Bank Of America has sent me reinstatement calculations (document attached) for my mortgage to prevent foreclosure. I also received a similar letter from B Of A attorneys. I in turn responded by remitting the exact amount requested well within the specified time limit of the letter. To which B Of A cashed the check I sent and applied payment to my outstanding mortgage balance. I have not received any written information from B Of A other than the initial reinstatement so I decided to make the normal mortgage payment about a week prior to its due date of 9 Nov 2011. To date this payment has not been applied to my account. Because of this I called the bank yesterday to determine the status of my account. I was informed that the back was still proceeding with foreclosure. Apparently the bank made a mistake in the amount they initially requested for reinstatement. They now want more money! Also, as an FYI I also filed for loan modification, twice, with them. Due to mistakes made on their end.
Here’s the thing. It isn’t that I don’t have the additional amount of money that they are now requesting. It’s a matter of principle. In the world of business they made me an offer; through the loan reinstatement. I accepted said offer by compliance of their terms by remitting payment within their requested timetable. They accepted the terms of their offer by cashing and then applying payment to my mortgage account. They had plenty of opportunity to mail out a new reinstatement letter and state that they made a mistake as well as to return funds to me; they did neither. I believe that this is a breach of good faith and contract on the part of B Of A. I don’t believe that they have been treating me fairly. My home is almost paid for, 2.7 years remaining on mortgage. I believe that B Of A is targeting me for foreclosure because it’s an opportunity to steal my home from underneath me and make a huge profit in the process.

I started calling back in 08, when the city I WORK FORCE STARTED TAKING 7.5% FROM ALL CITY EMPLOYES.ALL THE TIME WE WHERE TOLD THAT OUR PAYMENTS WERE UP TO DATE AND COULD GET ANY HELP FROM THE BANK.WE HAVE BEEN TOLD AS SOON AS WE CROSS OVER INTO THIS

180 DAYS THEN TOLD ME i MAKE TO MUCH MONEY FOR THE BANK TO HELP US.THE BANK HAS GOTTEN A LOT OF CASH FROM US TO BAIL THEM OUT, THEY HAVE LIED TO US THE PUBLIC.aFTER CALLING AND BEING SENT FROM DEPARTMENT TO DEPARTMENT WITH NO ONE ABLE TO TALK.
WE STARTED PAYING WHAT WE COULD WHICH IS 1250 MONTH.I have called over and over for someone that can help from the bank, all I have
gotten is you make to much money for us to be of any help.Just yesterday I was told even after all the documentaion that my wifes medcial problems dosenot matter, and the young women hung up the phone on us.I have yet to use nasety words when talking.Meny of us who have been through this neeed to go to court over a calss action suite, for the bank of america lieing that they have help us the people who need help.At this timee we have still been paying the 1250, b of a has gotten away with a big lie to the by taking the bail out and doing nothing to help people who need the help.

As i stated earlier i started my remod paperwork well over a year ago with them ( and not once have they called me - but instead i had to call them) to periodically find "status" ... And have RESENT them numerous docs because i assume too many people are TOUCHING and no one knows how to put things back! So now i have moved on - I am pursuing a Short Sale - I have had a tremendous response in going this route - Almost down to the wire now ! But here is the Stupid Logic on BofA's part - Why would you screw up doing a remod knowing that you will keep the customers in their home as opposed to a short sale where you are going to lose thousands and not keep the customer in it? We have lost over 200K equity in our home and that is what BofA is gonna have to suck up when they should have done a remod to keep us in our home - Go figure!

I was looking for a job and got one with BoA. I was told that I would be in collections and as it turns out, I ended up having to work as one of those, "it's in review" persons that you are all complaining about. I understand. My wife and I are homeowners, and the scary thing is that BoA bought our loan from the original mortgage company... I dread the day they screw up anything regarding our account, and I say the day because it is only a matter of time. I left the bank because I felt as if they have no moral value with their customers. I think some of the homeowners are full of themselves and do not deserve loan modifications. I am sorry, but whether or not at the time you signed your ARM loan, you didn't realize you maxing out your payment ability? That is your fault, you abused the American dream. But on the other hand, noone, atleast I think noone, signs a mortgage with the intent to not pay. There were some legit hardcases, but what you don't understand is that we didn't get paid to hear you or help you, we got paid to collect money from you.
You started your modification review, some of you were behind, some of you were current. The collections calls continued, 'until your account is current the calls will continue.' (God, I hated that job.) We were graded on how much money we could collect and how short our conversations were - under 7 minutes is what is expected. I never understood how someone could explain to you information regarding your account and have you, the homeowner, completely informed in under 7 minutes? Needless to say, I couldn't take the crap anymore. It's a 3 ring circus and the leadership is worse than the uneducated followers you speak with. It's sad. The economy is sad. California, Nevada, Michigan, Florida and it keeps going... Best of luck to you... and there are plenty of non profit organizations out there that can help you get the information that you can get on your own... personally, I would stay away from the big ones...

Bank of America and its President, Brian T. Moynihan, and one Robert Flores who says he's "from the Office of the President, Bank of America" are arrogant ###s totally out of touch with the rest of us Americans. Case in latest point is that I go to my local Senator's office for help under this HAMP, BUT the arroganr ###s, Brian T. Moynihan, and Robert Flores, leave me a telephone number I have to pay to call them at. [protected]. Zero customer service. Zero brains from Bank of America's Brian T. Moynihan, and Robert Flores. Bank of America takes billions of dollars from each and every one of us taxpayers but won't have an 800 number in Bank of America's President's Office to handle these loan mods coming in from the Congressional offices or even their customers. If I could afford long distance, you arrogant totally out-of-touch ###s Bank of America's Brian T. Moynihan and Robert Flores, I wouldn't be trying to get this legally required loan modification from Bank of America now would I?!? No wonder we tax payers had to bail Bank of America out!

I have my mortgage with Bank of america at the begining with country wide, I'm trying to obtain fair loan modification since 1 year and 10 months without paying my mortgage during the same time and bank of america seems to be deaf about everithing, they only are occupied on their interest.. I d'ont know what happen with all the money that the goverment gave to the banks to help homeowners and banks.. I'm still wating for modification, I went to the first modification meeting and this was very poor, the bank seems to want to keep the house to sell and get the cash no matter what damage is going to cause to the economy and all homeowners.. what world is this... is individual world or society.. The banks are destructing United Estates and all the espirit of the people.. the only think in hoard all the money in all planet and keep it for them.. the money have to circulate in a good a fair manner to make this economy respectable and worthy..And some vultures are appearing to make bussines with the foreclosure houses, they buy for less and rent instead to put the money in the bank, because they gain more money...

I would just like to say this complaint is for my cousins who I've seen try for thirty months trying to get help with Bank Of America.
See my cousins bought their house in 2003 and everthing was great. In 2008 my cousin Wayne Pudum received bad news he had stage three cancer. Going through operation after operation now blind but still with us thank god. My cousins got a month behind on their mortgage and sent in a partial payment of course it was sent back. Karen Purdum called Country Wide/Bank Of America and asked what they had to do.The reply was just wait we will get back to you, After two weeks Karen called C.C.S. who after six months still had no answers got with NACA who is an non-profitable organization and for as much as they did for her I can see why no one would pay them. Naca had all the papers faxed to them and after her sitting on the phone for hours after hours just trying to get in touch with someone. NACA claimed all their problems would be resolved and Bank Of America was going to work with them.Needless to say after a year in a half NACA says they tried everything and she would have to deal with Bank Of America herself. However Naca did manage to stop the bank from taking her house twice. Two weeks ago Bank Of America said they could help my cousin and remodify their loan. Now after two weeks Bank Of America says they can't help them and their house would being going up for auction 11-23-10 but then she gets a letter from them also today saying they had 60 to 90 days to get out. My whole thing is this they make $2500.00 a month their mortgage is $1805.00 why wouldn't BANK OF AMERICA just lower their interest rate and give them a new payment. Instead this company would rather see people on the street its insane because Bank of America should have helped them from the begining. This company has to be one of the sadest companies out there and I suggest everyone to count your blessings and hopefully never have a hardship. From 1 of my two adult children who tried to save their home and really got screwed by the so-called modification process. This one by BofA and the other by PNC.
Just an excerpt from a post he did today. 10/22/10

So rather than B of A help me out a year ago, they foreclosed on my 177, 000 loan... auctioned it off for $102K in Dec 2009, , and now someone just bought it for $75K ... EFFEN REALLY?

Wow...what I am reading is incredible and very sad. I keep hearing that the bank does not want to take your house, it's too much of an expense for them, yada, yada, yada...Then WHY are they processing more forclosures then modifications?

The only thing I can fathom at this time is that it's become more profitable. The under value note is written out of the books, replaced by a new one just like the forclosure noted above. The foreclosure gives them a writeoff, the new purchase gives them a new asset, new $$ at the bank. How sad...

Has anyone else experienced what appears to be 2 sets of books at BoA as they have been going through this process? I had thought that was illegal, yet it is happening.

My experience has been somewhat similar to everyone elses. Although it's truly not a strong financial position to take on a loan valued at less than the paper it's written on, we would still like to keep our home. All they need to do is take our existing mortgage with 22 yrs left, stretch it back out to 30 yrs, drop 1% interest so the payment goes down maybe $250 a month, and Tada...it's modified. We keep our house, the bank makes all of their money plus and life goes on, the RE market in the area isn't effected and the city gets their taxes. It's really just that simple. Very, Very simple, unless your BoA.

Now lets take simple to stupid, apparently the BoA way. We are underemployed due to pay reductions and loss of income, BUT we are both employed. We have some debt and the basic expenses like every homeowner. I expect things to get better. However, at this time it's rough. We applied for HAMP, have been in the program since Feb, or we should say March, since they would not accept the modified payment at a branch office? Hmmm

Meanwhile we have been receiving statements, usually around the 8th of the month for our payment due on the 1st. Hmmm.

Next comes the notice in June that we have not been approved for the modification because our loan was paid off on June 3rd. Hmmm. Imagine that, our loan has been paid off and we have been denied a modification and yet we receive notices of payments due?

Then I speak to a very nice young woman, and I will have to say for the most part the people that I have spoken with have been pleasant. She had me prepare and fax a letter of appeal. All done. Next step, we will have to wait 30 to 45 days for further paperwork. It's been probably close to 90 days since the appeal, 40 days since I last spoke to anyone at BoA.

Now when you call BoA, depending on which department you speak to determines what info you get and what's going on. One department has you in default (which I might add I was never behind until I started this program) - while the other can see where I made my modified payments on time. YET, I have never received any documentation from the bank referencing the modified payments and how they have been applied. If you speak to the two different departments, you get two different answers because they are not looking at the same set of numbers, which leads me to believe there are two sets of books?

Today we received a "notice of intent to accelerate". Although we have been making our modified payments, according to this set of books we are now two months behind plus late fees. Well actually they did reduce the amount by September's payment, but apparently October's payment has not hit this set of books yet. Simple to stupid!

And for all you negative people out there, still living comfortably, that have zero compassion for your fellow Americans, we who have been seriously effected by this economy pay taxes to. We are not looking for a hand out. And I can see why people are walking away from their homes. Why stay and pay rent and take care of your house for the bank while they process you for foreclosure. When did doing the right thing, become the wrong thing?

I have been working with Bank of America for 18 months on loan modification. First of all, they wouldn't even talk to me unless I was behind. I was forced to play their game. I paid them "trial" payments for 11 months, all before they were even due. I finally get a modification package which noone has been able to talk to me about. I was told that was their offer and it was not negotiable. The only thing they addressed was the payment. The principle went up $10, 000.00 and I had a balloon payment at the end of $18, 000.00 The house is barely worth 1/2 of the loan amount and they payment they figured out is still close to50% of my takehome. Hesitantly, I agreed to all their rediculous terms. I figured all that matters was that I could afford the payment and stay in my home. Eventually, the value of the house has to go up again. I started their new increased payments although I never got confirmation from them that they recieved my signed packet back. Here's where I lost it...after making 2 new payments, I get a letter saying I am one month behind. After talking to them, they tell me they applied my first new payment to the principle and if I don't send another payment, I will always be one month behind accruing late fees and hurting my credit. 2 payments is impossible for me to send. For over a year, I wonder...am I keeping this house or loosing it? I'm mentally drained, depressed often and have totally given up complying with their every request. For peace of mind I am ready to let them just take the house back. I can live just as well anywhere else and pay 1/2 what I'm paying here. Time to downsize, live within my means and get some peace into my life. I'm not the first, nor will I be the last to loose in such a big investment. My only regret is that I may not ever save enough for another down on a house and that my kids and grandchildren will not have a place to call their own. God knows I did my best. I'm turning in my keys...

I too have been having modification problems with bofa. I've been trying to get a modification since 12/09. They told me in July that I was declined and then said that they would run the package thru a second chance program. They then said that they would enter my protest to being declined and that they would let me know. They gave me 5 different reasons by 5 different people as to why I was declined. I was told today (11/1/10) that I've been declined again ~ no surprise! I fit all of the criteria for a modification (my income being self employed has declined because of this "recession" and my mortgage is 52% of my income). The bank just really wants to foreclose (I assume they make more money by filing foreclosure). I'm sorry that we (taxpayers) bailed out BOFA with Tarp Funds! We should have let them fail! They deserve to go Bankrupt!

Back in November I went to Bof A to request a loan modification I was declined, I had lost my job and just got a new one, I was delined because I made all of my payments on time. I was told by the agent to stop making my payments and I would receive help. Sure enough, I decided to do this after I depleted my savings.

2 months after missing payments I get an envelope from bofa saying I may qualify for a modification. great. at the time I had a credit score of 800. Okay first they say I am missing information they were kind enough to send me a fed x envelope with a pre paid fedX envelope. I got together all my paperwork and fedX it to the address that was printed on the package. They claimed they never recieved it. I was once again sent an envelope I quickly went out and recopied all my information 45 pages of my life Fed X again. Well guess what they lost that one too. I quickly clled them quite upset demanding to talk to an underwriter. I spoke to someone named Sunny. She was helpful and gave me a fax number to send thsi information to her . great I was told to go down to any Bank of america to fax it in. Bof A could not get it faxed. The following day I called Sunny the underwriter back and she wasn't available I talked to someone else who said that fax number did not exsist. So they gave me 2 other fax numbers. I went back to bank of america and they kindly faxed over to both numbers and gave me receipts showing the fax went thru. I called Sunny to see if she recieved it and she said no, but guess waht she was transferring and someone else is getting my file. okay this is now September. I have been making loan modification payments everymonth. I called back and I was told Yes we have your paperwork. I called every month and it was in process. October 28th I called to make my monthly loan modification and was told that the decison was made I WAS DECLINED! I ask them why, he said I would recieve a letter in by fed X. Sure enough I get a letter today saying I was declined "FOR FAILURE TO SUBMIT ALL PROPER DOCUMENTS"

This is the letter we sent to the attorney general that explains our modification scam.

:::::::::::This is my third complaint against Bank Of America Home loans. My husband and I purchased a home on, April 27, 2007. This was with, Countrywide. Everything was fine with our loans/payments until my husband lost his job due to being laid off on, May 19, 2009. We had enough money to sustain our bills until about August 2009. By this time he had still not found work and we were living off of unemployment, which was 1600k a month and my small income from working. Once, August, hit we started having a hard time paying our mortgage. We continued to pay but we were paying a month behind. Thus, once September 1st came, we started receiving phone calls for our late payment, for August. We did the best we could in keeping up with the payments. So, for August, September, October of 2009 we incurred late fees. When, November 1st, hit we had still not made our October 2009 payment. My husband explained to a representative that we were going through some hard times and were trying our best. We NEVER avoided their phone calls and had stayed in contact with them. This representative told my husband that he would set us up with a modification program. He said we would NOT need to pay out October payment because it would go to the very end of our loan. So, October 2009, was the ONLY payment we missed. This representative set up automatic withdraw payments directly from our bank account. Our mortgage was due on the 1st every month, and was considered late after the 14th every month. The representative set up partial payments for the 17th of every month.Thus making it a late payment. Our normal mortgage payment was 670.00$ per month. He told us we would need to pay 570.00$ of automatic payments for three months and if we did that we would be able to have our loan modified for this particular mortgage. My husband agreed and set up the automatic payments. We still received collection calls and letters. He would speak to them EVERY TIME a representative would call or he would call every time we would get a letter in the mail. From November to January EVERY SINGLE representative that he had spoken with told him that everything was fine and that they would just continue to call until the modification was set in stone. Once, January, came around we received a letter stating we were four months behind and could face foreclosure of our home. He called and spoke with a representative who informed him that our modification paperwork was never submitted. So, we were told not to pay October, and had late/partial payments from November until January. The representative he spoke with in January of 2010 told him that she was going to sent up the modification, we would now only be paying 470.00$ a month for three months of automatic payments. She also said she would fax/email him a copy of the information. We still received collection calls and then once the end of Febuary came around we were told once again that we were not set up in any program. So, from January until February we were now paying 200 dollars less then our original mortgage and it was also considered late. I then contacted the Attorney General and by doing so we FINALLY got some headway with a real modification program. Complete with documents, letters, emails, calls, underwriters, advocates etc. But from November 2009-to February 2010 we incurred late fees due to the faulty information given to us by Bank Of America representative. Bank of America still has not credited us back any late fees during that time. Keep in mind, the ONLY payment we HAD NOT paid was October. This was told not to pay.
During this whole entire time my husband was still unemployed. Every document we sent in had his unemployment information. Bank of America knew he did not have a job. They never said one thing about it. Towards the end of July, 2010 my husband started working. He was able to fax two pay stubs for completion of our modification paperwork. Two weeks before our paperwork was due, he was told that he did not qualify unless he was working. This was told to him in July. This was NEVER told to him at any other time. Thankfully, he had just finally started to work. He faxed them his two and only two pay stubs that he had. This was in July of 2010. We finally received a letter on November 2, 2011 stated that we did not qualify for a home modification due to the fact that he made to much money. Bank of America has been giving us the run around for an entire year. We were lied to for over 5 months about being modified. They set up payments after they are considered late and set up automatic payments of a smaller amount, thus we incurred THOUSANDS of dollars worth the fees and partial payments (for an entire year). We have faxed them every document they asked, only to be told they never received certain documents, then we had to fax them over and over again. We have kept in contact with them throughout this whole process. During our "real" trial modification we NEVER missed a payment, in fact we payed all of our payments before they were due on the first of every month. Now, we are disqualified for a modification because he makes to much money, when he had only been working two weeks. Now, we are being told that we are considered 6 months behind because we were only paying 700$ monthly for 5 months during our real modification. We had to set up an escrow account to even be considered for the program, which brought our "normal" mortgage up to 1000k monthly. So we have an extra 300$ x's five months to come up with and we still are being tact on late fees because they only apply payments to back pay and they apparently hole our payments until they add up to 1000k and apply them to our loan. So, every other month we are incurring fees. We cannot get on any pay back plan or forbearance program because we are considered to far behind on our mortgage. So, we owe 5k worth of late/partial payment fees.
For an entire year, Bank of America has been nothing but a headache and filled with lies and cheating. I was so distressed that I couldn't even answer the phone in fear it was them. I couldn't check the mail in fear I would receive another "possible foreclosure" letter from them. They lied TWICE about being on a modification program and they do not want to compensate our late fees for ANYTHING even though it was their representative who set up the faulty program. Throughout 5 months of being on the real modification program he was never told that the program only applied to him if he was working. They never said he could get a forbearance or a different type of modification. Then, only TWO weeks before our final paperwork is due, they tell him he has to have a job. THANK THE LORD, he had FINALLY gotten hired. Also, on his pay stubs it says his start date for employment. Now, after being strung along for so long we get denied and can't even get on a payment plan.
The only time we have every been able to make headway with them is when I complain to the Attorney General. We want to keep our home and our now in a financial position to make on-time payments, just as we were before we was laid off. But we CANNOT afford to give 5k worth the misc. charges and late fees. They are unwilling to work with us and have been full of lies after lies. We would like to make this right. And remember, this all started with two late fees (august and September of 2009) and a non payment of October (which we were told not to pay per a representative that was getting us modified).Thank you for your time in reading and reviewing this letter.

To whomever this may concern, November 24, 2010

Let me start by telling you a little bit about myself.

My name is Derrick Marquis and I reside in Corona, California. It is here I live with my 16 year old daughter and my loving wife of 19 years. I am 39 years of age. I am a full time employee of 8 years at a company in Irvine where we manufacture precision investment tooling for primarily Aerospace and Medical components. My job title is: Tooling Engineer.

Sixteen years ago when my daughter was born, my wife and I made a decision that it would be better for her to stay home and raise our daughter and I would be the one who brought home the money. We made many sacrifices throughout the years to make that happen. It was and still is a very good investment. Because of our decision my daughter is now a spiritual, responsible straight "A" student with strong morals & focused goals.

As parents who continue to survive so many odds against us, we could not be more proud of those choices that we have made.

Years ago I remember standing on my balcony at an apartment we rented in Huntington Harbor and with tears in my eyes telling myself that one day I'm going to buy a home for my family. This will be a home we can call our own. A piece of the American dream.

Myself coming from a broken family and constantly moving from place to place I never had that security that so many people had growing up. I was dedicated to not allowing that to happen to my family.

For several years we rented a small beach cottage home in Huntington beach just a mile from downtown. At the time my place of employment was only two miles away. This house was just next door to my In-laws whom I adored. We were very fortunate to have lived right next door to family for so many years. It was there my wife's mother Susie (our neighbor) passed away due to complications from Cancer. Not to long after Susan passed we were served a notice that the places were being sold and we had 90 days to move out. This news came very hard to both us and Timothy, Susan's husband. It was at this time in our lives that we decided to purchase a home.

A dear friend who at the time was a real estate agent quickly set the gears in motion. As with most home buyers we looked at a few places in surrounding areas but nothing caught our eye price wise. Knowing that time was of the essence heavy prayers set into place. Our real estate agent found a place in Corona. We got into the car and headed east. With only MLS pictures in our head we pulled up to the property and instantly fell in love. We were proud first time home owners within only a couple weeks of being served the papers at the place in Huntington Beach. It was meant to happen. The power of prayer!

We made a great sacrifice which changed our lives in many ways. Work wasn't 5 minutes away anymore. My daughters school wasn't just down the block. Timothy was 26 miles away not just next door. It was a tough transition but for the better.

Through hard work and dedication I was able to make that dream come true for my family.

We moved in on July 10th 2004.

In the years we have lived here we have spent tens of thousands of dollars on home improvements. All of these improvements were paid for with my earnings. I believe it is the cutest house on in the neighborhood.

Like so many people did when the equity in their home was substantial they took out seconds and bought cars and boats then when the housing market turned they were stuck with huge debt forcing them into foreclosure. In the years living here I have never re-financed even when the market was high. We took on a mortgage we could afford based on my income at the time.

Now, the bad news.

I don't want to bore you with all the details however if all the details are required by "you" the reader I would be more than happy to provide you with that information.

Reminder: All of my testimony from this point on is truthful backed by receipts, documents, dates, times and names of people my wife and I have spoken with.

May, 2009

Work slowed down and I fell behind on my mortgage payment by 2 months. Mind you from July of 2004 thru February of 2009 we never made one mortgage payment late. Being behind we immediately called Bank of America (BOFA) and explained to them our situation. We were told. "We had to be 3 months behind in order to qualify for the Making Home Affordable Program (HAMP)". After we had lapsed into 3 months delinquency I was asked by BOFA to fax them a long list of documents i.e.: 3 months bank statements, 6 months payroll, tax returns, expense breakdown, letter of hardship and so on. Later we were told by BOFA that "We qualified for HAMP" and that our file is currently under review. Note: We were never mailed a HAMP Packet. Two months after faxing BOFA all the documents they requested, we never heard back from them. At this time I was 5 months delinquent. I was receiving foreclosure notices in the mail and one even posted on my door, documents from Recon Trust were showing up in my mailbox and strangers were showing up taking pictures of my home. Perhaps BOFA had their fax machines hooked directly to the shredder.

My wife and I were sick from stress and with BOFA not at all working with us, we had no choice but to hire a company to help us out of our situation.

July, 2009

I did some research and decided to hire Pacific Loan Solutions (PLS) owned and operated by Jeffrey Torrez and Wassam (Sam) Ismail out of Riverside. The attorney on staff was Zachary Gonzalez LLC. I went to their location for a free consultation and they said they specialized in loan modifications, I qualified based on my criteria and they said they would be able to help me with a loan modification. I paid the company $5407.00 to do the work (1.5% of the total amount of the loan to be modified). Strange I thought but desperate. Over the course of several weeks I emailed and faxed them all the information they requested.

Months and months and Trustee sale date postponement after Trustee sale date postponement went by and nothing was happening. I was getting further and further behind on payments. BOFA would not even accept payments at this time until I came up with the full arrears. Months later after hiring PLS I got a one page form letter from BOFA stating *** MODIFICATIONS ARE NOT AN OPTION *** that our loan was non modifiable due to the fact that the investor (Wells Fargo) will not allow it. Did Pacific Loan Solutions know this and not tell me to scam me out of my money? The answer in yes. The company had an "A" rating with the BBB when I hired them and now an "F" rating. PLS shut their doors and Jeffrey, Sam and Zachary disappeared. Once again we were at a complete loss with seemingly nowhere to turn.

July 2010

After several attempts trying to explain to BOFA our situation they still were falling back on the excuse that Wells Fargo does not allow modifications, I was forced to hire another attorney. Through the state bar web site we found a reputable firm, Keefe Roberts & Associates. After a consultation Keefe was convinced that BOFA was up to something strange. We paid Keefe Roberts $2000.00, in which every dime they earned only to have BOFA send a letter to them stating that my loan was non modifiable and it wasn't an option because the investor Wells Fargo doesn't allow modifications. Keefe Roberts was even confused. Keefe and I started talking about different options, i.e.: (Lawsuit against BOFA) not an option as it would cost me ($10, 000.00) or more, Restraining order against the Trustee sale ($2500.00), Chapter 13 ($4000.00) or Short sale, ($1500.00) or of course walk away.

Don't get me wrong, Keefe Roberts is a good fair attorney but why is BOFA making me go through this nightmare? You would think BOFA would like to start getting payments from me?

My wife and I decided that we want to save our home and a chapter 13 seemed to be the best way out of this mess so we took that course. I put Keefe on the shelf and went after Zachary in hopes to get my money back so I could pay Keefe for the chapter 13 fees.

August 2010

A friend of mine and I found where Zachary Gonzalez (former PLS attorney) was practicing and confronted him in a public arena demanding my money back. He refused to refund me stating he simply did not have it, and an argument ensued. Police were even called. Finally Zachary offered to provide me the services for a Chapter 13 and court representation free of charge. I scheduled an appointment with him and the contract was agreed upon. The contract stated that Zachary Gonzalez would perform the services required for a chapter 13 free of charge. I contacted Springboard and paid the $45.00 fee to complete the online certificate course for pre-petition counseling for chapter 13. I wrote him a check for the amount of $274.00 for a chapter 13 court filing fee. Relieved I waited patiently to hear back from him.

Well that's just great now I have to call Keefe Roberts and tell him, "you know Zachary, that guy who stole fifty four hundred bucks from me, well now he's going to represent us in court". After notifying Keefe about what had happened I had a sense of relief that Zachary would make good on his promise and maybe things were starting to look up for us. Rightfully so Keefe probably thought we were nuts, however I had no choice and I did not have $4000.00 to pay Keefe for a chapter 13.

A couple of weeks went by and I had not heard back from Zachary so I decided to leave work early and go down to his office in Riverside. The secretary of the building told me she had not seen or heard from him for a couple of weeks and a lot of people were coming in asking the same question. Weak in the knees and a stomach ache I went home and later on found out he was disbarred. Evil forces are working against us once again.

Soon after, the court dismissed the case because of non activity. Thanks Zachary oh and thanks BOFA!

Now without an attorney to represent me in court and the lack of knowledge and paperwork it took to represent myself in court and the fact that 95% of all chapter 13 cases that are self represented are denied by the courts I turned back to Keefe Roberts. I wrote another check to Keefe for the amount of $2000.00 in which he continued to try and get BOFA to modify our loan to no avail.

At this time Keefe Roberts wanted to continue on with a chapter 13 but without BOFA Working with us by modifying my loan and adding my arrears to the back of the loan it seems to heavy of a burden for me.

Keep in mind by this time I am $9726.00 plus numerous days off work trying to get BOFA to modify my loan when all BOFA needed to do was help me out with my mortgage back in May of 2009. $9726.00 is 6 months of my mortgage payments to BOFA!

Why didn't BOFA tell me that modifications were NOT an option up front. Instead they lead me on for months and months allowing me to believe something was happening when actually nothing was happening. If I would have known up front that modifications on my loan were NOT an option (which I don't believe this as being true) then I could have taken a different course which would have landed me in a much better situation now.

A simple one page form letter from BOFA stating modifications are not an option is simply not enough information for me or my attorney for that matter. I thought that BOFA by law was suppose to work with the buyer by modifying their loan (if necessary) providing they have income. Wait according to BOFA you don't even need to have an income for them to work with you. Sure my hours got cut for a while but I never lost my job!

I went on (http://homeloanhelp.bankofamerica.com/en/loan-solutions.html) and here's what they say.

My wife and I even spoke with a HUD counselor who said she would take our information and give it to BOFA and that she would get back with us. We never heard from that lady again.

Of course this letter is an abridged version and I left out many small details, but in a nutshell you get the idea. Over the course of the last 18 months of hell starting back in February, 2009 I have learned a lot about a lot of things that most people should never have to know in their lifetime. I understand that it was I who fell behind on my mortgage payments back in February of last year but I never thought it would come to this. Further more I thought that's what the HAMP program was all about, Making Home Affordable Program? I am a hard working middle class American who does not rely on free government handouts to get from day to day like some people do. It was my understanding the Federal Government bailed out BOFA and set up laws forcing BOFA to use the money to help folks like myself. I was never offered that opportunity. All I ever wanted was to get back on track and current on my mortgage and to build up that sense of security I had before this nightmare occurred. It seems to me BOFA wants my home because they have no desire to work with me and start receiving payments?

I will not give my home to BOFA without a fight.

Well, once again, here we sit with a December 2nd trustee sale date looming over us and again at a complete loss with seemingly nowhere to turn.

Do I pay more of my hard earned money to high priced attorneys or would Bank of America rather have it?

The purpose of this letter was to share with people about the unlawful tactics Bank of America is putting families through. I understand you roll with the punches in life and every one's got battles to tackle. We will be moving on after all this is just a house right? Family and friends are the most important things in life. P.S. We both work and "I" make a great income. As the wife I'd like to add that the author of the comment above must have never had a drop in income and I hope he/she never does. It is hell on earth. Perhaps you don't live in California. Our unemployment rate is one of the highest in the US. As for doing work 'beneath' us. One needs to actually get hired to do any sort of work and the key word here is HIRED. Applying for over 100 jobs with no results has some bearing on the circumstances don't you think.? Judge not lest ye be judged. And yes, when we purchased the home we could afford it, we suffered a $40, 000 per year income loss. Could you maintain your lifestyle with that kind of change? If so, bless you since you are quite fortunate to have a large income. Taking action against the employer has happened but alas, no money came from it. Wanting something for nothing? Oh again, do not judge unless you are willing to be judged on your life right back. Paying every single debt on time for 25 years speaks volumes about character and should give you some insight into the kind of responsible folks we are. Again, I do pray you never feel this helplessness and never suffer the losses we've suffered. And by the way, we were just trying to take part in programs our government put in place, with our tax dollars. It's quite easy to give advice, judge & dismiss when you are not faced with the same reality, and for the record, work is not always out there. Not always. And cockamamie? Really? Bank of America did lie, did give us the run around and quite frankly, when we said we'll just start paying payments, etc, they didn't want the money. Hmmm, what do you make of that? Again, do not ever judge.

And one more comment, if your income dropped drastically, I mean truly drastically, could you afford your home? Your car? Your health insurance? Your child's needs? Food? We are not a union family so we have no guarantees for ANYTHING. We paid for our own dental insurance, the owner cancelled it because he didn't want to do the paperwork any longer. Since July 2008 looking for work but isn't better to have income than none at all? And we've never taken a dime in government "assistance", unemployment or any such thing.

CSN stores shipped a deep fryer that I had ordered from Walmart via Fed-X last week. They didn't bother to wrap it in any protective covering(brown paper anything!). Fed X delivered it to the wrong address, although my address was clearly visible. Thankfully the person they delivered it to was honest and brought it to our home. However my husband was the one they gave it to. It was to be his Christmas gift. Spent a lot on it and now any joy I could have had at giving it to him is ruined. WE're adults. I understand things can happen like that. However if I had been a mom who had bought Christmas toys for her children and had this happen, their Christmas would have been ruined.Shame on CSN stores. Will not be ordering from Walmart again..

The wife is back and by the way, I do work. You say you could handle an income loss of significance. Really? We had over 6 months worth of savings to handle our debts and responsibilities, in fact more, but it does eventually run out. Not real sure why our situation makes you angry. I believe my husband has quite clearly stated we are not asking for any handouts or any such thing. He has never stopped working, but his pay and hours were cut. You never did answer if you live in California. I work as well but you call us whiners. I guess you've never, ever in your life have ever had a setback of any proportion. Why is the bank bailout another story? Your tax dollars paid for that as well as ours. You OK with that? As far as cleaning houses, mowing lawns, etc, you must be assuming I have no qualifications other than that. Oddly enough, I was a legal secretary for years and as I repeatedly get turned down for jobs I'm told how "overqualified" I am. Just so you know, that legal work was fulfilling, as is being a mother, a wife & employee is for me now. Trust me, I do use the brain God gave me. Do you? I do have some qualifications for work though. It must be legal and moral. You said you made sure 'everything is in place'. I imagine that your age or where you live must not be remotely close to ours because many of my peers are suffering the same issues to different degrees right now. So while I understand you may find our situation completely of our own making, I assure you it's not. And again, I say to you ~ judge not lest ye be judged. I pray for you, your text is leading me to believe you don't care much for women that don't work full time or work two jobs. Forgive me if my assumption is incorrect but it is based on your comments.

Derrick, I understand your situation since I am living it. I had two jobs when I got my house. I got my hours cut in one and got laid off from the other. That was since may 2009 and still getting denied by BA since then. Now that I have a full time job they still not willing to work with me unless I come up with all the money that I owe in back Morgage which I cannot afford. I even went to NACA which was a told waiste of time. Now the Bank to me that they cannot help me since my loan is a FAH loan and refer me to a HUD approved Agency. Like you I want to keep my home since now I have the income to pay for my morgage. I feel like BA prefer to have the house standing there empy for monthst instead of working with me on reinstating my morgage which will bring money to their pockets.

I just made a comment to you Nana then the computer died! So hopefully this isn't a duplicate! I will sum it up quickly. I'm the wife and we understand your situation & I pray for a happy solution for you. After some research last evening I've come to find that Derrick's income has been cut to the tune of $50, 000 per year. Some negative comments were made and in frustration my husband behaved quite unlike himself but as you are going through something similar, you must know the stress that comes with. As far as our home, we both worked when we purchased it, everything was fine until hours and pay were cut so drastically. Again, I don't know where you or the other commenters live but if it's California, you must know how horrendous our economy has been and continues to be. We're happy to have jobs and while we've been filling out apps, sending out resumes, selling our items & so forth, if we don't get hired, we don't get hired. As far as 2nd jobs go, we've both had 2 jobs in the past, obviously we are hard workers and dedicated to taking care of our child and our debts but again, somebody's got to hire you and it's not happening. We both work now but our income is still down 50K per year, we've lost nearly half our yearly income in the last year and a half. I imagine Nana, you must been feeling a similar loss yourself. I have 2 friends, both with 20+ years with their jobs, now unemployed. It's a sad, sad situation here. As far as handouts, we've never taken one, nor asked for one. BofA said we qualified for a "restructuring" which seemed to have the same basic principles of refinance. We'd go back to 30 years on our mortgage with a new, lower monthly payment. We never asked for a principal reduction either. We've never refinanced but I assume it would've been very similar to restructuring. So in a nutshell, that's where we stand. We don't want something for nothing but I do believe that our hard earned tax dollars did go toward those bailouts and while we are not asking for a bailout, isn't helping the people and the economy the entire purpose for those trillions of dollars in bailout money given out for? And one last thing, most people don't expect to go back to "Go" (so to speak) when you are in your 40's so as far as being prepared, we had all the usual stuff in the place, 401K, insurance, savings and so on. Losing 50, 000 per year, you use up those reserves right quick. Nana, I hope you have a really happy and blessed Christmas.

I was hired at Countrywide in early 2007 as a loan modification supervisor. Previously I worked in Orange County's mortgage market for 7 years. It is true that we sat on loan modifications for no good reason. I personally oversaw numerous loan mods that simply went nowhere. Foreclosure proceedings were always been processed. Bank of america has been misleading me. I have a rental property that needs to be modified. They had approved it twice with another Arm Loan. I did not accept it. They also gave me 3 month trial last June 2010. After that They did not give my loan. Then they said it is not my primary residence, then all of a sudden I felt misled. They first tell me to go on default to modify loan to modify it. Then they say it is not my primary reisdence, after approving loan mod twice in the past. I am deserving of the modification because I did not get a loan I agreed to. the Broker Scott Nueberger disappeared into thin air and did not give me all of my loan docs.. I explained all this. They do not let me talk to the negotiator, or anything and now they said even after 3 month trial they that I paid on time they still did not give it to me. They lied misled me and I have ruined my credit over this.. I think they want me to foreclose for thier tax right off. Also my primary residence, I had to hire an attorney because of the run a round and lies. We need to cooperate with one another and the greed of the lenders is out of control! Tell Obama to stop giving them tax right off so they loan mofidfy everything..

Bank of America...it sounds so powerful and positive. CLUELESS is all I can say. I have never attempted to talk to 20 different people with 20 different responses in my life. They are a train wreck to say the least. They ruined my home, my life and my family due to stupidity. I hope they all rot in hell and suffer they way they are making me suffer. Modification? Hardly...scammers, con artists and should not even have "America" as part of their name.

Don't bother to reply to the B of A teenager, he is extremely judgemental. Your gripe was simply, why the hell didn't the damn bank just say upfront, no loan mod. You wasted valuable time, that would of been better spend invested in making other arrangements. I understand clearly what you are saying about how they strung you along. You did not force this institution to a loan modification and you are not capable of making several representatives tell you that you are qualified & being processed, when they in truth never began the process, they wasted your time by not being truthful. I don't know what his preaching had to do with anything, he basically is an ### who proceeded to make comments that have nothing to do with the topic at hand. B of A failed to communicate professionally that is the bottom line here. Derrick is not the problem B of A is the problem. They have contractually breached their fiduciary responsibility to communicate in a timely manner. PSUGUY is a mole or stooge for these clowns and he has tried to deflect and redirect the real problem here and it is B OF A SCREWING PEOPLE through incompetence and in MANY cases outright fraud.

Right now many banks have hired companies to defend them online by posting excuses and taunting people into ruining their points and arguments. Everyone should realize if you owned a company and it was being ridiculed online wouldnt you write things or hire a company to write things to defend your reputation.

Of course you would.

Beware of these "defenders" of companies they may come off preaching high morals and be accusatory of your motives and intent...but the fact of the matter is most of the time they are just trying to discredit you and deflect good honest points a poster makes. Such as " company X ripped me off by doing this and this and this" right away goons for will be called in to call you names; a bum or lazy or its your fault, never once talking about how its true company X has commited fraud or lied or misled or omitted.

Its a sad fact, but corporations are flexing their muscle online and they do not want the truth out there...they want more lies and deception. In my mind the legal entity of corporations should once again be banned as it has been twice before in history. They were banned in europe hundreds of years ago twice and guess what they were banned for the same crap they are doing all over again RIGHT NOW. Funny how history repeats.

I too was given the run around. Was told I don't make enough (DUH which is why I need loan mod) to make more money. As mentioned above, I too am on Social Security Disability and am not allowed to drive or work. To make comments such as these isn't it discrimination? against Americans with Disabilities Act?

I feel your pain. I've been trying to deal with BoA since May 2010 on the simple issue of terminating my PMI. Been in my house since 2004, never paid late, always paid additional principal. Currently at 70% LTV on mortgage and BoA refuses to terminate PMI without my paying for an appraisal. I have no problem with the appraisal but BoA says I have to use their company (Land Safe) which is owned by BoA. I believe thats a clear conflict of interest, been debating this issue with them sice May 2010. They are stonewalling me for a silly $39 monthly PMI payment. I'm tepmted to walk away from the house and let them have one more forclosed house to deal with.

My 70 yr old parents are going thru this EXACT thing right now! Only they are now 30 days from foreclosure. They have made every single payment on time since 2000. They have paid their insurance directly to their agent. They were late one time on their taxes. Now with the escrow, only a portion of their "automatically deducted full payments" are going to their actual payment. Which now shows late. 2 months behind! They can't get another loan b/c their credit report shows they have late payments! Until the credit report is cleared (hopefully this week) they can't do a darn thing! But we're also running out of time! Simply disgusting! We can't wait to get them away from BOA! Another SCAM!

;} I used Universal Lending to execute a modification (FTC closed their operations for fraud), then had to do it on my own. I had a friend who offered to finance the home, but after three months Bank of America still hadn't responded to multiple requests for payoff. We contacted the attorney in Monroe Louisiana who was handling the forclosure and was told they couldn't get an answer either. They finally sent me a modification just days before my home was up for auction. I signed them and sent them back FedEX. Two days later I recieved another offer. I called and told them I had sent the package off, and was told that it contained an adjustable rate and they could get it waived.. It also added back interest of over $18, 000 to the balance due of $118, 000 making the total due of over $145, 000. Since I was caught between the old rock and hardplace, I told them to go ahead with it and was put on a trial period. I fulfilled the period, (supposedly 3 months, but took over 6 months) and was sent a letter saying I qualify for the modification. The letter also in multiple places said they were preparing Agreement papers and as soon as I got them get them back in the time period stated. The wording actually was "to accept this offer, you will need to sign and return a Modification Agreement that includes the terms and conditions of the permanent modification. We are in the process of preparing your Agreement and will be sending it to you soon. Please be on the lookout for a package in the mail and return the Agreement to us by the requested date so we may finalize you loan modification". I did not recieve them within 4 weeks so I called on and was told if not recieved by June 23, 2010 call back. I waited til June 23 and still no packet. I called and was assured it was "APPROVED" but they were running behind pretty badly. They said call back if not recieved by July 23, 2010. No packet so I called on July 25, 2010. Again I was assured it was "APPROVED" and not to worry, it was taking several months to get all the paperwork out. I was told to just continue making the modification agreement payments as I had been doing. I was disabled in Janruary of 2010 and put on weekly disability payments. In Oct 2010 I was put on monthly payments paid on the 21st day of the month so I called and talked to John on the 5th day of December at 12:53 CDT. I explained the situation and he said don't worry, it would not change anything. He asked if I could afford the modification payments where they were and I told him yes. He also told me I could use direct pay by my bank at that time. He also assured me I was approved for modification and would see my paper work soon. On February 23, 2011 I recieved a call from BOA. I returned the call and was told I had been turned down. They transfered me to the DESIREE TEAM. I talked with a supervisor named Julie Nye. She said my payment was $1184.96. I explained that I had been approved each of my statements showed to continue the $983.32 Payments. She asked me to fax all that to her and she would post it to my folder. I also asked her about the turn down, and she said it did not reference that in my account. She said it showed I was still under "REVIEW". I explained the approval letter and she asked that it be sent also. Then last night, February 23, 2010 I recieved another call from another dept of BOA. I was told I had been turned down and I would be sent another packet. She also said not to be surprised if I recieved a forclosure notice and not to ignore them. She said they were sending me another package to see what other program I qualify for. So eleven months after I was sent an approval letter, and over 18 months since the process started they are now wanting to steal my home. I am now on permanent disability and would probably not qualify for any program. Where do I go from here? I have already went to the Federal Trade Commission and Louisiana's AG

DITTO. They are calling me now asking when they will receive payment and I tell them as soon as they get their s--t together. Yesterday I received yet another notice telling me that they had received a a recent request from me about my home loan (not! and are in process of obtaining the documentation and info to address questions, but need additional time to complete request. I will not send info to yet another department, who knows who is actually getting all this information and what they are doing with it. Didn't BOA have a breech of confidentiality recently? If they don't communicate with each other that is their problem not mine. I have an FHA loan, so they won't loose anything on my house, if they auction it off they will actually profit and from what I understand they are not permitted to collect on both

They are the most criminal banking organization on our planet. Quite honestly, the whole banking system needs to be replaced. I was also abused by their illegal loan mod practices. Many people are standing up and fighting these monsters:
