hold on account
Our account was placed on hold, which we discovered on a saturday morning only because our card was denied at a restaurant. After 45min on hold with customer service representative, we got no help. They didn't know why it was on hold and it looked like we still had all our money in our account (even though the automated information we heard first was that we were 800$ overdrawn). So we got told to call Risk Management. After being first disonnected with first representative, and sent to a voicemail that was defunct (after being told she was going to help me) by a second representative. I called Risk Management a third time. This representative was nice, but not anymore helpful than anyone else. He could not tell us why our account was on hold, only who did it. And that she, that one of THOUSANDS of employees at Bank of America, was the ONLY person who could take that hold off. And she was not back at work until Monday! I was also told that there was noone else who could help me. That there were no managers there all weekend, and supervisor was going to tell me the same thing! Basically I was being told that there was absolutely nothing that they could do for the next 48hours. We were being penalized, being completely cut off from all of OUR funds, our money, our account, for 48hours, with no explanation, for NO reason! This is so ridiculous, so unnacceptable I was practically in tears by the time I got off the phone 2 hours later.

not receiveing insurance money of mine they have
I had a house fire going on 4 months. The first check the bank wrote it was in mine and ex. Ex refused to help get check cashed. Called bank they told me the paper work to send to get it in my name. Going on 3 months every time I call I get a different story. I''ve talked to supervisors and managers. No one wants to help. My insurance company sent them my money. Bank of America has my money and is refusing to give it to me. I have two daughters, no kitchen and fire damange through the house. HELP.

Contact the Att. Generals Office in your State and place a complaint against them. It will be handled. Also You can call the Insurance Comm. of your State and report them. The Ins. Comm. maybe be able to do something sooner.
terrible customer service
I refinanced my mortgage through Bank of America. Both my first mortgage and my refinanced mortgage were both through B of A. They picked the title company Nat'l Real Estate info services to help in my closing. My sole responsibily was to pay closing cost to B of A, the title company and the taxes which were paid in my settlement statement. The bank and its title company informed me after closing that my first loan wasn't completely paid off. Why they both got me involved when I paid good money to have the title company take care of this refinancing. Furthermore B of A sent me a escrow overage check which just bounced in my B of A checking account. As I'm typing this complaint I'm waiting for customer service in the B of A payoff dept. "I'm sorry your call is very important to us please remain on the line until the next customer DISSERVICE officer can FRUSTRATE you!

I went to Bank of America last week to order checks for my business. As a small business we only have a Business Savings Account. I handed the teller a copy of the reorder form that comes with the standard sized checks. I said, "I need to order checks. I would like 3 boxes of the same thing we had last time!" She said, "Okay, the total cost is $24 and that will come out of your account." I go back to the office thinking everything was taken care of and all would be good. A week later, i receive large sheets of checks with the side tear stubs. This business has been using Bank of America since 1984 and have NEVER ordered checks like that. So, I go back down to the branch, end up with the same teller I had the week before and say to her, "I ordered checks last week and I got the wrong ones" She replies, "Who ordered them for you?" and I said, " You did." and she replies, "I can't make that decision" so then, I start getting angry and say to her, "What decision?" and she replies with a long, blank stare. "There is no decision to be made. I ordered checks, you ordered the wrong ones and I would like you to fix the problem so I get the checks that I ordered last week" I said. She then says to me, "I can't make that decision. You will have to wait to see Sergio." She pointed to the sitting area where there was 3 other people waiting. The Branch manager approached me and said I needed to sign up to see him. I noticed all the names above me had been checked off so I thought i was next. They have 4 desks in the banking center and the only one that was occupied was by Sergio. He was assisting a customer. I asked the woman how long she thought it would take a and she told me about 10 minutes. She then walks to the door and begins greeting customers and two other workers meet her at the door. They are talking, laughing and having a great time while the rest of us sit and wait our turn. After about 30 minutes of waiting, I went to the Branch Manager and say to her, "Excuse me, Is there anyone else than assist me. I have been waiting a while and so have the rest of the people." She then replies, "Oh okay, just a second." She walked over to Sergio and said something to him quietly. He gets up and goes to sit at another desk. He is then helping two people at a time and the Branch manager goes to meet her friends back at the door. No one was even coming into the branch. I doubt they needed 3 greeters for NO CUSTOMERS and have 6 customers waiting for the same person. To make matters worse, i tried to find a complaint link on their website since the Branch Manager was of no assistance and no such link exists... It's ridiculous that they can't even fix their own mistakes.
Since reading all the complaints regarding Bank of America, I don't feel as bad about my problem. My issue isn't concerning account issues such as I have just read. But, I agree with others, DO NOT DEAL WITH BOA. I have never dealt with such an incompetent customer service. Last year they ran a NASCAR credit card promotion stating, "Take out a NASCAR credit card and open a checking account (with direct deposit), you will receive two tickets to a NASCAR race and upon your first purchase with the credit card, you will receive a $50 gift card for use at NASCAR.com." In August, 2009 I took out the credit card and opened a checking account. It is the end of February, 2010, and I am still fighting BOA about the rewards, which I never received. Someone never requested the race tickets for me (I did finally receive a few race points at NASCAR. com in lieu of the tickets). I have called approx. fifteen times and talked with 15 different people (a number of them supervisors), with each one giving me a different excuse to explain why my $50 gift card has never arrived - excuses from "someone made an error", "someone didn't turn the request to the right department", "the promotion has to be researched" to state only a few. Tomorrow, I will be removing my money from Bank of America and cancelling my credit cards. Therefore, I won't be able to use the race points that I did receive to purcahse anything from NASCAR.com - promotion says the race points will only be valid as long as the checking account is open. This sounds trivial in comparison to other complaints; but has taken up hours of my time on the phone trying to get this resolved and I will do everything possible to see that other people are informed about BOA's practices.
BofA. What a bloated dysfunctional entity. I honestly try to like them, but every time I attempt to do something online with our business account, the accounts are missing or screwed up from the online system. So, about every other month a call is placed to BofA's ever changing toll free # for them to fix the issue, and it never fails, because the ph# changes, I end up spending a significant portion of an hour on hold, getting shuffled around to personnel who don't seem to have a clue what's going on.
I seriously can't believe that this Bank is going to survive much longer.
nfs charges
This banks steals hard earn money. ie I had 175.00 and some change in my account, there was 3 little pending charges leaving 145.00 and some change, that night the 3 little charges should have cleared but a check for 165.00 came in so Bank of America choose to pay the check first causing 3 NFS charges instead of 1 NFS charge.
Just read that there was a class action lawsuit regarding this kind of stuff with Bank of America. but it ended back in May of 2009 but obviously it hasn't stopped them. There still robbing there customers.
I have also been reading on Bank of America complaint this happens quite a bit. Same thing with me not knowing where to turn to get this kind of business stopped.

If the 'Bank Of America' "ANY Bank" would use a simple electronic TIME STAMP--(for date and Time) NFS charges would decrease dramatically.
In this age of technology--All I'm asking for is "REAL TIME" Transaction Postings.
And "YES!" Granny--they PAID all the "Lessor" Charges First (IN SPITE OF THE TRUE DATE AND TIME POSTING) which is WHY you're being Evicted!
There are a few occasions i.e. this week--I used my Bank Card to pay StraightTalk WHICH POSTED TO MY ACCOUNT ON APRIL 17th for $91.00.
In the middle of the night the payment "disappeared" and lost it's "Place" (Time and date)...
On the night (between the 18th and 19th) this $91.00 charge "reappeared" with a cute "triggered for NSF fee" in the log listing--ALONG with two (2) much smaller transactions.
I immediately got online (early morning on the 20th) and deposited $196.00--COVERING ALL CHARGES plus.
Fortunately, I'm on Social Security Disability--so I handed my DAILY LOGS for my NSF charges totaling $105.00 to Uncle Sam.
Ironically about 90% of NSF victims are NOT intentionally "writing 'BAD' checks."
MAKE SURE YOU PRINT AND FILE YOUR DAILY LOG OF TRANSACTIONS!
And set your Alarm clock for 2-3am EST and run another one.

I won't go on here about my problems with this screwball of a scam job bank called bank of america as it appears it is not new news what complete liars and shiesters this company is and how they have not only ripped off the taxpayers in borrowed tax money, but they have no problem turning around and doing it on an individual basis directly.
do NOT trust a single word they tell you if you are late and behind on your mortgage and/or credit cards and you make solid payment arrangements with them to get current again. They will turn around and stab you in the back when you go in to make your scheduled payment on time and tell you that your payment arrangement was never really "official" to begin with and we are very sorry your home has now gone into foreclosure (even after accepting prior payments in agreement to the scheduled payment arrangements).. BUT(this is the real kicker), they tell you, the good news is we can reinstate your mortgage for a fee - we won't tell you what that is right now - you simply must reach our office in 5 days max to find out what your "fee" will be once we decide.
I rue the day I ever ever got a mortgage through these sleaze balls... and I hope they end up doing themselves in!

See if you can understand this...We are adopting a child and one of the many things we need is a letter on letterhead from our bank simply stating that our accounts are in "good standing", signed and notorized. That's it! They said that they CAN"T do that. They told me that they can not give me anything on letterhead? We have been banking there for 15 or more years, they hold our mortgage AND just lent us $50, 000.00 to adopt but they can't give us a letter that simple. They give their employees $8, 000. to help with the cost of adoption, they have adoption loans to help with the cost of adoption but they can't give a bank customer a letter stating that their accounts are in good standing. I guess I need to switch banks!

They won't give anything with their letterhead because of dishonest people out there. A lot can be done if someone gets their letterhead. You need to see if they can fax or mail directly what you need to the adoption agency you are going through. If they will not do that then I would complain to the main office and the CEO or preident of the company. If all else fails its time to change banks.
No action on Sale of Timeshare
One, Kristian Reid, of Countrywide Timeshare Sales, contacted me in February 2008, advising of a buyer for my Mystic Dunes timeshare located in Kissimmee, Fl. A sale price of $38, 482 was quoted and I was asked to pay an advertising fee of $1, 350. My visa account was charged on February 29, 2008.
After I signed off the agreement form dated March 11, 2008, I never once received any feedback nor contact from this company concerning the sale of my timeshare. Even though they gave me a username and password to view my ad, I was never able to access it.
I would like to get some recourse from these people. They have scammed me of my hardearned money and they should be held accountable.

mortgage payment never applied
The house went into foreclosure after house was on the market over a year. Finally got a contract on the house to sell at full loan price, not a short sale. Sale was closed on October 20, 2009 and title company sent check to Bank of America. Bank of America cashed the check on 10/23/2009. The title company has a copy of cashed check, stamped by BOA. As of today December 29, 2009, Bank of America still shows my home loans as outstanding, not paid. After multiple phone calls from myself (at least 4) and title company (at least 5), Bank of America still doesn't know how to fix this. BOA still says they have no record of $125, 00 payment. Horrible, horrible company.

My main issue - I pay my mortgage on time and still receive (3 to 4 ) annoying phone calls days later. I am looking into legal action
at this time. It's always the same thing every month, They say its a dept collector and when I ask them what dept- They respond
that its a courtesy call to follow up on when I paid, When I tell them to check the records, The apologize . I am so tired of the BS Phone calls .
We have been going through the same thing. We did a modification and then two months later our payments went back up over 200.00 They told us it was because they had to pay back escrow, and it fluctuates every month. We were getting papers from two differnet addresses and nothing was ever the same amount. I was told that we were current as of March 31st of this year, two weeks ago, we received a letter in the mail statitng that we were five months behind and that we needed over five grand to save our house, as it was already in forclosure. This was just a little over a month after they told me twice that we were current on our mortgage. I never get the same person to talk with, half the time I can't understand the ones I do talk with. They clearly don't know what the are doing, and most of them have no idea what is going on with your accounts. When you find someone that seems to have a clue, they tell you that they can't be recontacted by you personally, there is no way to speak with them again for certain. THey send payments back to me when I make them, stating that they aren't enough to satisfy my monthly payment, but it isn't ever the amount that I sent them in the first place. The letter attached just states that the rest has been creditited to my account. So, then why do I keep having a past due balance? It never makes any sense at all. They said we had to pay a reinstatement fee in order to save our house, it was over 5000.00. They added late fees, attorney fees, and miscellaneous fees to it. We asked what they were, and we did not get a clear answer. To me it is just mereley money that they feel like adding to your account so someone in their higher up chairs can get an extra bonus for the day. I am so sick of working our butts off to do nothing but hand money over to a bank that is stealing from hard working people.I was sick and my husband had lost his very well paying job all around the time that they economy collapsed, putting us in a struggling position. But, we aren't any farther with this mess then we were two years ago. We just keep playing this roller coaster game, of your behind, pay more fees... They tell you, "we are here to help the home ownwer stay in their homes, if that were true, then they would stop adding all these extra useless and ridiculous fees, saying that you are late when your aren't, and actually work in truth and honesty with the home owner, so they can truely save their homes. This is a scam, and it is being covered up. Someone is filling their pockets, and trust me, it isn't the home owner. Funny thing, I got a letter about my mortage again recently. It was our account number, but not our name. Go figure! Well, I just wired them another huge amount of money, well see where we end up in a couple of days. I wish I had to money for a lawyer, because they would be handing me the signed deed free and clear, plus paying us back for all the extra and uncalled for charges that they keep tacking on. We now owe over twenty thousand dollars more than our loan started out to be in the first place, and it's funny how the papers that we have gotten recently have the same past due amount on them as they did last October. I have given them almost nine thousand dollars since Febuary of this year, and we still show that we are behind, plus owe the almost two grand more toward the payment plan for our five grand reinstatement fees. I am putting in a call to the attorney general, and I plan on sending this information to a local news station that investiagates. So tired of this..Not taking it sitting down any longer. If you really want to help fix this mortgage crisis, stop adding fees to people that are struggling. Give them actual options to be able to pay for and keep their homes. Stop making your CEO's rich with the fees that are uncalled for. At this rate, the mortgage problems will never be solved. More and more people will be homeless...How does that make you sleep at night in your million dollar homes... If you have been victimized by BAC, make a stand, let your voice be heard. In September 2008 i received a loan modification agreement in the mail from Countrywide Home Loans. Called Hope Now Program got instructions. Signed loan mod had it notarized and mailed. Completed trial period. Received loan mod approval letter in 1/2009, instructed to make next payment in March. Received 1/2009 mortgage statement principle increased to cover past due amount, interest rate lowered and term changed.
Surprise B of A still had me in a pass due status. Called B of A to tell them about clerical error and was told I didn't have modification and i didn't get credit for past due payment because it was a loan that didn't fund. Still have not been able to resolve their clerical error and they have placed me in foreclosure. Now since they have placed me in foreclosure they say I did have a loan modification.
i share all the problems that the rest of you have : no action, no response, . i researched my title today and found that bank of america is not even the owner -- at least not on the title . i am not sending them any dollars . in fact i think that we all need to unite and demand our titles free and clear . this smells of a political ploy that needs to be addressed...
We got a loan modification about a year ago . We were on the trail payment for about year and some months and three months ago Bank of America told us that our first payment was due on march 2011. That our trial payments cover our mortgage until march 2011. That we didn't have to pay Nov, Dec, Jan. We have documents stating this..We call Bank America and they told us the same thing. Now we our three months behind and they want the money for the last three months, after they told us and verified the documents we got in the mail were correct. We don't know what to do... I need some advice.:(
I agree Bank of America is a unethical company who has caused a great deal of harm to Americans and has not been held accountable for their actions. I myeslf have had more problems concerning my home loan then I can count. It is hard to understand how they continue to cause so much destruction in the lives of so many and no one does anything about it. Our President, elected officials, regulation agencies, and our courts all seem to be content with allowing B of A to rip off good tax paying Americans. We see the results that this un-checked bad behavior causes and still no action from those in a position to do anything about it. These are people lucky enough to have jobs and to act so irresponsible and carelesss with that job is another strike against those already suffering in these difficult times. I would like to find out what I can do to assist in stopping B of A from harming anyone else. If enough people get involved maybe we can create change. Bank of America must be held accountable.

Unfortunately, with my home loan being with COuntrywide I was forced to deal with the DEVIL (aka... lost payment
It has now been 3 weeks since I faxed and sent by registered mail, proof of the mortgage payment that I made in October and that they say that I didn't. Since I had not received any kind of acknowledgment that they received the check (front and back), I telephoned customer no-service, getting transferred 5 times from department to department. I finally reached Irene, who looked up my account. She said that they did receive the check, but did not receive the payment. What kind of sense does that make? What have they done with my payment that they obviously received and why isn't anyone helping me. I have never ever seen such poor customer service in my life.
I basically did what you did and after 4 agonizing months my payment was found in another account. Not only did I telephone, e-mail and fax all pertinent information to them, I visited 2 branches (3 times). I never received ANY customer service. It was the Office of the Comptroller of the Currency which finally resolved the matter. I too was worried about my credit rating and got a letter from BofA regarding credit reports. What an ordeal and since, I have canceled my BoA credit cards and will, in time, withdraw all of my business.

I made a payment through my online banking (also B of A) just as I have done every month for the past 3 years. The payment was made mid November '09 and it was on time. Two weeks later I received a call stating that I owed a late fee of $47+. While on the phone, I stated that the payment was already made but went ahead and sent in an additional $50 to cover it. Since then, I have received calls from a debt collector every 2 - 3 days because they have not received my payment. Both I and Bank of America have sent in proof of payment to the Bank of America Home Loans research department. The December '09 payment went in via check and was received fine.
Latest inquiries to B of A are that the Home Loans department still need more time to research this and the earliest B of A can contact B of A Home Loans for any further information is January 5th, 2010.
They lost my money within their own company and now I have debt collectors hasseling us and our credit score is certainly going to be affected by this. Funny thing about this, when I was able to speak to someone about this and they couldn't find my payment (even though they have the proof that it was sent on their screen) they had the nerve to ask if I wanted to refinance with B of A at that time.
Bank of American has been losing our payments since 2009 and for the 2nd time in a month there is a photographer taking pictures of my home. Every inquiry that I have made regarding my lost payments have never been answered. I have double paid thousands of dollars to keep my house. In fact in 2009 a neighbor knocked on the door and wanted to know when would we be moving out b/c he gets all his rentals from foreclosures and that was when we found out that BOA listed our home for sale in all the local papers...this is illegal...no notification, and no local papers should be used only one available to the locality. I have had a lawyer since 2009.
I also had my nov '09 pymt lost as well as july '10 payment lost. BofA has now forced my family home into foreclosure. I am trying the steps above. But at this point they have ruined my credit, as well as destroying my marriage. This is insane, and by the looks of it, common. Thank you for your posts.
I have owned my condo for 4 years, three of the years all of my mortgage payments were on time. I started a retail business and due to economy was having a rough time. I was proactive in contacting Bank of American because I knew soon I was going to have a rough time. They said I qualified for the home modification program I was given a new monthly payment trial period which is now at 6 months and I was told after the first three payments I would get the final modification. I got a letter 3 weeks ago stating i was denied the program and no details as to what to do. so freaking out, I called them and they stated that a letter was going to come to me as to what my payment plan was going to be. I stated that i can start paying the mortgage but can't pay the 11, 000 due from the modification process, they stated no problem you would get a payment plan. well i got that letter and it stated that i was going to go into foreclosure.. that was it.. no plan... i am so shocked as to one why i don't qualify (i had no income in 2008 or 2009) why i wasn't given alternative options.. it's not like i just stop paying for my mortgage.. ugh.. does any one else out there have this modification problem...
BofA sent my April payment back. When I called they said your house is in foreclosure. WTF?"You haven't made a payment in 20 months. Your house has been in foreclosure since FEB 17 2010" Even though they and Countrywide have taken my payments since Feb 2009. They won't talk to me, I have to fax a letter of expanation to some Dept. that customer Service doesn't have a real phone number for, only the FAX. Who can help me? State Dept of Justice says, we'll get back to you. My head is gonna explode I'm sooo pissed.
I have posted this elsewhere, but it bears repeating. perhaps if BoFA gets enough of these complaints from people who (1) made their payment on time (2) had their payment cashed by BoFA, only to have BoFA not apply the payment (3) provided proof to BoFA of the cancelled check, only to have BoFA not resolve it and (4) have debt collectors (aka the "Home Retention" division) call for the payment you have already made then do the following: 1 - file an online complaint with Office of the Comptroller of the Currency (they are responsible for BoFA's oversight); 2 -file a complaint with your state's Commissioner of Banks; 3- most importantly email a 1 page letter to the President of Mortgage, Home Equity & Insurance Services at: Barbara.J.Desoer@bankofamerica.com. The last leg is what did the trick, but you must do the other 2 in order to have a paper trail and to stop annoying calls from the "Home Retention" division. Once you tell these folks you have filed a complaint, the calls will stop. BoFA is required by law to respond to these complaints within a certain period of time. My problem, which was the same as yours, has been fixed. Be sure that they give you a letter for your files amending your credit report and that they provide a corrected 2009 Transaction History so that you can claim the correct amount of interest on your tax return. I would tell everyone you know, like I do constantly, to stay entirely away from these scammers, as it will be a matter of time before they have money stolen from them. amazing to me how a company as large as B of A actually can have computer "glitches" ! that's a laugh.. coincidental or ? I'm sure we all know the answer to that one!
Bank of America lost two of my payments. maybe three. Just by chance I caught a photographer taking pictures of my house for Bank of America this past Sunday. All my mortgage statements reflect current. Now I find out my house is in danger of being reported for default. What would have happened if I didn't catch the man snooping around with a camera? Does B of A want to steal my house? After showing my cancelled checks, they still say I didn't make a payment. Is this notoriously bad management or a criminal act? Either way, they should never get a penny of federal money. B of A should never be allowed to do business. Ever.

This is a complaint against BofA web service. This happens every payroll week. Bank of America always seems to be able to get several hundred dollars from my family account, and this is the holiday season which is truly despicable. On [protected] online web stated that we had $109.00 available. The next day we are negative. I verify all the transactions so I thought we were safe. I reevaluated it and you showed me the wrong information making me believe there was money in the bank. Now your company has benefited for the last pasted year. I will be looking into legal action as this seems to be a pattern. This is unfair! Additionally, I setup a low balance alert (which BofA offers) and it has stopped working, I go online to reset it and an error message says "try again later"...repeating 3 days in a round, results with the same message.

For more than 20 years I had a Quantum credit card with MBNA bank.
My credit line was $100, 000, I used the card often and my repayment history was flawless. On several occasions I drew against the line to pay income taxes (no problem EVER...a 5 minute transaction on the phone).
Then Bank of America bought MBNA's Quantum cards.
Almost immediately B of A notified me of a significant reduction in my credit line and a patently unacceptable raise in the interest rate (from 9.1 % fixed to 29.9% variable!). This is despite a FLAWLESS credit and repayment history with MBNA.
I declined.
We negotiated the following:
1. I would never again use the Quantum card and they would retain the account until paid off in full.
2. They would issue a B ofA "platinum Master Card" with a fixed rate of 9.9 and a line of $25, 000.
Yesterday I called to request a cash advance/wire transfer of $15, 000.
In the past a simple and straightforward 5-10 minute exchange (using Quantum with MBNA).
I was asked the following questions:
What do you do for a living, what is your annual income, why have you not paid the last cash advance off more quickly, what do you need this money for?
I balked and asked for a supervisor.
He declined.
I demanded a supervisor.
He processed my transaction...but ONLY after informing me that the B of A credit card default rate is "11.9%" and that B of A is "hemorrhaging" credit card debt money.
Frankly, I don't give a damn. They solicited credit cards from un-ceditworthy people, on a wholesale basis, for decades. The chickens are now roosting.
My vote: let B of A fail...and fail spectacularly. They merit failure, are not too big to fail and deserve not ONE CENT more of taxpayer bailout moneys.

making home affordable plan
In July we were contacted by Bank of America offering its Making Home Affordable Plan to lower our house payments and interest rate. We went through a ton of paperwork and were told not to make our August payment so we could qualify for the 3 month forbearance. The 3 months of payments were lowered about 80 dollars and we were told to sent them to a new york address. During this time I made numerous calls to ensure everything was alright. In mid November I called them and they said we were fine and we qualified for the program. We then received a new loan number and notification of the new BAC address to send the loan payment to.
Then suddenly we started receiving threatening letters telling us they were trying to collect a debt. I made more phone calls and everyone I talked to said do not worry everything is being updated you will not owe anything, everything is fine the payments simply have not been transfered over yet.
Then today we get a nasty call telling us we owe them 1500 dollars past due on the account they want it now!
I spent another hour on the phone with a Pakastani sounding person that said they were a supervisor telling me I wasn't smart, i should have known I would owe this money and my payment was more then what I was sending.
I told him I had never received any other notification telling me any other amount and I was not happy that we were being scammed like this. They literally did not care! They simply said we did not qualify for their program even though we had never missed any payments. They made us skip the August payment by their demand that we not pay it. Now it suddenly is overdue and we are being threatened with foreclosure. Every tax payer helped bail out this corrupt Bank that is scamming their customers and I want the world to know it is time they paid for it!

Additionally... you are also right about the Office of the CEO & President of BofA. They made it sound as though everything would be smooth sailing and my modification would be approved and complete within three weeks. Simply more lies. I was promised a Senior MHA reviewer would personally oversee my modification, instead of it going through several different departments and dozens of different reviewers. Of course this did not happen and I was simply thrown back into the same mess I was in to begin with.
Since I contacted the OCC, a new governing body has been formed. I believe the OCC is part of that governing body but there are several other agencies involved too. I wish I had the name for you, but I don't. I hope you can find it on the internet.
Also, contact HAMP, with the Dept of Treasury. They were actually very active in following my case. Unfortunately, it was too late. By the time HAMP got involved with my case, BofA was behaving and following HAMP protocol. My HAMP contact was empathic; he believed the things I told him about my history and what BofA had done, but he is under strict guidelines and couldn't review my case log retroactively. By the time he was involved, BofA, by HAMP guidelines, were following protocol. SO... if you can get a case opened with HAMP soon enough for them to see what BofA is doing (they do review the last few months of their processes) then you have a chance of success. I believe you're right; that the Attorney General is in bed with Bank of America, as evidenced by her dismissal of one of the largest lawsuits in history (over 1000+ complaintants) against a bank, which is Bank of America. Complaintants were all victims of fraudulent or poorly managed modifications by BofA.
I did finally get my complaint escalated to the HAMP Department in the Department of Treasury. The HAMP rep assigned to my case was quite helpful and responsive, contacting me 1-2 times per week. He was "babysitting" BofA in their process of handling my modification but sadly, by this point in time, it was too late for him to have witnessed all of their blunders, lies and blatant fraud. My house was sold at auction in February 2012. I considered retaining representation to sue BofA, but 1- I was unable to find an attorney willing to take the case and 2- I finally had to weigh the pros & cons and let it go. The stress, pressure and anxiety I experienced for three years had taken a terrible toll on my physical, mental and emotional well-being and it was time to simply cut my losses (albeit my HOME!) and move on. However, if anyone out there has had any success at all in suing BofA for their shameless actions in handling the MHA modifications, please do let me know.

OK. I HOPE this information will help others struggling with a BofA MHA modification. I submitted an online complaint to the OCC (Office of the Comptroller of the Currency). They are the regulating body for large national banks. Less than a week later, I received a call from BofA's Office of the CEO and President. They didn't mention the OCC, so I wasn't certain if my complaint was what prompted the call. I discovered yesterday that it WAS my complaint. The OCC contacted BofA about my complaint. Now, I am working with the Office of the CEO and President of BofA. They have assigned a very senior "Negotiator" to process our modification from the beginning to end. He will be personally handling and processing my modification from scratch, rather than it being touched by dozens and dozens of different departments and people. I suggested anyone having difficulties go to www.occ.gov and locate the online complaint link. Let your voice be heard. Hopefully the more the OCC hears complaints about BofA, the more closely the OCC will scrutinize their unethical practices. Best of luck.
We are in the same boat. These people have been modifying my loan for 3 years and now come back with a monthly payment of almost 4, 000 a month on a loan for 210, 000. Instead of helping, they doubled my payment, claiming it was due to taxes and insurance. But my payment always included taxes and insurance and it was 1800.00. Some help they are, seems to me like they are just trying to steal homes they think they can sell on their own for a profit. Shame on them.
BOA denied the so-called " MHF" plan after originally telling us that we qualified for it. We sent in a lot of documents to prove we qualified. Our pymt went down by $80. or so. Then, 6 mos later, they tell us we don't qualify for it because the "investor(s)" on our loan do not contract with the MHF plan. Such BS! But thanks for your insight. Now I see first hand what BOA is doing. This is just one more strategy in our country to destroy the middle class. These banks were bailed out billions of our tax payer dollars to help the American people. Looks like they are busy helping themselves.

Several weeks ago, some stranger knocked on my door, demanding to know if the homeowner lived here. I asked him to identify himself, and he only said he was hired by BOA to find out if the homeowner lived here. I confirmed yes, and asked what this was about. He said he knew nothing other than what he was sent out to do. I still don't know what the purpose of that was, but now I think I better find out. Thanks again. I will follow up on your suggestions.
Adriana, I'm sure that you've seen on the news how all 50 states have now put a halt of foreclosures due to that "robo-signing" of foreclosure documents. What has been going on is lenders like BOA have basically just been signing documents that courts need in order to foreclose on properties and the lenders aren't even doing any cross checking on ANYTHING to even make sure that THEY actually own the property being foreclosed on. The majority of loans made from the mid 90's on have been "sliced & diced" up so that nobody (lenders) really knows who all owns what. The way I can best describe it is to use an example like let's say there's a loan for $100, 000, a lender owns THAT 100, 000 loan but then takes that loan and creates 100 $1, 000 loans. They then sell each of those $1, 000 loans to different investors OR they "package" 10 $1, 000 loans each from different borrowers together and sell it for $10, 000. The original loan is "sliced" up so many times and bundled with other people's loans that it becomes practically impossible to figure out who all the invertors are that now all together hold your original $100, 000 loan. Make any sense? It pretty much SHOULDN'T since that's why they did it.. so that when the entire system collapses, like it did, nobody can figure out who owes what or who owns what. Why these people and lenders and banks aren't all being charged with felony fraud among other charges is beyond me. If you or I were to accidentally get $100 too much from a auto teller machine and keep it they'd arrest you and throw away the key.. but these lenders literally steal TRILLIONS of dollars and nothing happens.. and.. in fact they all give them selves billion dollar bonuses at the end of the year. The rich get away with everything and the middle class is destroyed. I don't want to get "political" here but.. there's just WAY too much money going into the Senator's pockets of a certain side of our political system. What I would suggest that you do, and this is up to you, is call your state's Attorney General's office and try to get them to INCLUDE your loan and abuses into their suit against unfair/predatory lending practices and/or any suits they may have regarding foreclosures on loans that the lender didn't verify as being THEIR LOAN. I have BOA break & enter into my home, change all my locks and STEAL VALUABLES all while my house was NOT foreclosed on and STILL ISN'T! And to top THAT off in the court records for the foreclosure that BOA WAS trying to push through BOA isn't even listed at all as the lender. The court records show "US BANK" as the lender! My loan is through BOA after originating through Countrywide. Nowhere EVERY was US BANK involved but yet US BANK is the lender trying to foreclose and on top of that BOA used a CROW BAR to pry open my front door, steal things and change my locks? The lenders flat out don't have a clue who's doing what or who owns what. They are just assuming that they hold your loan and file with the courts as being the lender even when they may not be. I know for a fact that it WAS BOA who broke into my house and stole valuables and changed my locks because they posted a form on my door window that says "BOA Servicing has completed the winterization of this property on" and it has the date and is signed by some subcontractor company who BOA contracted to steal my things and change my locks. UNREAL huh?
So, again, I would contact your state's AG office and request that you be added into any and all suits being filed against lenders. I don't know how much, if any, it could help.. BUT.. at this point the 'system' is so bogged down and overwhelmed with foreclosures I don't see any other way left. Again, I'm NOT giving you ANY legal advice but I am offering suggestions on how you might be able to get some help. :-)
This is a tragedy. I've been working on a modification with BofA since April 2009. After about 6 months approved and put on trial payment program for 3 months, after which process to formally approve modification would begin. TODAY, December 14, 2010, I am still waiting, arguing, being told denied due to lack of documentation, sent to appeals department, that I don't qualify and they are considering "in house" options, etc, etc, etc. I too am starting to believe Bof A is scamming us. What a mess. I'm not sure where to turn.
Hi, sorry to hear everything you're going through.. BOA really doesn't know what's going on in different departments, it's like the saying "one hand not knowing what the other is doing". I too have gone through all my senators and congressmen and gotten nowhere. I truely don't want to sound pessimistic but I want you to get very agressive with whatever route you go or else you will be "lost" in their system and then things get really bad. As far as bankruptcy, from what I was told is that it doesn't ALWAYS "protect" you from a foreclosure. Once bankruptcy is filed it will stop a foreclosure but then the lender can appeal and "get around" the bankruptcy protection, so it SOMETIMES can protect you but if the lender has agressive attorneys it will just be a delay in the foreclosure. Like I said, that was what I was explained and it might not be accurate or could be different in your state but I thought I'd pass it along. What you really need to do is not accept talking to the lower level people dealing with your loan, you must get the contact information for supervisors who can get to the bottom of things. It's not easy but when you call, write down everyone you talk to and the time & dates and then keep asking to speak with their supervisor or manager or ANYONE above them. Once you get to someone who is actually able to look at your loan and situation, BE calm and respectful and offer to provide them with ANYTHING they need ANYTIME they ask. They have to deal with screaming people all day and to hear someone who's rational and will be providing them with all the "tools" THEY need to get their job done is a good thing. Good luck and also get opinions from multiple attorneys, some will say the same things.. others may have a better solution or approach. GOOD LUCK! (:^D

I entered into a contract to buy a property in May 2009. This property went from a straight sale, to a AS IS, to a Short Sale. Now to I dont qualify for a mortgage as of November 2009, after being pre qualified for $250, 000 in May 2009. I worked in ILLINOIS and commuted my assigment was completed in July 2009 at which time I thought I would have been moving in to my new home only to have closing date after closing changes and then to be told by Bank of America you must show proof of employment to get the loan and that is a FHA requirement, after speaking with FHA I was Emailed this article FAQ: How does FHA view borrowers who change jobs frequently. During the course of events I was not pushing to hard for an assignment since I know I have to move and I will likely be out of town working, since I dont see much happening around here. I took out a Gold option loan and the agreement was for a fixed rate loan to be paid off within 5 years. They changed the loan to a revolving variable rate account. I finally paid back double the amount of my 5 year loan after 10 long years. After that I called and asked for a statement of interest paid on this loan and was told it would go out in two weeks. Now I've received a letter asking me to call them about my request. I'm sure they will not give me what I'm asking for because they are afraid we may all band together and do something. Please, please notify me if someone starts a suit against them over the gold option loan ripoff.

We are all in the same sinking boat. I just found out today they no longer offer this Gold Option Scam. Well they tell me they are now closing it and will not affect my credit since it is no longer offered. I called and said so how does this work? If I carry a balance and there is no available credit will that not impact my credit ratios since my score is almost 800. They transferred me 4 times then finally some lady laughed at me and promptly hung up. Well I was beyond livid with these thieves and explained I am closing on a home this Friday and they are like oh send a note and we will find that department for you. What ? Find the department? How did you lose it? It is on my paper and this is the number and now I am talking to you so could you direct me to a supervisor? Dead air, music and then disconnect again. Now I am escalating this as it is beyond shameful and we should all get into a class action together for this shameful organization. We have all worked hard to be able to pay loans and borrow money only to have this place fly their CEO around and have lavish vacations on our interest and their fat bonuses. I say we all get together and wait for some real answers. I am still trying to figure out my situation. I am just appalled at no warning and then this bogus letter with no real department to assist customers.

I also have a bank of america gold line of credit and have had it for seven years since april 2008 paid timely but have been told I cannot use it and it is showing late fees assessed and that all that can be offered to me is a credit card at 22 percent. I spoke with several customer reps to no avail and finally have submitted a complaint through the consumer finance protection agency which got me to the assistant vice president at boa. They now have sixty days to respond to me but I have 11 days left to make a payment on the account. I have been told I can use it for balance transfers but going online it says I cannot use it that way and have to apply for a new account to make balance transfers. Also that person said if I did make a balance transfer they would pull a hard credit check on me which is illegal. And it doesn't even make sense. I remember calling in at some point to ask if I borrowed off of it what the payments would be and they said they would shorten the term from 96 to 36 and raise the monthly amount to an amount I could not afford. Therefore I have had this line of credit for seven years without having access to funds in it and that has in turn affected my credit report and fico score for seven years but now they're telling me they will check my credit report and even more negatively affect me even though they are and have been affecting my credit score for seven years? Doesn't even make sense and I am pretty sure the whole thing is illegal.Plus I have already applied for and gotten a new credit account because I was told I could not use the account at all. I would advise anyone having or who has had problems with this account to complain to the consumer finance protection bureau because the more complaints they get the more likely they are to investigate.
I took out the Gold option loan in 2008 $35, 000 for the 60 months at 835.00 a month . Right from the start they put two payments on the same month and claimed I was late for that month. When I noticed that the balance never went down I called them. They assured me that it would. They just get all the interest up front. Not to worry it would be payed off in the said time. After six years and $58, 000. They claim I still owe them $27, 000 and have sent me a letter from their lawyer. Why in gods name do that get to keep robbing people! Is it too much to ask to be able to borrow money and not be scammed. God knows they make plenty of it without being crooked. I would have been better off going to a loan shark at least then I would know who I was dealing with. I feel as if I have payed them plenty. They got their money back and made interest off of it. Why do they get to rob me blind. What a dirty dirty dirty business they run! As they fly in their private planes. Go on vacation after vacation. All from the money they have scammed out of people who are just trying to make ends meet and they want to take more.
I agree! These stories well match my own. I took out a Gold option credit line for 42580 in 2008 for a 5 year term. It is now 2014 and I am still paying on it and accruing interest and mysteriously it now states I took out a cash advance in 2013 ( which did not happen ) No one tells the same story when you call there...You can be assured I will be contacting an attorney over this one. Oh and coincidentally, they no longer offer this loan
I have or had a Gold Option account and also had a 780 or better FICO score. I opened my account in December of 2009. By March I had a balance of $4, 800 on the $10, 000 line of credit. I payed $2, 500 for April's payment knocking the balance down to around $2, 300. Two weeks ago i tried to use the account to complete my new bathroom installation and was denied. Several confused representatives told me that the Gold Option accounts had been discontinued bank-wide.
Now I am stuck with an unfinished house renovation, balance and no available credit on this account. My current statement states that the account has $7, 300 available credit. All of my payments have been on time and in excess of the minimum amount due.
I spoke with a rep for a third time to resubmit my credit application to obtain or continue with a different line of credit. They sent me a letter denying me credit based on a review of my credit. They passed this off on me. My credit has not changed in 4 months time? Bank of America must be bordering on illegal business practices I would think. I am surprised that they can get away with these unethical practices.
I also have a Gold Option account. I was just on the phone with a representative and, by the way, they are not well-trained to answer all questions: They tend to use "I am not trained in that area" as an excuse when they do not want to asnwer a customer's question. I contacted them because, much to my surprise, the Gold Option account, suddently was called "a credit card account" on my monthly e-mail reminder, even though online it is still Gold Option. It was originally a loan I obtained after fighting for it accusing them of descrimination; indeed, they recanded and gave me the loan. It is small actually, and I have been paying for 5 years now. Apparently, it was a revolving type of line of credit, but I was not used it as such. I considered it a loan, period. I suppose, it was not good enough that for BofA that I was not borrowing from it and paying on time and it was in good standing. The rep I spoke to informed me that they are closing and discontinuing all Gold Option Loans/accounts. I then asked if they could review their decision and let ME close it instead of the bank, so it would look better of my credit reports. He said they cannot do that: "once an account has been closed, they cannot reopen it so the customer can close it". I know this is a lie, because I know people who did just that with other banks. In any event, no letter was sent to inform me ahead of time this were to happen and that my account (although it still shows as open online), it was going to be closed. It is hard to know if BofA feared I would borrow from it or was displeased with the fact I paid on time and never used it.
It is always a no-win situations with crook banks. I have been a loyal customer for 11 years. My credit union is starting to look really good...:)
We also have that Gold option "Loan"...it's not a loan at all. It was pushed as a non collateralized "Loan" but it's simply a unsecure line of credit. Our interest rate never went up but we cannot borrow against it because BOFA sent us a letter telling us that if we did our interest rate would or could go up to over 27% without notice. So we have a so called Loan which was not a loan with a supposedly fixed rate of interest that is not a fixed rate of interest and we cannot borrow against it because our rate would go so high we could no longer afford to pay it. Ours was for 96 months too...we are about 4 years into paying on it, hardly made a dent. It appears that 13.99 percent interest rate really comes out to about 50% interest since only 1/2 of what we pay goes towards the principal the way they have it structured. It would be less if it were a credit card. We are thinking of moving the balance off on a credit card.

Bank of America is beginning foreclosure on a property of mine which is current with its' monthly payments.
I have owned this property for 20 years and have never missed a payment. They allege that I missed the October
payment. Payments are made automatically out of a money market fund and I have verified that this payment was made in a timely manner.

About three months ago my accounts were almost emptied due to fraudulent wire transfers. I had just moved out of state and my wife was to come up weeks after me. She was still in Fl and received letters of fraudulent wires. Not even mentioning that weeks before that Bank of America contacted me saying that they caught fraud on my checking account and that they would close my accounts. Needless to say they closed my checking and left my savings open? Why? So then the wire transfers happened and my wife went to the bank. Four hours later we resolved closing the account and the said after the complaint was filed we would get our money back. In the four hours of my wife being at the bank the lady helping her got up twice and opened her door as to let her out and said I don't know what else to do for you. Then why work there? So we called and filed the complaint and they said we should get our money back in two weeks. Needless to say 3 months later and no money. Now we just get the run around and they say they can't even see anything in their system. What they are doing is wrong. They say their online banking is secure, well we found out when my wife was at the bank the lady helping her was on the phone with someone that said our online banking is where it was started. annual fee for the credit card.
I had taken Secure credit card with $29 annual fee from Bank of America for which I deposited $99 for security deposited. After finishing 9 months, as per my requested they converted my secured card to unsecured (regular) card and also returned my security deposit of $99. While converting, customer care associate confirmed that there won't be any annual fee as now it is converted into regular card with no annual fee.
After one year, they charged me $29 and they are saying that the card is with annual fee and they are sorry if any customer care associate had misguided me and they can't do anything and I have to pay the annual fee.
I would not have continued with the card if it was having annual fee while converting secured to unsecured card. but I continued because associate told that there won't be annual fee.
Bank of America people don't do what they have said and they are giving wrong information to customers.

escrow account - insureance payment
Bank of America was suppose to paid my Home Owners Insurance on 9/14/09; on 10/14/09 I received a letter from AAA stating no payment had been received. BoA said they would place a stop payment on the check on 10/15/09 and send out a new check. On 10/27/09 I had to pay for my insurance via a credit card and BoA informed me that a stop payment had not been issued but the check had been sent to research and it would take 10-15 days to be completed. And, they set me up with their own insuance that would cost more. On 11/3/09 BoA was waiting for the funds to be deposited back into my Escrow account and a check would be sent to me. BoA would call me by Friday, 11/6/09 to confirm payment. Spoke with BoA on 11/12/09 they are still waiting for the funds to be deposited and it could take 30-90 days before I would receive a check. No supervisor would talk to me and still has not called me. Let's see, check was issued by BoA, stopped by BoA, and they received the funds with in 24 hours but it takes 90 days to send to me.

BOA talks in circles! I have tried to get an answer as to why my escrow account needs to be 1600.00 over the amount needed for tax, insurance and the 1000.00 set in reserve. Last year I received a check because the escrow account is over the amount needed and was told that I should not use the money I get back because you never know I may need to put more money in the account later and then I would have it. OK I guess I should not wonder why, when the banks are able to get billions of dollars of tax payer money from the government to use as they wish, who am I to complain about letting them have a couple thousand dollars to use as they wish?

My Mom is an 80 year old hearing impared woman that was always getting calls from Bank of america . As i stated earlier she is 80 and is hearing impared . They kept calling and trying to get her to enroll in this Credit Protection Plus program which she never signed up for . We contacted them and then they provided us with the phone conversation between my Mom and Bank of America two times during the conversation she stated I would like it if you speak with my Daughter yet the Bank of America rep kept on pushing her and asking her over and over again then stated she could read the info being sent in the mail . She did not sign up for this program and miss understood this man on the phone since he stated he was going to send out info in the mail . She had no idea that she signed up for this and has now been charged over $2, 000 dollars from this company. I wish you could hear how persistant this Bank of America Rep was it was an embarissment and who would do this to a woman they know is 80 years of age . What a disgrace ! I have already send the letter off to the Elder affairs office in MA. i hope this does not happen to any other older person please beware.
