what a bunch of crooks
I am writing to empathize with all who have posted here before me about the ridiculous amount of money that BofA charges for overdraft fees and how they go about racking up fees to prey on those customers that sometimes 'forget'. We are are human and sometimes 'forgetting' just happens. I have never seen such abusive tactics by a bank in all of my adult life! My worst experience with overdraft fees was last summer when I had mistakenly gone over my limit on my balance with my debit card. Again . . . it was a mistake! I was unaware that i had overdrafted and had made a series of small purchases over a 5 day period before I caught my mistake. I had purchased about $180 during that 5 days in everyday purchases for things like a cup of coffee, lunch, small purchase at hardware store, gas, etc. All in all there were 27 transactions in that 5 day period. Well it was much to my shock when I checked my online account and had saw that I was charged $945 in overdraft fees for spending $180! I realize that we are all responsible for our own account balances but as I mentioned . . . it was a mistake! You can tell by my small purchases that it was not intentional! Why would I intentionally buy a $2.00 cup of coffee knowing that I would get slammed for $35 as an overdraft fee!? I wouldn't . . . because it was a mistake! I immediately went to my B of A branch and explained what had occurred. They gave me the typical canned answer that there was nothing that they could do about . . . and they were really sorry . . and that they truly value my business! What a load of crap! Well I got stuck paying all of those fees and it felt like I was robbed by my own bank! Tell me how that is just and reasonable! I have since opened a new account with a different bank that doesn't allow your debit card to ever go into an overdraft status. They just simply decline you. How easy is that!? I'll take a 'decline' for a cup of coffee any day as opposed to an 'overdraft'! What a bunch of crooks!

I was reviewing my a credit card bill and noticed a $99.99 bill for Bank of America Privacy Source. I called the 1800 number listed and was informed that I had an account for credit monitoring. This was the first I ever heard of the account. Apparently I had this account since December 3, 2002. When we reviewed the account information, we noticed that my name was spelled incorrectly. The operator informed me that she would immediately fix my name . I could go online and get a password and log on to see my report in the meantime. Day after, I logged on and tried to obtain my report. I received an error message that the name I entered was not in the system (did not exist). I again called the 1800 number and told the operator that I could not log on and again stated my issue with not knowing that I ever had an account. I never received any mailing, any phone calls or any emails. ANY - NONE- NADA!
She looked into the records and found that I have never been mailed any intro package, so no – I had never been informed that I had this service. She would send out this package now. I questioned the operator as to what service they can provide if I am not aware of the service? She responded that I would be notified of fraudulent activity and any abnormal activity. Two days later I again tried to log on, hoping that my name was now corrected. I again received the error message that I did not exist. I again called, and now was told that my name was still correct in the system. Now my question to the operator was if I was entered incorrectly in the system – how can they notify me for abnormal activity if my profile information does not match what is in the system for the 3 reporting agencies? Her response is that the results are based on social number. I have been notified several times over the last few years from Free Credit Report.com, experien and Equifax. Nothing from Bank of America. I asked for a full credit and asked that my service be cancelled. The answer was that there would be a $40 process fee from the 99.99$ charge but to get the rest of the refund, I would need to call coporate. I am still waiting.

Our home loan was originally with Countrywide Home loans and of course we were one of many and many that were taken on by Bank of America. Since that time, we have been having trouble with Bank of America posting our payments.
Every month we send our payment to BAC Home Loans Servicing, LP via our banks billpay. Our payment is sent electronically in the form of electronic fund transfer. Every few months BAC magically loses our payment, after receiving it, keeping it for up to 15 days then returning it to us - after our due date - making our payment is late.
Last year BAC took the payment and it was lost somehow. We checked with our bank and found nothing wrong, BAC swore it was an error on our banks side. After 3 months of hours on the phone and trying to get Customer (non) Service to assist and Payment research to try to find our payment, it was magically found when our bank spent time on the phone with them. It happened again this month (May), payment sent as usual, kept by BAC for 15 days and returned after our payment date (thus it is now late). BAC says the payment (sent the same way everytime) was missing some data field (won't tell us what was missing) so it was returned. We are now waiting for BAC to call us back with the information regarding the missing data.
We were told by the Customer rep. that we were not allowed to obtain any records other than our full loan file, so any and all INTERNAL notes by the company are not allowed to be provided to the customer even though it concerns our loan. Makes us wonder what BAC is trying to hide.
Anyone have any ideas on how to obtain these secretive internal notes?
Anyone think that BAC needs to be sued for this continued screw up of peoples lives for no reason?
Update: Have been waiting since Thursday, 5/19/11, for BAC to call us back with an explanation for the last error. Still not call back.
Anyone know of a good class action suit lawyer for this and any other problems that everyone is having with BAC?
Will be paying my next payment in nickels - all $990.00 of it!

WHEN i SENT FAXES TO THEM SHOWING THAT THEY CASHED IT WE WERE TOLD THAT THEY ARE SENDING US BACK OR MONEY AND NOW WE HAVE TO SEND THEM A CASHIERS CHECK. First when I called 4 days ago about bidrack.com charge me $99.00 for one bid that I made on their site. Bank of America said there is nothing they can do until the charge is posted which takes 4-5 days. Now 4 days later, the charge is posted, they said that there is nothing they can do since I did register to bid and consented to the bid packages. The fraud department had no interested in helping the customer contesting the charge from bidrack.com so don't expect any help from Bank of America
I would seriously consider changing bank considering how unhelpful they are. While reading this site, looks like other banks has been their customers dispute the charges. Think twice before you do business with Bank of America. Obviously, they don't want to get involve, it's easy for them to pay out the bad guy.

I had a fire at my home in 2009. I received a Check from the Insurance company and told to sign the check send it back to Bank Of America I did. I paid out of pocket to have the work done myself, mailed in all my paperwork, supplies I purchased, sent in the contractor bids and paid them has well. All I wanted was to be reimbursed from the insurance money that I was due. I had over $8, 000 dollars of repairs done. I was just informed that I would only receive $919.00. Bank of America has just commented Fraud. That insurance money was for the repairs I had done. The inspector came our signed off 100% completed by me. Now they want to send me only $919.00 for all that work I had paid for. Now I'M in forclosurer and they want to kick me out of my house and keep the money too. I was not in forclosurer when my house caught fire. Now I told they can use the money to add to my account. That not right. I need a lawyer

Reading these complaints, I find little comfort that I am not alone. I have been having major problems with Bank of America and my mortgage with them. Due to personal issues and work reduction I have fallen behind on my payments and I can not get anyone to work with me. They are telling me my only option is forclosure or a short sale. I think not. What really gets me, is that I can not get anyone to give me numbers on exactly how much it would take to bring the loan current and that they have to submit info and then forward it to me and then I have 10 days to come up with the money. This is after finally speaking to someone on the phone. I have spent many hours on hold or an automated voice tells me to leave a message or to call back at a different time. What?!. I can not stay on hold at work or my entire lunch time spent on hold. I know that I am not the only person dealing with this issue now but if you are going to say that you are going to help then at least have the resourses to do so. I have speoken with some very rude and unfeeling people and they always end the call with, "Thank you for your business." What a crock. They don't want our business and are doing nothing to try to keep our business. I can not even pull up the information on line to see if the payments I have made are really being posted to the mortgage.
It is a shame the way that this Bank treats people and yet you hear of all the profit they made, while they are increasing fees and changing the rules to suit them.
If there was anyway to get this mortgage taken over by someone who is willing to to work with people then I would be happy.
When I first started banking with them they did everything in their power to make sure I was happy and satisfied. The customer service and their buisness practices are shoddy. Once and if I ever get this taken care of I will never do business with them again.

I want to point out to you the orginal sales contract for 4653 Warm Spring clearly showed in the description that the property had a mobile home on it. The Survey clearly points out there was a Mobile Home on he property. These were known to the Bank of America from the very beginning (1-7-09) and again on (1/09-09).
Was this noticed by you or your staff? NO. Instead you darg me out for wekks until the last minute. Finally, on 1-30-09, you asked if this was a Mobil Home. This clearly shows the inability of the Bank of America to conduct their business in a professional manner. It shows the complete disregard for the customer. If I had been told on 1-7-09 that the Bank of America did not loan on Mobil Homes we could have saved a lot of frustration and pain. Incidently, 1 continued with the deal and paid CASH. However, your ineptness and haphazard way of handling this situation has prooved to me there is a total breakdown of professionality with in Ban of America. Because of the way I was treated, and based on this matter, I will be changing to a bank that will show me some respect and consideration. You must realize I have been with the Bank of America for over 20 years, had over 6 loans that was always paid off early. I would estaimate over the 20 years I did over 3 million dollars with the bank.
I obtained a mortgage in July only to have it sold to this bank a month later (oh joy). I have made 17 calls to attempt to have someoone respond to our request for our final draw on a remodel but this bank won't even call back. The inspector has tried to get them to respond to no avail. Is there another bank failure in our near future?
This company is COMPLETELY screwed up. I've been working with them since April 2009, and every 2 months we have to start over as they say we never began the process of refiguring our loans. Then they take our payments and apply them as they wish, including to pay late fees that we didnt owe to begin with. I've sent them recepts showing where we paid on time, and they took the late fees anyway, then set the rest of the money aside because it was no longer a full payment. They have completely screwed our mortgages up and their is NO ONE to hold accountable. Any one with any ideas, please let me know!
I need some help! I feel that Bank of America is breaking fair trade laws and probably banking regulations preventing me from getting a government restructured loan that I applied for, and that they themselves qualified me for. They lost my entire tax returns 7 times. They lost IRS documents 5 times, they kept saying they have them but another fed ex would come requesting them again and threatening not to give us the making homes affordable loan. Now after 6 months they are again asking for our tax returns and we have 30 days or we will have to pay 10, 000 in back mortgage and not be accepted into the program. We are over a barrel, we have the proof that they are trying to force us out and we need someone to read the condensed version below. I signed up for the making home affordable with BOA back in July of 08. I was out of work and they sent me a letter saying that I qualify. I called, and I did after all qualify for the program which would drop my mortgage by 1000 per month. I sent in all the requested docs, and then was asked for them again. I faxed them and they didn’t receive them. These are full tax returns, w-2’s everything each time. 2 weeks went by and a fed x arrives with a letter saying we qualify and we are to make trial payments to BAC home mortgage in the amount of 1900. That’s better than 3000. We start making these payments and get phone calls on Sundays saying that they are missing information. I call and they say, well its not us that is missing information, it’s the HOPE team and heres there number. The hope team isn’t open so I have to call back Monday. They tell me that they don’t need any info and don’t know why I was asked for it. The next month they call and say there missing the tax returns. I fax them 2 times and mail them once just for good measure. 3 weeks go by and they now are missing an IRS form. I tell them that they already have it and end up faxing it in 2 times. They didn’t get it after 2 weeks more and I fax it again and mail it. 3 more weeks and they don’t have my tax returns and if I don’t send them in I don’t qualify and now I am on the hook for all of the back mortgage that I would have otherwise paid. I tried to use my Home Depot card to buy some stuff and it was denied. I called and found out that BOA had reported to my credit that I was de-faulting on my loan and was reporting it even though I was in their own program. Long story short they told me that its automatic in their system and I would have to call every month to get the last months report to the credit agency removed. I did that and I must every month. But my credit is still being affected.
Now back to BOA. We have been making our payments on time and we get a fed x saying that were missing some important documentation for our modification. Tax returns and such. More phone calls to all of the departments because the phone numbers that are on the letters they send are not the ones to call. In fact they are to other departments other than the right one. I fax 2 sets of our entire tax returns in and mail them too in their fed x pouch. I call 2 weeks later to check up. Lady on the phone says we have received all of our docs and it is going to underwriting. I get another call on a Sunday saying were missing some stuff. I call Monday and they say were not missing anything. 3 more weeks and I call to check. The lady says congratulations! Now just wait for the final docs to arrive, sign them and your all done. What a relief! I jumped up and down with joy. 3 more weeks and I get a fed x saying were missing tax returns in their entirety, and form whatever from the IRS. I call and argue and then send them again and tell the people on the phone that I was already told we were approved and waiting for the final docs. There is no record that anybody told you that they say! STRESS! Faxed returns again! 3 more weeks and I call to check. Now were in December 08. They have all they need and its all going to underwriting. Christmas comes and goes and we are missing more paperwork. This goes on like this until today when I got another fed x saying that I need to send them my entire 08 tax return, the hardship affidavit, check stubs from work ( I am still unemployed) a signed notarized copy of something else etc. I was on the phone 4 hours today trying to get somewhere. Finally they are helpful and figure out that they indeed have everything and they don’t know why BOA is asking for more. Keep in mind that if I don’t send in these docs they will deny us and we will be liable for all of the back modified payments in cash and the next months mortgage. That is 3000 plus lets see, , 1100 for every month since September, that’s right about 10000. The supervisor got on the phone and tried to talk me in circles telling me that I needed to send in the documents or I wont get the new loan. They have them and they are not willing to give them to the underwriter again. It is up to me to send them in again. I asked why I need to send docs that they already have and he said because they asked for them. All of these documents over 6 months they have lost over and over again and now that I am under a 30 day timeframe what do I expect? I expect to get a letter after the 30 days is up saying sorry we cant give you the new loan because we didn’t receive the docs. I have all of the proof of all the other times I sent things in, and I could have proof that I sent the new ones in too but if they say that they didn’t get them, I don’t get the loan, and have to pay 10, 000. All of this even if I can prove everything every step of the way. I need help, and I don’t know what to do. They are making it impossible for us to get this government program by continually putting up roadblocks that they are aware they are doing. I need HELP! After reading an article in the St. Petersburg Times South Pinellas Edition on 02/21/2010. I feel compelled to advise you my dissatisfaction and total frustration with Bank of America.
September 28th I was laid off from my job which paid $73K a year. I called Bank of America with the Homeowners HOPE Hotline on the phone. BOA advise us there is nothing they can do and I don't qualify for the "Making Homes Affordable" since I had Mortgage Insurance and my loan was backed by Freddie Mac.
Mid December I realize my situation is getting desperate and I am not finding work and to only receive $275 a week in FL unemployment and be told I make too much for food stamps and borrowing money from family and friends is not enough. I call back BOA I speak to a very nice man (even though it takes over 30 minutes to get to the right department). This person advises me I do qualify but it takes BOA 45 days to fedex the Form 1126 and Hardship document. Even though these are on the Making Home Affordable Website he stated I could not use them.
Well 45 days come and go and I receive a call from BOA advising me they are so busy it is going to be another 30 days which should be next week. The women that called me was very nice and explained once I receive the paperwork I can qualify for a 3 month trail but I must remain current in my mortgage.
I am very very frustrated about this process as I was a Countrywide customer and now BOA purchased them. Between December and the call mid February I must advise you I called a few times to follow up as I am desperate.
I also own a home in Pennsylvania so I have 2 mortgages, HOA fees in FL plus all my utility bills and only receiving $1, 100 I can not keep borrowing money from family and friends. I already owe out close to 10K just since September.
I can forward you the article where it stated BOA has been the worst in assisting customers with the Making Homes Affordable.

I was a happy homeowner until Bank of America purchased my refinance in 2009. My first payment for BofA was in September of 2009 which was paid early by a few weeks. My mortgage payment was now $1050.00/month.The issues started when I sent a check for the escrow payment of around $750.00. I sent the check in with a payment coupon clearly marked ESCROW. The nexts month payment coupon was sent with the invoice but the due date was for a month in advance. I thought, maybe this is how BofA invoices? I wasn't sure it being a new company to me and all, so I gave them a ring to get some info. After waiting on hold for roughly 5 minutes, I explained my situation to an operator I could barely understand and was told that everything was up to date and normal on my account. Perfect, I thought. I don't have a payment due till November. This was after my first call in October. After a few weeks went by, I started to think and reviewed October's statement. "AH HA", I said out loud as I noticed my escrow balance was zero and that is why my payments were for a month ahead. I called BofA, Again, and explained what I found. Again, I was told that my account was fine and the escrow payment was applied properly and the invoices sent out were correct. Okey Dokey BofA, if you say so on a recorded line:) My refinance dream had awakened to a nightmare of negligent accounting practices and poor customer representative training on arrival of my December statement. I was sent a rather nasty notice from the bank on December 5 stating my escrow "MUST BE PAID BY DEC, 25, 2009" or I will be delinquent on my escrow responsibilities. Then to darken my already glum dismay, I was sent an invoice for $1350.00 to pay my mortgage up to date. So, the $1350.00 was due to BofA posting my escrow of $750.00 as a monthly mortgage payment causing the billing to show a partial payment for the month of October and a balance of $300.00 to pay month in full. Each month I paid I thought I was paying a month in advance, only to find out I was behind all along plus short on my escrow. So my x-mas was not fun to say the least. I was forced to come up with almost $2000.00 to get my account in order. I asked if there was anything they would do to help since I called and was told everything was o.k and it was their mistake. They said no, "we cannot go back and change the postings", I was told, so I paid the balance. Mind you a single homeowner, full time student, and there is nothing they can do. Hhhmmm. I explained that this will put me behind for January and they need to document this issue so I am not noted as delinquent. The rep said "no problem, I will create a note" Come January I called in to remind them I would be late more than 30 days and to make sure they do not document me as delinquent, again "no problem, mamm, we will take of that for you" What a bunch of lies. This time I had dates times and operator #'s, but they still didn't care and BofA reported me delinquent for the month of January on my mortgage!? Because of this my discover card available balance was lowered which resulted in me not making anymore home improvements or using it for school. Also, my credit report was affected adversely. Now I have to take out larger amounts in student loans. Thanks BofA! The steam roll affect had started, Since I was unable to use my card to continue my home improvements, I was unable to keep my home looking nice. I had invested almost $5, 000 in landscaping and just started a small kitchen remodel. I made the decision in late 2010 to short sale the property before it deteriorated. I filed for a short sale in October of 2010, and by December I had a contract on my house. It is now August 13, 2012. I have had two other cash offers for my home and BofA still has not approved my short sale? It is a constant run around of, we need this document faxed, or we need a copy of this. They continually change what they need to prolong the process so I will foreclose instead of short sale. My personal opinion and advice to everyone out there, is to invest in your local banks-they are out there and provide a better level of service. Before BofA bought my refinance I was with GMAC, in the three years I had my loan with GMAC I was never delinquent nor dis I have any discrepancies with my payments. Because of a simple accounting mistake that went unnoticed and no one bothered to take a closer look when I called in 2009, I lost my home and credibility. Thanks Bank of America!
I too was told, I did not qualify for the HOPE program. Bank of America has only increased my house payment, to an unbelievable amount of $1108.15 a month. I currently am a seasonal worker and attending school, part time. I do not have a second mortgage and I don't use (believe in) credit cards. I know they exist, but I am a "cash and carry" man. Only because of an illness, I had fallen behind on my payments and BofA is killing my credit score. My house is the only thing on my c. score. Is the modification program just a SCAM?

i bought a mercedes truck it had a diesel problem a few days later the cluster burned the truck was at theire premises for about 3 wheeks they said they gone fix the problem they dit not i wend and said that i will pay half the cost to repair the truck they stil had excusses i wend to fetch the truck i took it to an bosch agentsy the cost are about 30 thousend to repair they just say sorry i have the truck more than a month they forget that the truck was at their premeses for most of that time

I've been banking with Bank Of America for 10 years. But they deducted this authorization from my balance and hit me with fees 7 days later when I would have overdrafted had the transaction actually been paid. (I know, it's complicated, but it's highly fraudulent). After they corrected the six over draft fees of $25 each I wake up the next day and find TEN overdraft fees of $35 each! The first set of overdraft fees caused me to overdraft FOUR more times, which is true but why TEN charges? Nobody seems to know! After another hour on the phone this was taken care of. So I cynically wrote the bank an e-mail asking for $500 worth of credits towards my account for wasting my time. I made the point that if I had overdrafted by mistake I would not be able to deposit the difference and say 'I'm sorry' I would have to pay $500 worth of fees! They wrote me back with 'We've researched this account and found that you overdrafted blah blah blah'. I wrote back with 'apparently you didn't research this account because xxx and yyy'. They wrote back again with 'Oh. You're right. Sorry'. It just drives me so mad! First, they use a fraudulent fractional reserve system and create money out of thin air! The Federal Reserve is about as Federal as Federal Express and then they have the nerve to assess fraudulant fees on the public! Let me tell you how money is created. No, it's not backed by gold, it hasn't been in DECADES! The United States Government decides they need $10 million dollars. So they print up some fancy looking treasury bonds. Then they call up the Federal Reserve (who is a private corporation) and they print up some more fancy pieces of paper and give it to the US government. That's it! 10 million was just created! Oh but it gets far worse than this. The new created money has to have value and since the only thing regulating the value of money is how much is in circulation 10 million dollars has stolen value from the money you have in savings causing inflation! Now imagine 700 Billion being created out of thin air and given BACK to the bankers! And you wonder why gas is $2/gallon when a barrel of oil is going for $35 (it should be $.75 at the pump!) It gets worse! The fractional reserve system requires banks to only have 10% of their reserves in holding. This means they can loan out 90% of their reserve. So what happens to the $70 Billion of bail out money? It goes into bank accounts. Not $70 billion has because 7 TRILLION! Thus causing MORE inflation! And if you really want to realize how you're getting screwed let's factor in INTEREST! The US government doesn't just give the bonds to the Federal Reserve but the bonds are promissory notes that the US government will pay back the Federal Reserve with INTEREST! But if the Federal Reserve made the first dollar where does the money to pay back the interest come from? You got it! Print more money and borrow more money from the Federal Reserve! Causing a never ending cycle of inflation! Inflation is a tax on the people. Look at cars for a minute. In the 80's a new car cost an average of $7000. Now it's an average of $20, 000. Did things get more expensive? No! The value of the dollar has been chopped down to a third while wages have not even doubled! So you save a million dollars to retire on. When you retire that million dollars will have the buying power of $250, 000 if your lucky! And to top it all off.. they hit us with overdraft fees! In searching for writing jobs on Craigslist I came across several postings in search of people who would be paid to "research and contribute blog content" and "comment on the vending industry in online forums." At first glance it seemed like a simple enough part time job to take on, and they might have actually convinced me it was legit too, except that the bottom of the post does not give contact info or a link for applying to the job, but rather asks the reader to "google 'fresh healthy vending opportunities'" in order to apply. This immediately struck me as unusual. And so as per my usual habit when applying for jobs, I searched to see if the google auto-complete filled in 'scam' at the end of any related search phrases. Sure enough, when googling the phrase given in the job posting, there it showed in auto-complete: "fresh healthy vending scam." Which landed me here, but curiously also on a slew of other seemingly legitimate blog and info sites containing reference articles about childhood obesity, healthy eating alternatives, etc. The strange thing was that almost all of the sites I found on my "scam" search had inserted the words 'fresh healthy vending scam' as the company/product name in the promotional articles, where it logically should have said 'fresh healthy vending.' All of the websites and articles were so odd and awkwardly written that it actually took me a minute to realize that Fresh Healthy Vending was the actual company name. When I read the thread on this website I realized what they've done, and it's surprisingly smart albeit deceitful. They've paid (or I'm assuming they actually paid them) unsuspecting people to write positive, promotional articles that appear (or might actually be) factual, which include the word 'scam' in the articles and the search keywords of the website so that they flood the search engine with their own paid materials, even if the searcher is looking for something else. The more recent and active websites their postings appear on, the higher they rank in search engines. So when people like me are looking to see whether a company is legit, they don't immediately or easily find negative commentary, or really anything at all that the "company" doesn't want them to find. So this warning goes out not only to investors but also to writers. I can't say whether or not these people actually pay for any internet work done as I did not apply, but regardless, it seems a colossal waste of valuable time, not to mention a tremendous compromise of personal integrity, to get involved with this type of organization. Aside from which, you could never include this type of absurdity in your writing portfolio or resume.

I don't know if this is the correct forum but I feel rather helpless at this point and am grasping at straws now.
In mid to late 2009 I applied for the Obama Administration's Making Home Affordable Home Loan Modification Program with my mortgage holder, Bank of America.
For almost 8 months I went through hell with BOA representatives just trying to get my application through! Although I provided EVERYTHING they asked for, during the first 3 months I heard nothing about my application. Then after my repeated calls, they began telling me over and over that either they never got my documents, they were "incomplete, " or I needed to update them.
Each time I would re-send the requested documents via FEDEX Return Receipt Requested AND GET THE RECEIPT BACK. Yet I would hear nothing for weeks and then when I called to check my status I would be told again that I had "missing or incomplete" documents- the SAME ONES!- despite the fact that I had the signed receipts!
This went on for MONTHS!
Finally, I went on a Trial Modification Program in March 2010 which was supposed to last about 3 months while they reviewed my file to determine if I could receive a permanent modification.
During the next 6 months I went through hell AGAIN...the SAME scenario...BOA reps claiming I wasn't supplying the correct documents, or they lost them or some nonsense. Each time they would tell me I was in danger of being DENIED the permanent modification if I didn't straighten out the paperwork! But how can you straighten out a mess that's being made IN-HOUSE!?
This ridiculous back and forth FedEx signed receipt "I don't have the right documents" mess went on until August 2010.
Then, in early August one of the BOA reps told me I had NOTHING to worry about because my loan app was sitting in the "approved" Dept and I would soon be receiving an "offer" letter for my "new loan modification." I was so happy and relieved. She ASSURED ME that all the NIGHTMARE was OVER!
A couple days later Fedex was at my door with a package. I was happy. I thought "Finally! After all the hell I've been through! Here's my modification offer!"
Imagine my SHOCK when I opened the package and found a LETTER OF DENIAL, stating the reason for the denial was "MISSING OR INCOMPLETE DOCUMENTS!" To add insult to injury it made some reference to the fact that they would get in touch with me later about possible foreclosure info!
I was LIVID! First, I had just been told I'd been APPROVED 2 days earlier! And 2nd, how DARE THEY even MENTION foreclosure to me YET?! I had not MISSED one single payment on my mortgage in the 20 years I'd lived here!
I immediately got on the phone and called them. Guess what they said!? "Gee, I don't understand why you got a Denial Letter. Everything here looks good. All your documents are in order." Yet they couldn't guarantee that the Denial Letter wouldn't "stand!"
So I then wrote my Senator and I wrote Brian Moynihan, President and CEO of BOA. To his credit, within one week Mr. Moynihan had a rep contact me for details. And within two weeks I received my new Loan Modification offer/Agreement. I signed the Agreement/contract and sent it back. In addition I also requested a SIGNED letter from Mr. Moynihan's office stating that I had been APPROVED for the new loan, which I received via FEDEX.
I HAVE the new loan/agreement AND the signed letter in my possession as of this writing.
As a result I have been paying my new loan amount under this agreement since August 2010.
However, all of a sudden, yesterday, when I called to dispute the amount of interest BOA sent me on my 1098 for 2010, the rep that answered the phone informed me that I had NOT paid my April mortgage AND that I also owed a late fee! I said "NO, I paid my April mortgage on April 1st!"
After some more review of my file she said she saw that I DID pay the money but the money was sitting in the holding area. I asked why. She said "because your modification was declined."
WHAT!?! I explained that I've BEEN in a modified loan for almost a year. She said she could only go by the CODE she sees. And the code says I'm DENIED. OH MY GOD! NOT THIS AGAIN?!
She said she would check something and get right back. When she came back she said she could see that I had been paying on a modified loan and wasn't sure why they didn't apply my April payment. She said she would transfer the money right then and remove the late fee. But she said I'd need to talk to someone in another area about that CODE and why it was there.
She then transferred me over to discuss my tax problem. While discussing my interest/tax problem, that rep and I discussed my Decline code. I said the other rep had at least made sure my April payment got posted. He said NO SHE DIDN'T. He told me I was showing up as NOT HAVING PAID MY APRIL MORTGAGE STILL! AND that I owed a late charge!
So what DID that other rep actually DO? Nothing?!
He said he could NOT credit my mortgage payment as long as that DECLINED CODE was on my file!
So here I sit, having faithfully been paying on a SIGNED LOAN MODIFICATION AGREEMENT since last year, having faithfully PAID MY APRIL mortgage, yet being told I'm DECLINED for a mortgage modification ? Being told I'm delinquent for my April payment? Being told I owe late fees because BOA is HOLDING MY MONEY and NOT applying it as they were supposed to?!
I can't get ANY decent or logical answers from BOA reps because when you call them, one Dept NEVER seems to know what the OTHER Dept's are doing! And when one Dept writes something in your file, another Dept has NO CLUE WHY, or what it means!
Now here's the BIG dilemma, among all the possible dilemmas:
Even though I PD MY APRIL MORTGAGE, I'm being told it's not being applied but in fact is sitting in a "holding" area because my modification was DECLINED! As long as it sits THERE, I APPEAR to not be following the rules of my NEW MODIFICATION/AGREEMENT, which could ultimately cause me to be KICKED out of the program through no fault of my own!
BOA has been happily collecting my monthly loan mod payments under the AGREEMENT for almost a year now! Why have they STOPPED this month!?!
Why can't BOA get their stuff together so that the right hand knows what the left hand is doing at all times? Instead of making the customer SUFFER things like THIS!?
What is BOA trying to "PULL" now? It really makes me wonder!
The BOA rep that worked on the tax problem is looking into this for me but it's really NOT HIS AREA. So he didn't seem real positive about what he might be able to do about this "decline code" for me. But at least he, unlike the majority of the BOA reps I've talked to, has been willing to TRY.
My next move, just like before, will have to be my Senator and my Congressman. And this time I'm taking it to the news media as well.
Financially, I'm in a very bad place right now. My home is all I have. I will NOT let BOA put me through that nightmare again and try to make excuses for taking my home. It is all I have left. It is the one thing I have ALWAYS paid for, even at times, not getting medications I've badly needed (I'm on disability), just to pay my mortgage!
I hope that someone reads this and helps me before BOA starts my nightmare all over again.
And I hope people realize that I'm probably one of thousands that BOA pulls this on daily. I know I was one of thousands they pulled the "missing documents" scam on in order to try to discourage customers from participating in the home modification programs!

i totally agree with all of you. i lost my house through legal stealing . i can not begin to tell you what they put me through. it is totally shameful what they are legally allowed to do to people and their families. how is it that they are allowed to stay in business after they stole my money, house, and i and my family had to bail them out but they would not help us through their illegal practices is this really how we treat hard working americans i guess so . legal stealing . they will all be judged one day for what they have done. i want this off my credit report so me and my family can start to live again . they sold my house at auction but they would not let me sell to get their money. legal stealing thank you very much for taking my home. patricia

Like yourselves I have spent countless hours on the phone trying to work with BoA. The following is the complaint I wrote to congress after finding out our request for home modification was declined.
Dear Mr. John Boehner Speaker of the House, Senator Cornyn and Congressman Lamar Smith,
Seven months after applying for a home modification through Bank of America, BOA has declined our request for help, and noted on our account we had to be 91 days delinquent before they would intervene and modify our loan. With the help of a qualified home counselor, we submitted all required paperwork requested by Bank of America three times (although 2x's according to BOA our paperwork was never received). In nine years we never missed a payment for our 1500 square foot home, and we have done everything asked of us by BOA and we will lose our home anyway, and that in itself makes no since.
We are trying to save our home by reducing the loan because of two hardships, one being in 2006 when I was involved in an automobile accident and the other in 2009 when my husband was laid off work for over a year. He is working again but took a grossly reduce cut in pay. Furthermore, our most recent news from our daughter who is in the Airforce seventeen years announced she would deploy in six months as well as the father, and I am the Guardian of the both their children and may not have a home.
The reason for my correspondence is I want my congress and Washington to know the new "Making Home Affordable Act" is ludicrous in that it does NOT work. I can't help to think of all the American people who may have lost their homes because of this new law with all its rules, regulations and red tape that goes with it when a perfectly good system worked.
After submitting the letter to congress I began searching for a modification application on line from BAC Home loans Servicing, LP. In my search I stumbled across your site. Your mails are a huge, I mean huge eye opener. I would like to know who is BAC and why is BOA using them for load modification?

My brother was a long term BoA customer when he died in January. I received a notice from BoA that they needed to repay the Social Security department for an overpayment to his account, which I had closed following his death. When I tried to pay at my local branch, I asked for a notarized receipt of payment. Since I'm not a BoA account holder their rules would not allow them to notarize a receipt to me. When I called their reclamation department to express that they should be ashamed of this kind of treatment, I was told that "they have rules". This is an indication of the little regard they have for their customers once they no longer can get any fees from them.

I'll keep this simple. I always paid my mortgage on time. I had countrywide. Boa took over. I had a death in the family in december and other craziness going on. I somehow missed paying my mortgage for the first time in my life of being a homeowner. They did not leave me one voicemail message. (I had a lot of 800 calls that I did not answer as I thought it was sales calls—and no one left a message which a rep told me was not usual) I also did not get an email reminder either. As a result, they sent me a letter which was received early in january that my payment was not received. As soon as I got the letter I ran to my computer and researched frantically to see if they were right. The funds had not gone out of my account. I made a payment immediately. I also called and asked why no one contacted me. No one could answer and said it was no usual. As a result they reported to the credit bureau my late payment and my credit is now ruined, credit cards rates went through the roof, etc.
The last correspondence I received said "bank of america provides collection calls as a courtesy to our customers, and are not guaranteed. " ###s. I let them have it again. They suck to say the least. Keep an eye on them. They have a bad reputation with mortgage procedures. Again, never had a problem with anyone else.
I just have to give an update to anyone who is interested...I replied to the last email response I had received in my BOA inbox---I blasted them for their lack of customer service and decency. Again, I REPLIED to an existing inbox email from them---this was the response I got: "Thank you for your recent inquiry regarding the late payment on your loan.
We were unable to address your request with the information provided. Please provide a clarification of your request along with your name, loan number, property address, and re-send your e-mail message so that we may better assist you. "
WOW---THEY CAN'T EVEN FIND MY LOAN INFORMATION from me replying to the email in THEIR OWN SYSTEM INBOX/MAILBOX---That shows how stupid they are and how their reps do not care at all. How can you not know who is sending you a message right from within your own system? They are sickening.
Thank you for the advice. The only problem is I can't prove I made the attempt to pay online this past December and it seems with everything going on that I probably did not attempt it or else I'd be able to find the confirmation somewhere. So as I can't prove I did pay/attempt to pay they won't "fix it" on my credit report. Do I have any other recourse?
I applied for help with my mortgage going almost 3 years ago (march 2008 after losing my job) with the keeping your home affordable program. They sent me a package with lots of material that I had to send them and very little details about what I was applying for and what I would have to do. I was approved for a trial period in November of 2008 and I was sent information about making the payments and for how long. I was never told that by making these payments it would damage my credit report and rating and make me behind in my mortgage for six months. To make matters worse, after 5 months, they denied me and put me in for some other program. I never knew what it was, nor could I get in contact with anyone. After a year of calling and getting no word, they final denied me for the last unknown program when they found out I had a temporary job that only lasted 2.5 months. The person working the account at the time wanted me to repay the debt. I never found out was happened to the money I was sending in or if it was going to be applied to the balance owed. I tried to contact them, with no results. I got passed from person to person and no one could answer any of my questions. I wrote my senator and the president and was sent back some info on government agencies that were supposed to help me. Finally I was able to get someone through and agency that could answer my questions. I found out they had bad information on me and had been reporting me for non-payment even though I paid as agreed under the trial period. They also had bad information on my income and other things even though I had sent this to them several times. The woman I spoke with told me that I had a code put on my account that was preventing me from being put into any other programs that I may qualify for and that in order to qualify for any of the programs I had to pay back the money I owe in excess of over 6, 000.00 which I was only in debt because I was paying the amount they told me to pay for the keeping your home affordable program. I have tried several times to talk to someone because now they are threatening foreclosure on my house. None of my papers told me any of this was going to happen and I never knew I needed to continue to pay my regular payments even though they told me to pay the trial period amount instead. I am tired and burnt out after almost three years of this and I am ready to get a lawyer to settle this for misleading me into a program and damaging my credit score and endangering me of losing my house. Please advise. There is more that I left out because it would be too long for me to write in this message.
People be careful in dealing with Bank of America, they have ruined my credit by decreasing credit limit and reporting as if I went over my credit limit. I have never missed a beat with this account, paying twice as much of the minimum payment due. I have paid roughly $10, 000 on this account but the way they report to the credit bureau seems as if you are up to your limit due to limit reduction that is being done all over the Country. I closed this account when banks started having problems with loans and never used their services again since 2009 but they did not close the account and started reducing my credit limit reflecting on a risky loan. Welcome to the predatory states of America. It would seem our government has forgotten who they are here to protect. As a result, the banks are having a field day by ruining the lives of folks. Nobody is minding the hen house anymore. Sad and disgusting times.
I had a similar situation happen. I had paid online and they did not withdraw the funds from my account due to a technical error on their part. I had to get them to release a letter saying that "they removed the delinquency put on my account and advised the credit bureaus to do the same." You can get the delinquency on your credit removed. Its alot of work and you need to stay on top of Bank of America but it can be done. The sooner the better! The more you wait the harder it is to remove. I was in the middle of purchasing my house when my credit score dropped 100 points bc of them. I got it rectified 60 days later after I took the letter they wrote and submitted it to the 3 credit bureaus. Research how its done and keep calling bank of america until they release the letter!

I have had a credit card with Bank of America since 2003. When I first opened my account I had a Checking and Saving accounts as well as my credit card account. I had problems with my checking and savings accounts within two years of opening the accounts and choose to close them as opposed to contiuning to do business with Bank of America. When I closed my checking and savings accounts I was informed that if I choose to close my credit card account it would effect my credit score negitatively. I had not had any problems with the account so I kept the credit card open. I have always made my payments on time and paid slightly over the minimun required amount. On my most recent billing statement the payment from last month (April 2011) was not credited to my account. I called to inquire why this payment had not been credited to my account even thought the check has already been cleared through my current bank account and after being transfered three times was told to contact my bank and advise them that a processing and coding error had occurred. I have the proof that Bank of America received my payment however they have taken the position that my check is not enough proof of payment for them they would not even advise were a copy of my check could be sent to dispute this matter. This is not legal and I plan to continue to dispute this issue with them. I would never recommend this company to any I know.

unnecessary charging for using debit card
Recently, I was charged around $700 in overdraft fees from my Bank of America Checking account. The problem originally started when I made an accounting error and left my checking account with insufficient funds. I did not realize this, and used my debit card for my normal spending (many small items such as gum, drinks, etc). I used the card around 25 times and was not notified once that there was insufficient funds to cover the amounts.
Therefore, I was charged around $30 every transaction. It was only when I checked my online statement that I found this out. I promptly called Bank of America to try to get my money back, however they would not budge. I asked why they would let me keep charging small items on a card when the account did not have enough funds (although I knew the answer was so that they could keep charging fees and making money).
I remember reading somewhere that they made around 40% of their banking profits on overdraft fees alone, now I believe it. I have been a member with Bank of America for over 10 years and cannot believe what they are doing is not illegal. Also they raised the rates of 2 of my “fixed rate credit cards” for no reason other then “they did not like my payback habits” (although I was never late).
Shame on you Bank of America.
Exactly as 123321 said. You must opt out of overdraft protection so that your card is declined if you have insufficient funds. They may reverse some of the fees but most likely not all of them. You are truly the one at fault here.

Let me start off by saying, I'd have loved to post my complaint directly to Bank of America's website… but they require a login before doing so, and unfortunately the inability to log in is the crux of my problem. Too bad BOA, your system is biased against people having problems with your website.

Here's what happened. I had a semi-urgent task to complete in Online Banking, and upon logging in the same way I always had, the site kept telling me "You have not entered your Online ID. Please do so and click the Sign In button."
I had indeed selected my ID. The site just wasn't acknowledging it.
The response that I was given was that "you are an esteemed Private Wealth Management customer" and "Though it is a privilege to assist customers like you, our bank has marked your accounts to receive assistance from our Relationship Manager appointed especially to manage your accounts."
Fine. Frustrating that my "esteemed" status required me to jump through more hoops, but oh well. So, what's the contact information of my Relationship Manager?
The response to this question - TWICE - was to "call us at 1.800.878.7878 and receive the same dedicated assistance. We are available 7 a.m. to 10 p.m. Monday through Friday Eastern Time."
The second time really bothered me; clearly BOA has not empowered its customer service staff to think for themselves, so she just went right back to the script and posted an identical answer **and I mean identical** a second time.
At that point, I'd had it. When I need access to my account, I need access to my account. Bank of America, you can either make this easy on me, or hard on me. I don't have time to jump through hoops at 850am on a work day. BOA completely failed me today.
loan modification denial
We submitted our application for a loan modification with Bank of America on September 9th of 2010. This was after an initial rejection the previous summer and a subsequent call suggesting we apply again. Now, after seven months of dickering and constantly asking for more and more information we have been told that our request has been denied and that our hardship was not severe enough. Given that I went from a nearly six figure income in 2009, to $10K in 2010 as an under employed salesperson, I am at a loss to understand what then constitutes a hardship? We are living off our savings and the income of my invalid mother who I care for in our home 24/7. I left my last employer after they slashed my pay and had to bring my mother into my home to care for her as I could no longer pay to have her cared for at an assisted living facility. I do not collect unemployment nor any other financial assistance to help care for my mother. I refuse to place her in a nursing home as the quality of care in such facilities here in Georgia is, on the average, substandard. I promised her I would care for her as long as I am able. We are barely getting by and it is only by withdrawing money from our 401K that we have managed to survive this last year and a half. But at this point our savings are almost gone and yet we are being told our hardship is not severe enough. I only wish we had the same opportunities the banks had when they applied for their bailout money back in 2008. They filled out a two page request form and simply had to ask how much they wanted. At this point I am not sure what we can do. If I could refinance it would probably help, but with my current income situation, and the size of my mortgage, no financial institution in their right mind would consider me regardless of how current we are on all our bills. We have not had a late payment in many years but that could easily change here once our savings are gone. I am just frustrated and to put it mildly, annoyed at a system that favors the rich at the expense of everyone else.
