vets is such a dishonest manner. Keep in mind that we never missed a single months payment and only did what they instructed us to do and now they are trying to take a home away from a retired vet with a brain injury. B of A has left a really bad taste in my mouth and the fact that they are using the making home affordable plan as a front to steal from honest Americans and take their homes from them is extremely foul on so many levels. I have been in that process for over 2 years. Send the documents over and over and over. Then declined for not sending them. It is a joke. They do not care about there customers period. I have one mtg with bank of america, and a loan with teachers federal credit union that is attached to my house.I went thru the whole process pictures and all the steps after 7 months I’m now told that the 2nd loan took a loss and charged off the loan. I also filed bankruptcy 2yrs ago and everything but my bac mtg was discharged in the bankruptcy. Because of this Bank of america denied my deed in lieu. I told them right in the beginning when I called them after I received all of the paperwork and told them.
My son attempted loan modification THREE TIMES….it was always kicked back for some stupid reason and he had to start the process all over again because of the length of time it took on BOA’s part. during one of those periods where it got kicked back and my son redoing all the paperwork BOA filed foreclosure papers. Third time was the charm (after almost a year!) and the modification finally went through…foreclosure cancelled.
THEN HE GOT A NOTICE THIS WEEK….pay $5000 in attorney’s fees or we start foreclosure and they want it immediately. they will only spread the payments into three payment and he has to keep his account current. he works a full time job, is going to school full time, he and his wife had a baby 3 months ago, his wife works and they are staying ahead of the curve but barely because of his travel expenses to get to school every day (80/day one way). I went to Bank of America to obtain signature guarantee for a document that I had to submit to Fidelity Investments. This is something I had done many times in the past at their Mission San Jose branch with no prior problems. We had banked there for more than 20 years. But this time, I made the mistake of going to their Warm Spring branch office. The branch manager there was named Quenby Fong. She was ready and eager to say NO to anything I asked for.
She first claimed she had did not know what a Defined Benefit Plan was and therefore, she could not provide signature guarantee on my document. I explained that a defined benefit plan is similar to a 401K program. Then she said she did not do signature guarantees but she could only do Medellion signature guarantee. Then I said I did not care which one I got and whichever one she could do, I would request for that. Then she finally came back and said she would not do any signature guarantee. I finally gave up asking her for assistance.
About an hour later, I made another trip to Bank of America Mission San Jose branch. The branch manager, Lily Tang, was very helpful. She explained that I needed to bring an account statement from Fidelity before she could provide me with the signature guarantee. Luckily, there was a UPS store next door. I went there to use the internet connection and printed out an account statement immediately. Lily Tang gave me the signature guarantee within 5 minutes.
The branch manager (Quenby Fong) at Warm Springs branch of Bank of America was determined NOT to help me and came up with excuse after excuse to discourage my request. With this type of attitude, she should have found other lines of work so that she could be happier at what she does.

I am a senior citizen who In November 2008 got a mortgage loan with country wide and the loan agent forged my signature on additional loan applications changing my 30yr. Fixed with payment amount $1480 to $2330 dollars after feeling pinched to make the payment BoA incurred the loan willing knowing after OCC report suspicious of fraud then BoA said I had the loan before they brought it from country wide an it’s not there problem and continuous to deny all modification request and when I write to them inquiring about the reason for the denial ….
I get no written response back. I have been in the review process for two years waiting to receive a Home Alternativ FORECLOSURE package after six months of waiting for it, I found out by getting a consumer advocate involved that the Home Alternative package was never sent out and my account went into the Foreclosure department. I never receive any information addressing me being declined or notice to accelerate the account, or even a notice of default. On February 6 2011 I received a debt collection letter from reconstrust, then the trustees sale notice came Foreclosure sell on June 6 2011.
If it had not being for the help of a four year college student help me by fighting the Foreclosure process I would be out of my home. Bank of America had denied me postponments and have schedule a sell date for 12/21/11 knowing that there is a discrepancy in the loans.
My mortgage servicer promised a refinance with principle reduction over a year ago. The bank has sent an appraiser to my home twice but they keep expiring. At the end of every month I get a desperate call to make the payment which I make after more promises. They get me to send pay stubs and bank statements and promise to get it done before end of month. In May I got an email stating I don't have to pay if they don't complete modification but I had to make payment. In July I was promised a principle reduction because they hadn't completed refinance. I had to make payment in order to proceed but was promised it would be complete in 15 days. I didn't get anything but a call on the last day of the month which I ignored. Every month for over a year they at least waived the late fee. Now it seems like I was being called by a boiler room full of people just to string me along. Do I have any recourse.

car loan delayed payment
I decided to pay off my car loan and delayed the last payment while I liquidated some assets to pay off my loan completely. I called Bank of America and advised them of my intention and to let them know that my payment would be late. I was able to make a payment before I paid off the entire loan. Although Bank of America had received the payment, they sent someone knocking on my door. This is the second time I've been late on my loan for the past 3 and half year (last time was a mistake) and they send someone to knock on my home to hand a debt collection letter. I am glad I won't have to deal with them again, but what this bank has done is irresponsible/bully behavior. If you have an account with this bank, I recommend either not using (if credit) or closing (if bank account). The bank seems to be on it's last legs.
duplicate foreclosure-failure to investigate
I am at my wits end because I can't stop a foreclosure of a property I once had a loan for that was already foreclosed in 2009. I even have the 1099-A form from the federal national mortgage association stating they acquired the property on September 15, 2009 and I have written this property off in my taxes. I had been current on the HOA dues and had a manager active until they foreclosed. Then, a few months ago, I got four certified letters on the same day saying they were going to foreclose on this same AZ property. The title was left in my name it seems so they are foreclosing again! Someone made a mistake but I relied upon the information of the bank and the final disposition given for my taxes so it is unfair to come after me three years later to start it all up again. I wrote about 20 letters and faxes right up to the CEO and I can't get someone in B of A to do anything to put the sale on hold pending investigation. My assigned rep says she is "looking into it" something she has been saying for weeks or months and she sends letters asking if I want a loan mod. I think I am getting a total run around and it is like a steam roller coming down on me. They seem like they could care less. Meanwhile someone at the complex says a man came with keys, lived there for nearly two years and left saying that he bought it at auction but there were title issues. It is in my name apparently by mistake and the way they want to fix it is foreclose! I am out of my mind about this. Any help or ideas are appreciated.
this is the worst company ever
During June 2011 I feel behind on my mortgage because of because of car repairs and Bank of America called me everyday about six or more times per day harassing me about making a payment. After constant calling I requested a loan modification and the representative took my information over the phone and said I qualified for a modification. She also provided me with a list documents need for further processing and said I will receive a letter outline and confirming the necessary documents.
Shortly after I receive the letter I faxed the documents and a representative confirmed she received them. About one month past so I started calling to find out what my next step was and to see if what or if I should be making payments.
Each time I called the call was routed to an “Account Manager” voice mail that never returned called. After about a week of none responses, I started leaving about 6-7 messages per day and still no response. I reached out by calling other departments that routed me back to the modification department and everyone was nice but consistently lied to me and never returning my calls or resolving my issues.
I finally spoke with a few managers and supervisor that seemed to all read from the same script, “I so sorry this happened to you but I will contact and email your account manager, his manager, and copy my manager”. Every single manager and supervisor said the same exact thing and nothing was resolved.
With my constant determination I still constantly called trying to find out the status. Finally I was able to call to other departments to be routed to the modification department and speak to someone that told me my application was denied because someone noted in the system I was unreachable. I was so upset I cried to know that my livelihood is at stake and someone just lied just to deny me receiving help.
I never faced this before with Bank of America before the merger. This is the worst company ever! All I asked for was a chance to get back on track with my mortgage payments. No chance of that now.

As long as we are approaching them one by one, they can act like we're isolated cases and blow us off. I've been fighting them the past 4 yrs by myself. A.) They received bail out money which was supposed to go to modify loans.

C) Plus the banks get to keep the houses and resale them & pocketing all the money received from each home

Yes BOA scammed me too and would not allow me to negotiate anything because my house was in my deceased wife's name. The told me I had to go thru the probate court process and would not discuss the loan with me at all. When I was making payments on time it was all good but it was clear they felt like they had me in a corner. They could have easily put the deed of trust in my name if they wanted to. I had credit card companies and

I am one of those victims of Bank of America's illegal practice of mortgage foreclosure. I have had my mortgage with BofA since 2004. I was forced into an early retirement in 2006 and being without a job, I decided to file for a Loan Modification in 2009 to lower my monthly payments and that was the beginning of my nightmare with BofA. So far, I went through 2 different Trial Payments and finally a permanent loan modification. I NEVER missed nor defaulted on my mortgage payments NEVER. Two days ago, I received a CERTIFIED letter from BofAmerica claiming that I am $19, 000 behind and they are filing for foreclosure. When I called them for an explanation, I was told that they made a mistake and Yes they have received my payments but theY FAILED TO APPLY THE MONEY TOWARDS my mortgage payments. Yes that is illegal and unethical - what do I do? Who do I contact for justice? I am 68 years old and have worked very hard to purchase my house ($20, 000 down). This is supposed to be my retirement home to spend my golder years and BofAmerica is attempting to take my house from me while my payments are current. I am sad and disappointed and distressed and fighting BofAmerica is a Losing fight. Please tell me how this can be resolved.
Early in 2012 I applied for a home loan modification with BOA. I was told by them that I did not qualify for a loan modification because I was not behind on payments. I was told to stop making payments so I could receive assistance. I worked with a counselor at BOA Sean Killian (who is no longer employed there). I have transmission logs dated 7/26/12 of faxes that I sent to BOA. Sean told me numerous times that he had not received my information even though I have the logs to prove that it was sent. I had a letter fedex'ed dated Sep 20 2012 received Sep 21 2012 to me from BOA stating that "We are unable to offer you a modification because you did no sign and return the modification agreement that we had sent you more than 30 days ago". I have looked up what this is and also told by the hope hotline agent Erica Correa that this is stating that Bank of America had sent me a loan modification agreement and terms but I did not sign and return this documentation. I have never received any such documentation and can prove that I have not through UPS, Fedex, and USPS. Various representatives at Bank of America have told me that they sent this documentation. However when I ask them to provide a date sent and a tracking number they always tell me X department handles that. They transfer me somewhere else where I have to start all over. The only thing I have received from BOA is that my account is delinquent and I need to contact them. When I first received this Sean Killian advised me that this is normal and its just an automatic letter that is sent when someone misses a payment. On Feb 14 2013 I called BOA again and was told that my home is in foreclosure and has been since Sept 2012. I have never received anything from BOA that is showing my home is in foreclosure. They state they have sent me a notice of intent for foreclosure. When asked to provide proof of this they are unable to. Then they tell me that the letter I have is a foreclosure notice. But it just says to contact them because my account is delinquent, which told by Sean Killian this is normal. Now another rep of BOA is telling me that my home wasnt in foreclosure since September but actually since February. So they can't even agree when I have been placed in foreclosure. I was recently laid off of work in November. Talking to a rep Feb 16 2013 I was informed that I do not qualify for BOA's unemployment assistance because it is only for homeowners who are 90 days or less behind on their payments. When the reason im so far behind on my payments is because I was advised by BOA to stop making my mortgage payment so that I could qualify for a loan modification. I believe this practice of "losing paperwork" and giving consumers the run around by BOA is not only unethical but illegal. Arizona has been hit very hard by the foreclosure crisis and BOA is doing everything it can to not help customers.
My second complaint is against the HOPE line (888 995 HOPE) that is cofunded by mortgage companies. I have called their line and when you call they have an automated recording stating if you feel you've been the victim of a loan scam to press 1. I hit 1. It connects me to someone who takes my information and gives me a reference number to put me on hold so they can transfer me to a "fraud specialist". This person then asks me if I have been the victim of 3rd party fraud. When I reiterate multiple times that I believe it is my lender who is actively participating in loan modification fraud. The agent then tells me they are unable to help me because its not 3rd party and they dont help with servicer fraud and are not able to provide me legal advice. I understand that since major banks are the primary funders of the hope hotline that they do not want to give out advice that would hurt their funding, however, this is the hotline you are advised to call by banks who are supposed to help you.
Everything I am claiming in this can be proved. I have numerous recorded phone calls to BOA, the hope hotline. I have documentation showing when I received items from BOA. The fax transmission log of my request for mortgage assistance.
I do not have the phone calls with Sean Killian recorded because I did not think I would need to record them. I have confirmed through multiple agents that these practices are regular of BOA. Particularly the part about "stop paying your mortgage so you can get a loan modification". The reason for my original loan modification request was that I had taken a 53% pay cut at work.
If this is illegal what type of lawyer would handle this? Consumer fraud? Mortgage foreclosure?
I hope this can be resolved before I am foreclosed upon.
Also for recording phone calls Arizona is a one party notification state. From what I can find I do not have to tell them that I am recording the phone call. However if I do I am told that "bank of america does not participate in recorded phone calls and if i do not advise them that I am turning the recorder off they have to disconnect the call". I tell them that I am not turning of my recorder and they hang up on me. I do not think it is right that they are able to record consumers but refuse to be recorded themselves. I am pretty positive im acting within the law but want to verify this.
I started a modification program because I forsaw a financial problem due to my change in employment. I began by faxing everything they requested, on a daily basis. They kept telling me it took 24hrs to show up in the system. I would call them daily, just to have them tell me, that it's not showing up in the system. I was having to refax documentation on a daily basis. On some days, I would have a representative tell, it's in there, then another one would tell me, they can't find it. They finally sent me a letter telling me that I was denied the modification because documentation was not sent in on time. I requested an appeal. all of a sudden, I stopped hearing from them. So, I retained an attorney. Now, BofA has started sending me letters, indicating they can help.
your company name is FRESH START -legal group with two lawyers?..please give me names and licence #..and when I asked for LIC# the customer service hang up! why are you posting here complaints when in reality you are scamming homeowners?.

We had our morgage bought out by Bank of America. Ever since our payment has never been the same as when we first bought the house. We have a fixed rate our taxes went down and our insurance went down and the payment keeps going up and they won't tell us why. Now we are struggling to make the payment each month and according to them we should get second jobs. What kind of bank does this?

I opened an account with Bank of America, I was appproved I recieved account numbers, debit card and checking account.. I haven't used this account yet. Its only been a week since I was appproved and have recieved all of the above items. I recieved a letter a couple days later saying that my account is closed. I called the same day I recieved letter and they said they don't have to give me a reason. Isn't this discrimination? How can you make other complaints on this bank?
I have never had a good encounter with Bank of America. No one at the branch has the authority to help you with anything except deposits...G_d forbid you ever have an actual question or fee on your account...they make it so difficult that you just eventually just give up! Had an incident in Dec 2011, where there was a fee on my account, they couldn't tell me how it got there or why it was there, told me to go into the branch same thing, neither the teller nor personal banker. Or manager could figure where the fee came from besides they said that they did not have the authority to reverse a fee...even though I had never had one before? Said I had to file a claim and someone would look into and get back to me by mail with two-three weeks...in the mean-time another fee was pending because I had not paid the unknown fee...? Since the incident in Dec 2011 at the Brea/State College local I have since received a letter stating that I will now be charged a $10.00 Fee if I do not make a monthly deposit of $1500.00 I had to call in again to see what my options were, not sure about you but, I do not have the luxury of leaving a balance of $1500.00 in my account every month just to avoid a $10.00 fee! SO the rep on the phone switched me to an ATM acct only...where you do all your banking through the ATM...That was in March 2012. Thinking everything was OK and taken care of by the previous rep, I tried to make a deposit today and the ATM would not take my transaction, After spending 45 mines on the phone with "Customer Service" and no closer to an answer, I had to go into the Branch where I was met with someone who asked for every single piece of my information yet again, but still couldn’t help me and put me back on the phone to customer service after speaking to yet another rep and a supervisor They still could not tell me why my account had been closed, they said that there were no notes on the account but a code stating that if the account had a low balance for 120 days that it would close, they could not tell me who put the code on the account or the date it was put on the account...had to open yet another claim to find out what the heck is going on at the Brea/state college branch...I can tell you what's not going on there...Customer Satisfaction or Service, ! I can't believe in this age that we still allow these financial institutions to bully us into paying their fees and require no customer service and satisfaction in return. What happened to the days where people united and refused to patron these kinds of establishments! If we do not complain when we are unjustly treated or do not receive the service that we deserve...It's your money, we can no longer let these financial institutions to take our hard earned money and bully us into staying with them just because...I encourage anyone and all to switch to a local Credit Union where they can help you on an individual basis, credit a fee once in awhile if you haven’t had one credited and for G_d sake give you great customer service without having to talk to 5 people in customer service before having to escalate to a Supervisor! If they have gotten too big and have lost their service aspect I suggest converting to a Credit Union that is still grateful for your loyalty and service! Can you say CREDIT UNION! I can! And anyone can join! Try it you might just get the great service you deserve regardless of the amount you deposit each month. Credit Union for the rest of us that aren't part of the 1%.
Sincerely, standing up for our rights, is our American right! We are not going to take lack of service any longer! Lets standing united and send a message we weren’t going to pay their $5.00 fee and were not going to put our money into establishments that do not consider our patronage worth keeping and that means giving us GREAT customer service at the ONE level not the 8th level.
i hear you about BOA. a few years ago my cousin did some work for someone who paid them with a check from BOA. she went to the BOA bank to cash it and was told they don't cash checks unless you're a customer with them while all other banks (at the time) didn't have a problem cashing a check written by their customers. now she could have deposited it in her account at another bank but she needed the cash that day and couldn't wait for it to clear with her bank. long story short, the teller and manager were rude and unhelpful which caused my cousin to flip out (and thats putting it mildly). she ended up getting arrested for disordely. unfortunately BOA broke no laws by not cashing the check written by their customer. then they started needing thumb prints to cash checks. all ###. then we bail them out and they still act like we should be greatful to them. they will be onb the virge of bankruptcy again but this time we don't bail them out.

I have deposited a paycheck 1x / month for years. All of a sudden, bofa is putting a 2 week hold on the funds. Last month the supervisor was "generous" enough to remove one week of the hold. This month I am told that the check went to "risk management"—cannot give reason and $304.00 is being held for 2 weeks. This may not seem like much to people and not certainly bank of america. I am just getting on my feet after 3 years of unemployment... The only thing that supported me was a $500 check from a reputable company in new york for which I work as a contractor. Risk management? They will tell you any lie to hold on to your money and then they told me I don't understand because i'm not a banker. No, it's because i'm not a liar.
Bank of America also did that to me. I checked the paying party and their money were already taken from their bank but bank of America saying they are verifying if the fund was available. Bank of America lied straight up.
maliciously putting my loan into 4-closure
First countrywide put my loan into 4-closure from the beginning, because they refused my own personally paid insurance companies windstorm & flood insurance policies! Then I spent months calling & getting the "run around" going back & forth mailing paperwork which they continually "refused to accept"! Now they even turned down my professionally prepared f. E. M. A. Approved flood zone property documents, as they went "on & on" about it was the wrong paper, it was signed in the wrong place, it was "in-accurate" and each & evertime they came-up with a new excuse and after providing them with 5-different copies of this paper over a series of additional months they refused it again "each & everytime" from a state licensed pro. Survey co! This is when my real problems started, because thats when they "illegally" started adding additional "lender placed insurance coverage" at 4-5 times my original cost that I had previously paid for my personal home coverages! This is when they started my funeral arrangements to put me soo far behind and later start 4-closure proceedings with the court! I fought the 1st 4-closure process with the judge right from the beginning after carefully explaining to your honor just how countrywide started all of this "illegal" activity with my mortgage! That 4-closure process was "thrown out" and the lawyers who started it totally backed-off and cancelled the whole process! Then boa took over and turned me down 4 different times in about 18-months for a loan modification without telling me why! You see, they told me all along that I had to be atleast 3-months behind in my payments before even ever being considered for any type of help! Now, a boa representative would call-me atleast every other day telling me that I had better "pack it up asap" because my home had already had been 4-closed-on and my property was now owned by the bank and I would be escorted-off the property by the nassau county sherriffs dept, this went on for months as I tried to explain to those ###s that it was totally impossible for that to happen because it never went before a judge! Luckily for me that florida is 1 of the states that requires a judges signature for a final foreclosure hearing before the bank can steal your house from you! Now sls is handling my account for boa and they sent a field rep out the middle of last month that tried to "strong arm" his way into my home telling me that I had no choice in allowing him to come into my home for pics & an inspection for boa! Well I threw him off my property with a stun-gun that I bought on-line for protection of thieves like boa! ( ( ( ( (I will fight tooth & nail to the very end to get my house back from the thieves at boa for free) ) ) ) ) I refuse to roll-over and play dead to the ###-sucking boa 99% of control freaks, money-hungry, greedy sob's that think they can control me! If your not part of the solution, your part of the problem! All of us 99% need to pull together and fight these corrupt people together!
I have been in th is for almost 2 years the same old runaround call back ina week and will have an answer I call sxme old thing week after week. I have been told that my modification loan was approved & I should get the documents to sign from fed ex. That was 15 months ago how much more can I take I got a sick mother living with me & I am on disability with health issues and can't afford all these bills since I got on medicare. BOA is an perfect example of what does NOT work in America! I had my credit cards, mortgage, savings and checking accounts with BOA and it meant nothing to them when they jacked up my CC rates after I missed my payment dues date by one day and then missed my minimum payment by 82 cents! Both cost me my favorable 8.5% rate and after calling them to ask them to be reasonable and take into consideration my many years of charging and paying all their bills faithfully and on time, they rewarded me by reducing my credit line from $15K to $8K and because they did that, my outstanding balance now amounted to more that 80% of the credit line value so I was hit with another penalty and my interest rate went to 28.8%! Our AAA credit cards which were funded by BOA interest shot up as well and because my wife had her AAA credit tied into mine, her AAA BOA credit card rate went up as well! After spending countless hours on the phone mostly waiting after the automatic attendant placed me in Queue, I was not allowed to speak to anyone who had power to change the rates for me!
Seriously, I've had many banks in the past (Boston Five, Suffolk Franklin, Bank of Boston, Bay-bank, Citizens, Mt. Washington bank, South Boston Savings, Massachusetts Cooperative, and a few others) but I have never been treated with such disdain or impertinence and ultimately rudeness and disregard. Bank of America should have been allowed to fail so that perhaps out of the rubble a few decent SMALL banks could rise.
I've already posted my opinion about Bank of America. It's a doomed to fail bank because it does not understand that people are it's customers and people matter. My wife and I dumped BOA and we refinanced with a local credit union. Try to get in with one if you can. They seem to be more like the banks of old that I remember, and worked with us in Boston. Also, note that their accounts actually pay an interest rate that you can calculate with out too many digits to the right of the decimal point: what is 0.05% on a savings account anyways? It's the principal of it that I'm talking about here. The kids can actually see their acct grow with the credit union. Check it out you may like them.
phone harassment
We receive approximately 10 phone calls per day from Bank of America regarding our mortgage account. We get phone calls even before the payment due date and everyday thereafter. Once the payment has been made, we still get phone calls asking for payment. We get tired of answering these calls and repeating the same information. Is there any type of harassment the bank can be charge with, because this has become more than just annoying? When trying to contact them, the person we talk to in customer service will say they will make a note on our account, but the phone calls continue. What recourse, if any, do we have?

credit card limits
Good old Bank of America. Until now, I actually encouraged people to do business with them. However, over the weekend, with absolutely no warning, while I was on vacation in Key West and using my BOA credit card, my credit limit was decreased by $3, 000. This is not the end of the world type story, but it did cause me a lot of distress and I had to make a number of phone calls to make sure that the charges I made while on vacation were not rejected. They basically cut my credit limit because I have co-signed for college loans for my sons. I have never been late on any payment and my credit score is over 700. My sons are now earning in excess of $150, 000 a year so they are paying the loans. Perhaps they did me a favor. I am rolling over an IRA and will now definitely put it into my credit union.
excessive fees
I don't write checks. I use my debit card for everything and I use it as credit to avoid ATM/ABT fees. Also, I do this because I don't want to get in to the overdraft fee game. And I am sure many people think the same way. But, I found out today - the hard way - that Bank of America can choose what type of purchases (charges) are being made to my account without asking me, thus opening up a way for them to keep my hard earned money.
Here is what I was told by customer service; If the B of A gets a request for funds from a vendor more than once for the same amount they consider it a reoccurring debit, and will pay it no matter what the account balance. Also, if the vendor tells B of A that the account is reoccurring they will pay no matter what the account balance.
When I opened my credit union account I kept B of A for when I travel - so I could still cash checks. But, my Norton Anti-virus subscription was still paid through the B of A account - I forgot to transfer it to my credit union. When my subscription renewal request went through it put a negative balance of $3.65 on my account for which I was charged a $35.00 overdraft fee - which is 958.9% interest due immediately. I was then sent an email stating I had to pay it by the March 16 - 3 days from now - or get charged another $35.00. When I called to figure out what was going on I was told by customer service that these fees would keep being applied until I brought the account to a zero balance. To make matters worse, to stop having this payment flagged as reoccurring I would have to pay an additional $30.00 - per charged item.
In the end my $3.65 overdraft cost me $35.00, because customer service waived the $30.00 fee - not out of the kindness of their heart, I had to beg. But, this could have easily cost my $100.00 by Friday if I didn't take care of it right away.
But, what makes me really angry is the $30.00 fee for correcting their change to my account. I never asked B of A to make this reoccurring. B of A just assumed it was and for it to be corrected I would have to pay. I'm not sure, but is this legal? What's more - and someone please correct me if I'm wrong - a Federal law was passed in mid-2010 making banks inform their customers that their account would go in to the negative because of a Debit/credit transaction. In my case I was never informed. Does the reoccurring debit free B of A from having to informing me? It seems to me that B of A has found a loophole in the Federal law and for those of us who try to close it, they charge us.
So, luckily I'm working near a B of A location. I went in and brought my account to zero and closed the account. I will never use B of A again. For anything. I will not even use their ATM's. Furthermore, I plan to spread my story as far as I can to warn others.

I went to my Bank of America to withdraw a sum from my savings account to invest in another bank that paid higher interest. I asked for a Cashier's Check, & was informed that the fee would be $6.00. Since BOA had only paid me $6.45 interest in the past 4 months, I thought this was ridiculous. Rather than submit to this form of "bank robbery", I took my money in cash. BOA has forgotten that good customer relations rely on the small courtesies and services that only a bank can offer to its customers, including reasonable fees for such services. Gouging customers with excessive fees is not good business. The next thing they may do is install toll booths at their doors and charge a buck to enter the bank.
I have only been banking with Bank of America for one year now, but it hasn't been a good expieriance thus far. This past week though was horrific. My lovely wife and I spent the weekend in Louisiana to celebrate our 1 year anniversary. We made a mistake in our spending and unintentionaly overdrew our account.
An old purchase surfaced late and one of the hotels charged us an extra $30 to park that we weren't expecting. We discovered the error upon our return and notified the bank to resolve the issue. At that point their were already $140 worth of charges for our $90 dollar mistake. The customer service representative suggested we not take any action yet because their were more penalties pending. She told me they would be able to work something out with us on all of them once they cleared. Nine penalties and 2 customer service reps later they told us their was nothing that they could do. So now Bank of America expects us to pay $455 of penalties for a $90 mistake. I went into the branch to resolve the issue and was told that I shouldn't have followed their own reps advice and that they could not check with their own customer service department. The associate I spoke with left me waiting twice to speak with the branch supervisor, and both times returned stating she was unwilling to work with me. She never spoke to me personally and simply had him give me her card and placed our account on hold. I explained to them I have a small struggling business and my wife is a part time teacher. We could manage the $140 fees but $455 was just not possible right now. Don't you think that is a real bully tactic?
Bank of America messed up my account. I was in positive balance and now I am owing them $185 in overdraft fees. It seems that they withheld two debit transactions until my balance went below and then let the other ones go through. That's when they start charging me $35 for each one. I asked why they charged me overdraft when it clearly showed that my account was in the positive. They stated that I was not able to view the transactions that caused the overdraft but assured me it was not the bank's error. They are such rip offs. Some of their customer service reps are so RUDE and act like they are the bank themselve. I am closing all my accounts with Bank of America.
This corporation has more cojones than a brass monkey. We have a B of A Visa card and it has been a continuing nightmare.
It began when I made a payment online on our due date which happended to fall on a Friday. When the next statement came I noticed a $39.00 late fee. Upon calling the Customer Service number I was advised that they don't credit payments until the next business day. Thier attitude was "We're the bank and we don't care". I paid with a debit card. That is the same as cash! I was also told that if my due date fell on a weekend I'd have to make my online payment on Thurday for it to credited before the next Monday. I have to pay BEFORE my due date or they ding me for $39.00! This is BS. I want to know how they get away with this.
We previously had a small energy efficeincy loan line of credit with them for the purchase of a new water heater and gas fireplace. These people charged me $3.00 to make my payment TO THEM at their drive up window!
I paid off the loan and am transfering my small card balance to a local credit union acount where they remember and stress the concept of customer service.
B of A will never miss my business, they're too big for any individual to make a difference but I'll know that I have done my part to eliminate their inluence on my life and my blood pressure!
cash for keys program
I have been in contact with Sen. Baccus office and was told of the "cash for keys" program settlements of up to $2000. I had a loan sold to Countrywide in Jan/Feb 2008 after purchase in Dec. 2007 on Cedar Creek Rd. in Plains Mt. [protected] which soon after was foreclosed on. I understand there were several attempts at auction sale and not even sure if i an still the owner or if it sold which I assume has occurred. I tried to contact Countrywide and get my redress under the "cash/keys program. Please all help I can get is greatly appreciated as I am presently a homeless unemployed USAF vet.
